{"id":225498,"date":"2004-08-25T00:00:00","date_gmt":"2004-08-24T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/state-of-haryana-vs-daya-nand-on-25-august-2004"},"modified":"2016-03-06T05:37:08","modified_gmt":"2016-03-06T00:07:08","slug":"state-of-haryana-vs-daya-nand-on-25-august-2004","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/state-of-haryana-vs-daya-nand-on-25-august-2004","title":{"rendered":"State Of Haryana vs Daya Nand on 25 August, 2004"},"content":{"rendered":"<div class=\"docsource_main\">Supreme Court of India<\/div>\n<div class=\"doc_title\">State Of Haryana vs Daya Nand on 25 August, 2004<\/div>\n<div class=\"doc_author\">Author: S Hegde<\/div>\n<div class=\"doc_bench\">Bench: N.Santosh Hegde, S.B.Sinha, A.K.Mathur<\/div>\n<pre>           CASE NO.:\nAppeal (crl.)  940 of 2004\n\nPETITIONER:\nState of Haryana \t\t\t\t\t\t\n\nRESPONDENT:\nDaya Nand\t\t\t\t\t\t\t\n\nDATE OF JUDGMENT: 25\/08\/2004\n\nBENCH:\nN.Santosh Hegde,S.B.Sinha &amp; A.K.Mathur\n\nJUDGMENT:\n<\/pre>\n<p>J U D G M E N T<br \/>\n(Arising out of SLP(Crl.)No.5135 of 2003)<\/p>\n<p>SANTOSH HEGDE,J.\n<\/p>\n<p>\tHeard learned counsel for the parties.\n<\/p>\n<p>\tLeave granted.\n<\/p>\n<p>This appeal has been filed against the order of Punjab and<br \/>\nHaryana High Court at Chandigarh dated 22nd of January, 2003,<br \/>\nwhereby the High Court set aside the judgments of the two courts<br \/>\nbelow in a revision petition filed by the respondent herein.<br \/>\nBrief facts necessary for the disposal of this appeal are as<br \/>\nfollows:\n<\/p>\n<p>On 6th of July, 1988 when respondent was carrying 20 liters<br \/>\nof cow&#8217;s milk in a bicycle he was intercepted by the Deputy Chief<br \/>\nMedical Officer, Narnaul and a sample of 750 ml. of milk was<br \/>\ncollected from the container in which the respondent was carrying<br \/>\nthe milk and the same was sent to Public Analyst who in his report<br \/>\nfound the sample to be deficient in milk solid to the extent of 5%<br \/>\nof the prescribed minimum standard. He also found solid fat as<br \/>\nrequired under the law deficient.\n<\/p>\n<p>On receipt of the said report, a copy of the same was sent to<br \/>\nthe respondent by registered post but the same was returned by the<br \/>\npostal endorsement &#8220;refused to accept&#8221;. On the basis of the<br \/>\ninvestigation made on 25th of August, 1988 a complaint under<br \/>\nsection 16(i)(a)(i) of the Prevention of Food Adulteration Act was<br \/>\nfiled against the respondent.\n<\/p>\n<p>In the trial, the prosecution examined PW-1 Dr.S.P.Singh<br \/>\nand PW-2 Megh Nath, the Food Inspector, in support of its case.<br \/>\nThe respondent did not lead any evidence in defence except<br \/>\ncontending in his statement under Section 313 Cr.P.C. that he was<br \/>\ninnocent. The trial court as per its order dated 18th February, 1989<br \/>\nfound the appellant guilty of an offence punishable under Section<br \/>\n16(i)(a)(i) of the Prevention of Food Adulteration Act and after<br \/>\nhearing the respondent on the quantum of sentence taking into<br \/>\nconsideration he had no previous conviction and had three small<br \/>\nkids to support, awarded the minimum prescribed sentence under<br \/>\nthe Act that is to undergo RI for six months and to pay a fine of<br \/>\nRs.1000\/- in default of payment of fine the accused was directed to<br \/>\nfurther undergo simple imprisonment for three months.<br \/>\nBeing aggrieved by the conviction and sentence, the<br \/>\nrespondent preferred an appeal before the Sessions Judge, Narnaul<br \/>\nwho by his order dated 28th of March, 1990 concurred with the<br \/>\nfinding of the trial court and confirmed the conviction and<br \/>\nsentence.\n<\/p>\n<p>The respondent, as stated above, preferred a revision against<br \/>\nthe said orders before the Punjab and Haryana High Court at<br \/>\nChandigarh and the High Court by the impugned cryptic order<br \/>\ndated 22nd of January, 2003 held that in the sample milk, non solid<br \/>\nfat was found to be 8.1 % instead of 8.5% while solid fat was<br \/>\nfound to be 4.5% as against the requirement of 4%. It also<br \/>\nobserved that in the circumstances of the case, possibility of<br \/>\nimproper stirring could not be ruled out. On that assumption it<br \/>\ngave the benefit of doubt to the respondent and allowed the appeal<br \/>\nof the appellant setting aside the conviction and sentence imposed<br \/>\nby the two courts below.