JUSTICE AMARESH KUMAR LAL)<\/p>\n<p>Amaresh Kumar Lal, J.                The accused petitioner has preferred this revision<\/p>\n<p>                         application against the judgment and order dated 7.02.2002<\/p>\n<p>                         passed by the learned Additional Sessions Judge, VII, Patna in<\/p>\n<p>                         Cr. Appeal No.110\/1993 by which the conviction and sentence<\/p>\n<p>                         of the petitioner under Section 25 (a) and 26 of the Arms Act<\/p>\n<p>                         has been confirmed.\n<\/p>\n<p>                                     The prosecution case in brief is that on getting<\/p>\n<p>                         secret information, the informant raided the house of the<\/p>\n<p>                         accused petitioner and on seeing the raiding party, the accused<\/p>\n<p>                         started to run away after jumping through a window, but he was<\/p>\n<p>                         apprehended by the police and on his search in presence of two<\/p>\n<p>                         witnesses, a country made pistol and a live cartridge of 315 bore<\/p>\n<p>                         were recovered and seized from the waist of the petitioner. A<\/p>\n<p>                         seizure list was prepared and the accused petitioner was<\/p>\n<p>                         forwarded to custody and the police instituted the case under the<br \/>\n<span class=\"hidden_text\">                  2<\/span><\/p>\n<p>Arms Act. After investigation, charge-sheet was submitted.<\/p>\n<p>Cognizance was taken and after trial the petitioner was<\/p>\n<p>convicted under Sections 25 (a) and 26 of the Arms Act and<\/p>\n<p>sentenced to rigorous imprisonment for one year each and both<\/p>\n<p>the sentences to run concurrently vide order dated 21.05.1993<\/p>\n<p>passed in G.R.No.3961\/90, Trial No.253\/93 arising out of<\/p>\n<p>Gardanibagh P.S. Case No.541\/93. Against this order, the<\/p>\n<p>petitioner preferred Cr. Appeal No.110\/93, which has been<\/p>\n<p>dismissed and the conviction and sentence imposed by the<\/p>\n<p>learned trial court has been confirmed.\n<\/p>\n<p>             Learned counsel for the State submits that there is<\/p>\n<p>concurrent finding by both the courts&#8217; below and the learned<\/p>\n<p>trial court has given the minimum punishment to the petitioner.<\/p>\n<p>             This revision application is being disposed of<\/p>\n<p>without waiting for further time for the petitioner.<\/p>\n<p>             It appears that the learned trial court has<\/p>\n<p>considered the evidence adduced on behalf of the prosecution.<\/p>\n<p>A loaded country made pistol has been recovered from the<\/p>\n<p>possession of the petitioner and the pistol and cartridge have<\/p>\n<p>been sent for the examination and it has been found that arms<\/p>\n<p>and cartridge were fit to be used. Learned appellate court has<\/p>\n<p>considered the evidence carefully and thereafter he has upheld<\/p>\n<p>the conviction and the sentence imposed by the learned trial<br \/>\n<span class=\"hidden_text\">                                               3<\/span><\/p>\n<p>                             court.\n<\/p>\n<p>                                          Considering the facts and circumstances as stated<\/p>\n<p>                             above, I do not find any ground to disagree with the concurrent<\/p>\n<p>                             finding of both the courts below. The sentence is also not<\/p>\n<p>                             excessive. Further, I do not find any ground to interfere with the<\/p>\n<p>                             impugned order. The bail granted vide order dated 22.04.2002<\/p>\n<p>                             by this Court to the petitioner is hereby cancelled and the<\/p>\n<p>                             petitioner is directed to surrender before the learned trial court<\/p>\n<p>                             to serve out the sentence.\n<\/p>\n<p>                                          In the result, this petition is dismissed.<\/p>\n<p>                                                  ( Amaresh Kumar Lal, J.)<\/p>\n<p>Patna High Court, Patna<br \/>\nDated, the 29th July, 2011<br \/>\nN.A.F.R.\/V.K.
