Learned counsel,             Mr. B.F.Amin,<br \/>\nappearing for the respondent, submitted that as learned counsel, Mr.<br \/>\nJadeja, appearing for the appellant, was not present even on the<br \/>\nprevious occasion, he was requested to intimate him the next date of<br \/>\nhearing which is today.         He also stated that he has<br \/>\naccordingly informed Mr. Dhiren Jadeja to attend the hearing and that<br \/>\nthe matter may otherwise be heard for final disposal.\n<\/p>\n<p>\tIn<br \/>\nthe above facts, it appears that the appeal is not attended by<br \/>\nlearned counsel, Mr. Jadeja consistently and deliberately, and<br \/>\ntherefore, there is no other option but to dismiss the appeal for<br \/>\ndefault. Accordingly, the appeal is dismissed with no order as to<br \/>\ncosts. Interim relief, if any is operating pursuant to any previous<br \/>\norder in the appeal or other interlocutory proceedings taken therein,<br \/>\nstands vacated.
