It is\n\n  Case. of the petitioner that any order passed in any one of\n\n_Vu_gthose_gpsuits  adversely affect his right in the suit filed by\n\n  Therefore, prays that all the three suits and FDP\n\nW\n\n\n\nproceedings should be tried by the same Court. CiVii\\,Ju--dgeVV{;'E3f;l\u00a7ri)y'4Ko_1'ar,' for disposal in accordance\nwith law by clubbing thet\u00e9tsaiciithree suits separately from FD?\n\nN0-45\/ \n\n *5;\"B.eiIig\"aggrieVed by this, the petitioner has filed this\n\nId\"gpetition.challeri\u00e9ijnigythe order in so far as clubbing the three\n\n snits'g_and directing that the FD? should be tried\n\n contrary to the interest of the petitioner and\n\nV .  \n\n\n\n6. 7. Heard the counsel for   It} is seen
\nthat the withdrawal of o.’sd.dINos}22t0t,k200s’,~0 .0840\/2008 and<\/p>\n
315\/2008 from the fi};eV_.of th’e”C.ivi1V ;,r_t-tag; Kolar and<\/p>\n
posting them to    Judge [Sr:Dn.), Kolar is not<\/p>\n
objected ‘  proceedings. The
\nobjection of t’h_e” petitiohderV_”h.er’e:i’n is only to the extent of
\ndisposal ofthe separateiy without clubbing it with FDP<\/p>\n
‘perusaimof the common order passed by the<\/p>\n
 triai dCou’1ft1 i11t\u00b0’t.h_e f.}tfI5resaid three Misc. petitions, it is seen<\/p>\n
that the”‘1*easaonirig given by the court below in withdrawing<\/p>\n
suits and posting them to the Court of the Civil<\/p>\n
 and to club them together is in order.\n<\/p>\n

8. Further the order of the Court below in directing<\/p>\n
FDP No.45\/ 2007 to be tried separately is also in order<\/p>\n
reasons that the rights of each of the parties to <\/p>\n
have to be decided separately and independentiy:iii,    <\/p>\n
suits, based on that the \ufb01nal decree proceredtirigs-. <\/p>\n
up to decide about the shares  be aliotted  of <\/p>\n
them. Insofar as FDP No.45\/ithe\ufb01rights of
\nthe parties is already  in the said<\/p>\n
