School Assistant in<\/p>\n<p>an aided school on 19.7.1979 and worked as such till 9.7.1984.<\/p>\n<p>Later   on   he   joined   Government   service   as   a   P.D.   Teacher.     He<\/p>\n<p>was   promoted   as   HSA   on   13.11.1998.     Taking   into   account   all<\/p>\n<p>services,   the   petitioner   would   complete   23   years   of   service   on<\/p>\n<p>16.7.2002.  The petitioner&#8217;s complaint in this writ petition is that<\/p>\n<p>although   on   completion   of   23   years   of   service   as   above   the<\/p>\n<p>petitioner is entitled to selection grade, he has not been granted<\/p>\n<p>the same on the ground that for the purpose of selection grade<\/p>\n<p>only   the   petitioner&#8217;s   service   as   High   School   Assistant   in   the<\/p>\n<p>Government   Schools   would   be   considered.   His   claim   in   this<\/p>\n<p>regard has been negatived on the basis of Ext.P5.   The petitioner<\/p>\n<p>therefore seeks the following reliefs.\n<\/p>\n<\/p>\n<p>           &#8221;      (a)     call   for   the   records   relating   to<\/p>\n<p>           Exhibit   P-5   and   quash   the   originals   of   the<\/p>\n<p>           same by the issue of a writ of certiorari or<\/p>\n<p>           other appropriate writ or order.\n<\/p>\n<p>                  (b)     issue   a   writ   of   mandamus   or<\/p>\n<p><span class=\"hidden_text\">W.P. ) No.4336\/04                          2<\/span><\/p>\n<p>            other appropriate writ order or direction<\/p>\n<p>            commanding   the   respondents   to   grant<\/p>\n<p>            Selection   Grade   to   the   petitioner   in   the<\/p>\n<p>            Primary  Cadre  counting   both  primary   and<\/p>\n<p>            HAS Service in the light of the judgment<\/p>\n<p>            in   O.P.   No.7348\/2003   and   connected<\/p>\n<p>            cases   as   well   as   in   view   of   Exhibit   P-7<\/p>\n<p>            judgment.&#8221;\n<\/p>\n<\/p>\n<p>      2.     The   learned   Government   pleader   submits   that<\/p>\n<p>although   in   view   of   Exts.P1   to   P6   orders   as   well   as   Ext.P7<\/p>\n<p>judgment the petitioner is entitled to have his primary school<\/p>\n<p>service   also   reckoned   for   the   purpose   of   grant   of   selection<\/p>\n<p>grade,   he   is   not   entitled   to   have   his   aided   school   service<\/p>\n<p>counted for the purpose.\n<\/p>\n<\/p>\n<p>      3.     The learned counsel for the petitioner would submit<\/p>\n<p>that   since   Ext.P7   judgment   refers   to   both   Government   and<\/p>\n<p>Private  School  Teachers, the  petitioner  is entitled to  have  his<\/p>\n<p>aided school service also counted for the purpose.<\/p>\n<p>      4.     I   have   considered   the   rival   contentions   in   detail.<\/p>\n<p>Two Division Benches of this Court has in separate judgments<\/p>\n<p>held   that   for   the   purpose   of   granting   increment,   on   coming<\/p>\n<p>over  to   government  service  prior   aided  school   service  cannot<\/p>\n<p>be   counted   and   that   for   the   purpose   of   weightage   in   pay<\/p>\n<p>fixation   also   prior   aided   school   service   cannot   be   counted   in<\/p>\n<p>respect   of   Government   school   teachers.     Although   in   Ext.P7<\/p>\n<p><span class=\"hidden_text\">W.P. ) No.4336\/04                         3<\/span><\/p>\n<p>judgment both Government and Private School teachers have<\/p>\n<p>been   referred   to   that   can   only   mean   that   the   Government<\/p>\n<p>School   teachers   and   private   school   teachers   are   separately<\/p>\n<p>entitled to  have their primary  school service also counted for<\/p>\n<p>the purpose of selection grade.   As such, I am not inclined to<\/p>\n<p>accept   the   contention   of   the   petitioner   that   he   is   entitled   to<\/p>\n<p>have   his   aided   school   service   counted   for   the   purpose   of<\/p>\n<p>selection   grade.             However,   in   view   of   G.O.(MS)<\/p>\n<p>No.552\/2004\/Fin. Dated 25.11.2004 primary school service of<\/p>\n<p>Government   school   teachers   are   liable   to   be   counted   for   the<\/p>\n<p>purpose   of   selection   grade   and   therefore   the   petitioner   is<\/p>\n<p>entitled to the said benefit.\n<\/p>\n<\/p>\n<p>       In the above circumstances, the writ petition is allowed to<\/p>\n<p>the   above   extent   of   directing   the   respondents   to   pass   fresh<\/p>\n<p>orders computing the petitioner&#8217;s service as P.D. Teacher also<\/p>\n<p>for the purpose of granting selection grade, but excluding the<\/p>\n<p>aided   school   service.       Orders   in   this   regard   shall   be   passed<\/p>\n<p>within   a   period   of   two   months   from   the   date   of   receipt   of   a<\/p>\n<p>copy of this judgment.   Needless to say, the petitioner would<\/p>\n<p>also be entitled to monetary benefits arising there from.<\/p>\n<p>                                                     S.
