l\\_order l\ufb01assed by the Commissioner for Workmen’s<\/p>\n
 Coinjiensation, Udupi dated 18.11.2005 in Case<\/p>\n
W<\/p>\n
4<\/span><\/p>\n
No.WCA\/CR\/FC\/20\/2004 is called in question by the
\nappellants herein. MFA 1055\/06 is filed by the<\/p>\n
United India Insurance Co. Ld.. MFA is<\/p>\n
filed by the employer of deceased Kenneth <\/p>\n
Kundar. Therefore, these two~~ .appe’als” .4_’_hea.;:’d’ry<\/p>\n
together.\n<\/p>\n
2. Facts leading to this \u00a2a\u00bbs_\u00e9~ areiiasihereunder:
\nRespondent Bhaska:_r=,_ Deyapaul\ufb01Kundar” and three
\nothers filed a claim  compensation<\/p>\n
on account off’ d:\u00e9..ath”;o’fA:.Vone..__..i{enneth Nishchal<\/p>\n
Kundar   about 6 p.111. while
\ndischarging: in the course of his
\nemployment  Cars (P) Ltd. , Mangalore.
\n3-y,’neV”VcVl’a:i;mants, deceased was working as<\/p>\n
driyerj-?Vc=1\u00a7:\u00a7\u00ab._yVSales; Promotion Officer on probationary<\/p>\n
V”-~=’~bas;i.s’.__and on the unfortunate day he had taken<\/p>\n
-\u00ab.i.i’_:’:..’Ifoyota Quailis bearing No.KA-19\/21-8766 from Manipal<\/p>\n
 Chitpadi, bus bearing No.KA–20\/B-7 dashed<\/p>\n
‘a\u00a7jainst Qualis which was driven by the deceased, as<\/p>\n
V”.:_'”va:.V’result of which she died. Claim petition was<\/p>\n

5<\/span><\/p>\n
lodged on the ground that the deceased was a
\ndriver–cum-Sales Promotion. Officer of R-1 gin_ the<\/p>\n
claim petition lodged a claim petition.<\/p>\n
3. The owner of the vehicle admitted the\u00bbdeceasedgk<\/p>\n
as its employee but denied dthat’ he. was :\ufb02QEC a<\/p>\n
workmqp. It was further contended that on the date<\/p>\n
of the accident without Vprioritpernission of the
\nemployer had taken vehicle on his own even though
\nit was observed _as: a ‘\u00a7harat\u00a5 Bundh and he was
\ndriving the”tgvehicle+Elhy:l consuming alcohol.
\nTherefore} “em\u00a7;p\u00a7\u00a7g iiii Econtended; that there was no
\nrelationshiee of ‘eastern and servant. Similarly,<\/p>\n
insurance company contended that since deceased was<\/p>\n
;\u00a7a1es bt\ufb01icer and net a driver, liability cannot be<\/p>\n
4. Commissioner, considering the documents<\/p>\n
:]produced by the parties and considering the oral<\/p>\n
“Vi evidence let in by the parties, held that there was<\/p>\n
a relationship of master and servant between United<\/p>\n

Cars (P) Ltd. and the deceased since vehicle in<\/p>\n
question was insured, insurance company is_i”l_4i~able<\/p>\n
to pay compensation. Accordingly, compe__ns’at..ion\u00a7-‘.is<\/p>\n
awarded . I  _<\/p>\n
5. It is to be noted\u00bb, at this j1:1I:\u00a2:ture’=.4i’thaty<\/p>\n
immediately after the accident. claimants lodged
\nclaim petition underzijthe sf’ the Motor
\nVehicles Act, later on and
\nfiled claim  on that deceased<\/p>\n
was a workmen. .3<\/p>\n
6. The  ‘ of both the appellants
\nherein is th__at_ deceased: was not a workmen, he was<\/p>\n
an of\ufb01iicier ofillthe respondent, therefore petition<\/p>\n
filedv. _yundeyr.4f”‘~–Workmen Compensation Act was not<\/p>\n
 igdxinsurance company further contends<\/p>\n
that even if the deceased was considered as a<\/p>\n
__:Vv;;ork:na!}, liability of the insurance company is not<\/p>\n
 there as he cannot be considered as a paid driver<\/p>\n