\n<\/p>\n<p>Mr.Manu Sharma learned counsel appearing for the<br \/>\nappellant-State contended that first of all the High Court in a<br \/>\nrevision petition could not have gone into the questions of fact<br \/>\ndecided concurrently by the two courts below. He also contended<br \/>\nthe assumption of the learned Judge that there is improper stirring<br \/>\nwhile taking the sample was contrary to the facts on record and<br \/>\nfindings recorded by the two courts below. He submitted that on<br \/>\nthe basis of the material on record such an assumption could not<br \/>\nhave been drawn by the High Court. Hence, he contended that the<br \/>\nimpugned order of the High Court is unsustainable in law.<br \/>\nMrs.Laxmi Arvind, learned counsel appearing for the<br \/>\nrespondent, however, contended that the High Court was fully<br \/>\njustified in coming to the conclusion that there could have been a<br \/>\npossibility of improper stirring which, if true, would not give the<br \/>\nproper result while analysing the sample product, hence, the order<br \/>\nof the High Court is legally justifiable. She also placed strong<br \/>\nreliance on the judgement of this Court in the case of <a href=\"\/doc\/1544783\/\">Food<br \/>\nInspector, Municipal Corporation, Baroda vs. Madanlal Ramlal<br \/>\nSharma &amp; Anr. (AIR<\/a> 1983 SC 176).\n<\/p>\n<p>We will first deal with the assumption of the High Court that<br \/>\nthere is a possibility of improper stirring while taking the sample.<br \/>\nIn the trial court, the learned counsel for the respondent had<br \/>\nraised this contention and the same was negatived by the trial court<br \/>\non the following basis :\n<\/p>\n<p>&#8220;Otherwise also the witnesses have<br \/>\ncategorically stated that the milk was properly stirred<br \/>\nwith measurement before taking the milk sample.<br \/>\nThus I hereby over rule this contention of learned<br \/>\ndefence counsel&#8221;.\n<\/p>\n<p>This finding was given by the learned Judge while<br \/>\nconsidering various judgments cited in support of the contention<br \/>\nraised on behalf of the accused as well as the evidence found in<br \/>\nthis case as to the proper stirring of milk.\n<\/p>\n<p>Learned Sessions Judge while considering the similar<br \/>\narguments raised before him after considering the judgments cited<br \/>\nbefore him held thus at para 11 of the judgement:<br \/>\n&#8220;Regarding last contention, learned counsel<br \/>\nseems to have been impressed by the word &#8216;churning&#8217;<br \/>\nmentioning in the complaint. A look at the complaint<br \/>\nwould show that both the words &#8216;stirring&#8217; as well as<br \/>\n&#8216;churning&#8217; are mentioned. It appears that word<br \/>\n&#8216;churning&#8217; was not deleted in the complaint because<br \/>\nthat method is necessary in case of &#8216;curd&#8217;. In any case it<br \/>\nwas stated by the witnesses that the sample was made<br \/>\nrepresentative and homogeneous by stirring and thus,<br \/>\nno fault can be found on this account as well.&#8221;\n<\/p>\n<p>Thus it is noticed that both the courts below have considered<br \/>\nthis question and on the material available on record have come to<br \/>\nthe conclusion that the sample milk in question was properly<br \/>\nstirred as required by law and the sample was made representative<br \/>\nand homogeneous. This finding is based on the evidence found on<br \/>\nthe record. In this background, in our opinion, the High Court<br \/>\nrather casually has come to an erroneous assumption that there was<br \/>\nimproper stirring for which there is no foundation at all, as could<br \/>\nbe seen from the finding noticed by us herein above of the two<br \/>\ncourts below. We do not think the High Court could have<br \/>\nsubstituted a factual foundation available on record, by an<br \/>\nassumption, to give benefit of doubt to the respondent. As stated<br \/>\nabove, the learned counsel appearing for the respondent relied on a<br \/>\njudgment of this court in the case of Food Inspector, Municipal<br \/>\nCorporation, Baroda (supra), we do not think the above judgment<br \/>\nwill be of much assistance to the respondent because that was a<br \/>\ncase in which primary question was what should be the method by<br \/>\nwhich &#8220;churning&#8221; of &#8220;curd&#8221; should be done. In that context, this<br \/>\nCourt held that the law does not provide for any specific method<br \/>\nand the finding in this regard would depend upon the evidence on<br \/>\nrecord. That apart in that case the court was considering the effect<br \/>\nof &#8220;churning&#8221; of &#8220;curd&#8221;, while in the present case, we are<br \/>\nconcerned with &#8220;stirring&#8221; of &#8220;milk&#8221; which on facts has been found<br \/>\nto be properly done.\n<\/p>\n<p>For the reasons stated above, we allow this appeal setting<br \/>\naside the order of the High Court reducing the sentence and restore<br \/>\nthe conviction and sentence imposed on the respondent by the trial<br \/>\ncourt as confirmed by the Sessions court and direct the respondent<br \/>\nto serve out the sentence awarded by the trial court.
