JUSTICE MAHESH BHAGWATI<\/p>\n<p>Mr. J.R. Tantia, for the petitioners.\n<\/p>\n<p>Mr. G.S. Fauzdar, Public Prosecutor for the State.\n<\/p>\n<p>\t\tThis order governs the disposal of  bail application filed under Section 439 of Cr.P.C. by Mr. J.R. Tantia Advocate on behalf of the applicants pertaining to F.I.R. No. 286\/2009 at police station Cheepa Badod, District Baran, in the offences under Sections 143, 332, 353 and 452 of IPC as also Section 3 of SC\/ST (Prevention of Attrocities) Act.\n<\/p>\n<p>2.\t\tHeard the learned counsel for the petitioners and learned Public Prosecutor appearing for the State and perused the material on record.\n<\/p>\n<p>3.\t\tLearned counsel for the petitioners has canvassed that they have been falsely implicated and are in no way connected with the commission of the offences of the instant case. They are innocent. They have been in custody for quite a long time, hence, they may granted indulgence of bail.\n<\/p>\n<p>4.\t\tLearned Public Prosecutor appearing for the State has opposed the bail petition.\n<\/p>\n<p>5.\t\tHaving reflected over the submissions made at the bar and scanned the relevant material available on record, I, without expressing any opinion on the merits of the case, do feel inclined to grant bail to the accused petitioners.\n<\/p>\n<p>6.\t\tIt is, therefore, ordered that the accused petitioners namely Prahlad @ Pradeep S\/o. Kishanlal; Manoj Mittal S\/o. Poonam Chand; Pappu @ Sharif Khan S\/o. Abdul Majeed; and Anil Kumar S\/o. Brijmhan in F.I.R.