In the circumstances, both the appellants request
\nthe court to set aside the order awarding
\ncompensation by the Comissioner. Per contra,<\/p>\n
counsel for the respondentswclaiments contends that<\/p>\n
the deceased ‘was not an officer, he_,wasa:only”ma”g<\/p>\n
workman, his duty was to promote the Saies business’<\/p>\n
and on account of the instruction of the of\ufb01icerss<\/p>\n

\nwas also eeqj\u00e9sbed~to dreve the vehicie as a driver
\nin order to conduct test–driving and to satisfy the
\ncustomers. Considering the nature of work of the<\/p>\n
deceased, even \ufb01if d:ne~’a\u00e9\u00a2\u00a7asedf could not be<\/p>\n
considered as a driver, he-has to be considered as
\na workmangc *thereforex’ his case falls under<\/p>\n
Sec.2(n\u00a7(i) of the Workmen’s Compensation Act. In<\/p>\n
the circuestances, he requests the court to dismiss<\/p>\n
7, Haring heard the counsel for the parties, what<\/p>\n
,\ufb01is.tcrbe required to be considered by this court in<\/p>\n

“Whether the deceased was a workman and whether
\npolicy issued by the Insurance Company covers
\nthe risk of such workman?”\n<\/p>\n
8. It is not in dispute that the deceased was an<\/p>\n
employee of United Cars (P) Ltd.. The questlo5.1$xy<\/p>\n
whether he was workman or an of\ufb01icerfyg\ufb01\ufb02eimantsp<\/p>\n
relying upon Ex.P-19 order of appointment isseed by<\/p>\n
the employer in favour of deceased K\ufb01ndar contends
\nthat the deceased has to be considered asia workman
\nconsidering the Vnaturel of yworkc assigned. to him.<\/p>\n
According to thegclaimantsf_deceased was required<\/p>\n
to drive iiii “the _vehicle} in “order to satisfy the
\ncustomers as a-test\u00e9driver and he has to promote<\/p>\n
business of Rel- [In order to promote the business<\/p>\n
\u00a7$\u00a3.a~:f he has to discharge all the work assigned<\/p>\n
by the employer to satisfy the customers. So, in<\/p>\n
V'<athe hcircumstances, on the ill–fated day he had<\/p>\n
-@\u00aegtaken Toyota Qualis for a test drive along with the<\/p>\n
“C\ufb01$tQm\u00e9r which vehicle met with an accident during<\/p>\n
l,ghef course of employment. Even though the<\/p>\n
h”\u00ab\u00a2ontention is raised by the employer that on that<\/p>\n

day deceased has taken the vehicle without prior
\npermission of the employer has to be ruled fo’upt in<\/p>\n
view of Ex.P-14 which is the certificate ieene\ufb01 by<\/p>\n
the Managing Director of M\/s United_Ca”rg  <\/p>\n
Mr.Ganesh Rao dated 6.2.2003 where he has certifiedii<\/p>\n
the conduct of the deceased. It\ufb01was alsLo’A.’cont.ehdedp<\/p>\n
that the deceased had  while
\ndischarging his dutiesipbip  ofvviinaterial is
\nplaced before the deceased was
\ndriving the    Be that<\/p>\n

the nature assigned to the deceased.<\/p>\n

 In the absence of such material withheld<\/p>\n
 byiwthe employer an adverse inference has to be<\/p>\n

drawn against the employer. Accordingly, we hold
\nthat the deceased was a workman and not an officer.<\/p>\n
considering the provisions of WC Act even thondh he<\/p>\n
was not a driver as he was required to discharge =<\/p>\n
with the work in any other capacity in connection"<\/p>\n
with the motor vehicle as defined under 5e\u00a7.2}h)(ie\n<\/p>\n
a) (c) of the Act, we are  that the
