Official
\n\tLiquidator has made the following prayers:\n<\/p>\n
\tThis
\n\tHon’ble Court may be pleased to permit the Official
\n\tLiquidator to appoint four stenographers, two company paid
\n\tclerk out of the waiting list candidates as submitted at para 7 of
\n\tthis OLR, with the help of the Registry of this Hon’ble Court.\n<\/p>\n
\tAs an
\n\talternative the Official
\n\tLiquidator may further be permitted to follow earlier adopted
\n\tprocedure for further recruitment of vacant post at present as
\n\tdirected vide orders dated 21.05.2005 passed by this Hon’ble Court.\n<\/p>\n
\tIf, the
\n\tprayer (A) and (B) is in affirmative, then this Hon’ble Court may be
\n\tpleased to permit the Official
\n\tLiquidator to pay the salary from the funds available with
\n\tthe Official Liquidator in
\n\tthe head of  Company Paid Staff Salary Reserve Fund Account  in
\n\tthe similar terms and conditions and pay scale, etc., as applicable
\n\tto other Company Paid Staff of similar category presently working in
\n\tthe office of the Official
\n\tLiquidator, Ahmedabad as already approved by this Hon’ble
\n\tCourt in various orders as submitted above.\n<\/p>\n
\tSuch
\n\tother and further orders and directions as this Hon’ble Court may
\n\tconsider just and appropriate may also be passed.\n<\/p>\n
Heard
\n\tlearned advocate and the Official
\n\tLiquidator. The Court was informed that in so far as prayer
\n\t(A) is concerned, the waiting list of stenographers is already
\n\texhausted and in relation to the clerks no orders are made. Hence,
\n\tit was submitted that prayer (B) may be considered and appropriate
\n\tdirections may be issued.\n<\/p>\n
In
\n\tprayer (B) the date of order is wrongly mentioned as 21.05.2005,
\n\twhereas the order annexed at Annexure-A is dated 21.10.2005.
\n\tOfficial Liquidator is
\n\tpermitted to follow the procedure contained in Paragraph Nos.6, 7
\n\tand 8 of order dated 21.10.2005 made in OLR No.83 of 2005 which are
\n\treproduced hereunder:\n<\/p>\n
 6.\tOn
\n\tthe aspect of procedure for appointment and inviting of applications
\n\tare concerned, after hearing OL and the learned Counsel appearing
\n\tfor the parties, I find that a committee can be constituted of the
\n\tfollowing persons:\n<\/p>\n
\t(1) One
\n\tOfficer not below the rank of law officer having judicial background
\n\twho may be nominated by the Registrar General of this Court.-The
\n\tOfficer having judicial background shall be the Chairman of the
\n\tCommittee and the OL shall be the Member Secretary and other Officer
\n\tof the rank of Dy. Registrar shall be the member of the Committee.\n<\/p>\n
\t(2)<\/span><\/p>\n
\tOfficial Liquidator<\/p>\n
\t(3) One
\n\tOfficer of the rank not below the rank of Dy. Registrar of this
\n\tCourt having administrative background, who may be nominated by the
\n\tRegistrar General of this Court.\n<\/p>\n
\t7.\tVarious
\n\tmodes are suggested by the OL at para 2-B for the purpose of
\n\tinviting applications from the interested qualified persons and such
\n\tmode appears can be followed by the Committee and, therefore, the
\n\tCommittee shall undertake the process for inviting applications and
\n\tthe scrutiny as stated hereinafter:\n<\/p>\n
\t(A)
\n\tApplications of the candidates shall be invited by placing a notice
\n\ton the notice boards of the followings:-\n<\/p>\n
\t1.
\n\tNotice Board of the High Court<\/p>\n
\t2.
\n\tNotice Board of BAR Association<\/p>\n
\t3.
\n\tNotice Board of BAR Council<\/p>\n
\t4.
\n\tNotice Board of Ahmedabad Chapter of the Institute of Chartered
\n\tAccountants of India<\/p>\n
\t5.
\n\tNotice Board of Ahmedabad Chapter of the Institute of Company
\n\tSecretaries of India<\/p>\n
\t6.
\n\tNotice Board of Ahmedabad Chapter of the
\n\tInstitute of Cost and Works Accountants of Indian<\/p>\n
\t7.
\n\tNotice Board of Gujarat University<\/p>\n
\t8.
\n\tNotice Board of Local Employment Exchange<\/p>\n
\t9.
\n\tNotice Board of Office of Official Liquidator<\/p>\n
\t10.
\n\tNotice Board of Office of Registrar of Companies, Gujarat Ahmedabad<\/p>\n
\t11.
\n\tNotice Board of National Institute of Information Technology (NIIT)<\/p>\n
\t12. Any
\n\tother place as may be directed by this Hon’ble Court.\n<\/p>\n
\t(B)
\n\tAfter receipt of applications by a cut-off-date, the meritorious
\n\tcandidates as may be found eligible as per their academic
\n\tqualification and experience shall be short listed (minimum 5
\n\tcandidates and maximum 10 candidates per post) by a sub-committee
\n\tconsisting Official Liquidator and Registrar of Companies.\n<\/p>\n
\t(C) The
\n\tshort listed candidates shall be interviewed and screened by the
\n\tselection committee and on the basis of marks awarded by members of
\n\tthe selection committee the best candidates shall be short listed by
\n\tthe selection committee and a panel of post wise second best
\n\tcandidates shall also be finalized by the selection committee so
\n\tthat in case the best and selected candidate does not finally accept
\n\tthe offer of appointment, the second best candidates from the
\n\twaiting panel can be offered the appointment without repeating the
\n\twhole process of recruitment.\n<\/p>\n
\t(D) The
\n\tlist of best selected candidates with the details of their
\n\tqualification, experience and performance of their interview with
\n\trecommendation of the selection committee shall be placed before
\n\tthis Court seeking permission and sanction to appoint them against
\n\tthe 18 posts of special company paid staff, initially for one year
\n\ton probation and continuation thereafter for further two years
\n\tdepending upon their performance without any right of continuation
\n\tin service on permanent basis or absorption in regular Govt.
\n\tService, and also liable to be terminated at any time.\n<\/p>\n
\t8.\tThe
\n\tOL shall be at liberty to make appointment of company paid staff as
\n\tper the final recommendations of the committee. If at any point of
\n\ttime there is any clarification required by the Committee then only
\n\treport shall be submitted to this Court.\n<\/p>\n
Accordingly
\n\tfor recruitment of stenographers and\u00a0company paid clerks,
\n\tOfficial Liquidator is
\n\tdirected to adopt the aforesaid procedure for recruitment to fill up
\n\tvacant posts.\n<\/p>\n
In
\n\tso far as the prayer (C) is concerned, it is not necessary to make
\n\tany orders at this juncture, leaving it open to the Liquidator to
\n\tapproach the Court as and when the requisite staff is appointed.\n<\/p>\n
The
\n\treport stands accordingly.\n<\/p>\n
