This appeal is directed against the impugned order dated 22.10.2009 passed by the<\/p>\n<p>learned Single Judge dismissing the Appellant\u201fs Writ Petition (Civil) No. 7207\/2009. We<\/p>\n<p>have heard learned counsel for the parties.\n<\/p>\n<p>2.     The Appellant is a physically handicapped person. There was an advertisement<\/p>\n<p>issued by Respondent No. 3, Delhi Subordinate Service Selection Board (DSSSB), for<\/p>\n<p>the post of Staff Nurse. Admittedly, the advertisement did not provide any reservation<\/p>\n<p>for physically handicapped persons among the vacancies advertised. The Appellant<\/p>\n<p>applied under the unreserved (UR) category. Having failed to be selected, he filed the<\/p>\n<p>aforementioned writ petition in this Court.\n<\/p>\n<p>3.     The first prayer in the writ petition was to restrain the Respondents from<\/p>\n<p>appointing a person to the post pending the disposal of the writ petition. The further<\/p>\n<p>prayer was for a direction to the Respondents to make &#8220;appropriate provision for<\/p>\n<p>reservation for the disabled persons as per Section 33 of the Persons with Disabilities<\/p>\n<p>(Equal Opportunities, Protection of Rights and Full Participation) Act, 1995&#8221; (Act). The<\/p>\n<p>learned Single Judge recorded the statement of the standing counsel for Respondent No. 2<\/p>\n<p>that after the filing of the said petition by the Appellant it had been decided to make<\/p>\n<p>reservation for disabled persons in future vacancies. However, relief was denied to the<\/p>\n<p>Appellant because he had applied under the UR category.\n<\/p>\n<p>4.     It appears that the aforementioned advertisement was issued at the request of the<\/p>\n<p>Municipal Corporation of Delhi (MCD) for filling up 280 posts of Staff Nurse in the<\/p>\n<p>Health Department, MCD. We have seen a copy of the communication dated 24.11.2009<br \/>\n<span class=\"hidden_text\">LPA 545\/2009                                                              Page 1 of 2<\/span><br \/>\n by the Administrative Officer (Health), MCD in which it is pointed that the DSSSB had<\/p>\n<p>recommended 279 candidates for appointment to the post of \u201eA\u201f Grade Staff Nurse in<\/p>\n<p>MCD as against 280 vacancies. Consequently there is one vacancy to be filled up. This<\/p>\n<p>postion has been confirmed by Mr. Sanjeev Sabharwal, learned standing counsel for the<\/p>\n<p>Respondent No. 2.\n<\/p>\n<p>5.     Section 33 of Act mandates the reserving of posts for the physically disabled<\/p>\n<p>persons. Admittedly, no such reservation as mandated by the Act was made while<\/p>\n<p>issuing the advertisement in question. Since there were 280 vacancies, and 279 have<\/p>\n<p>been filled up and one is stated to be available, it appears to this Court to be in the<\/p>\n<p>interests of justice to direct that the Appellant must be admitted to the said vacant seat.<\/p>\n<p>Merely making a provision for the disabled in future in terms of the Act which has been<\/p>\n<p>in force since 1995, is not a satisfactory answer to the grievance of the Appellant. He<\/p>\n<p>cannot be faulted for applying in the UR category when in fact no provision was made for<\/p>\n<p>applying in the disabled category. Since, in any event, there is one vacancy available, the<\/p>\n<p>Appellant should be accommodated by the MCD against the aforementioned vacancy.<\/p>\n<p>We direct that this be done within a period of eight weeks from today.<\/p>\n<p>6.     The impugned judgment of the learned Single Judge is hereby set aside. The<\/p>\n<p>Appellant will be appointed to the vacancy in the post of Staff Nurse within a period of<\/p>\n<p>eight weeks from today.
