Collector,<br \/>\nStamp Duty Valuation Organization, Rajkot Rural,  Rajkot dated<br \/>\n29.12.2001 and  the order dated 26.11.2007 passed by the Chief<br \/>\nControlling Revenue Authority, Stamp Duty Valuation Office,<br \/>\nGandhinagar.\n<\/p>\n<p>\t\tHeard<br \/>\nthe learned advocate for the petitioner and Mr U A Oza, learned AGP<br \/>\nfor the respondents.\n<\/p>\n<p>2.\t\tIt<br \/>\nis submitted by the learned advocate for the petitioner that without<br \/>\ngiving any details regarding determination of market value, in<br \/>\nprinted form, order was passed by the Dy. Collector, Stamp Duty<br \/>\nValuation,                                                           <\/p>\n<p>                             Rajkot Rural, Rajkot in a casual manner.<br \/>\nIt is submitted by him that  after taking into consideration certain<br \/>\nprinciples regarding  determining the  market value of the land, he<br \/>\nhas  passed the impugned order on the basis of which the respondent<br \/>\nNo.1 has valued the property in question at a higher rate and<br \/>\ntherefore, deficit Stamp Duty of Rs.51,260\/- and fine of Rs.250\/- was<br \/>\nrequired to be paid to the authorities.    It is submitted by him<br \/>\nthat the respondent authority has not considered the fact that the<br \/>\npetitioner has purchased the plots in question by paying<br \/>\nRs.3,80,000\/- at  the  market value and the respondent authority has<br \/>\nalso not considered the market value as per Jantri decided by the<br \/>\nState.  Therefore, it is prayed that  the decision of the respondent<br \/>\nauthorities is required to be quashed and set aside.\n<\/p>\n<p>3.\tIn<br \/>\nsupport of his submission, the Learned<br \/>\n                     advocate has  placed  reliance on the following<br \/>\ndecisions of this court:\n<\/p>\n<p>(1)\t\t2003<br \/>\n(1) GLR  454 vol.44 <a href=\"\/doc\/646212\/\">(Pradhyaumanbhai \t\t\tMohanlal Patel \t\tv. State of<br \/>\nGujarat<\/a><\/p>\n<p>(2)\t\t2006<br \/>\n(3)  GLR 2252 <a href=\"\/doc\/132885409\/\">(Mayurkumar J Patel  v. \t\t\tDy.Collector, Stamp Duty<br \/>\nValuation Department, \t\tRajkot)<\/p>\n<p>In<br \/>\nthe<\/a> above decisions, it is held by this court that without giving any<br \/>\nreasons and without applying mind towards any of the defences raised<br \/>\nby the petitioner therein, in printed format the impugned order has<br \/>\nbeen passed wherein some gaps have been filled in and one and two<br \/>\nsentences have been added.  It is also held by this court that it is<br \/>\nthe duty vested in the respondent authorities to justify its say for<br \/>\nhigher market value for the land in question, and thus, the order in<br \/>\nquestion was quashed and set aside by the court in the aforesaid<br \/>\ndecision.\n<\/p>\n<p>4.\t\tThe<br \/>\nrespondent Deputy Collector has passed final order on 29.12.2001.<br \/>\nThe Appeal of the petitioner was rejected by respondent<br \/>\nNo.1-Appellate authority on 26.11.2007 on the ground of delay.\n<\/p>\n<p>5.\t\tConsidering<br \/>\nthe facts and circumstances of the case, it is apparent that   the<br \/>\nimpugned  order is in printed form and only some gaps have been<br \/>\nfilled up by the authorities without giving any reasons.  This<br \/>\nclearly shows total non-application of mind on the part of the<br \/>\nrespondent- Authorities.  Under these circumstances,  the impugned<br \/>\norders are required to be quashed and set aside.\n<\/p>\n<p>6.\t\tIn<br \/>\nthe result, the petition is allowed.  The impugned orders dated<br \/>\n29.12.2001 and 26.11.2007 are quashed and set aside.  Consequently,<br \/>\nthe matter is remanded to respondent No.2 for taking  fresh decision<br \/>\nand for passing a speaking order as per the Act, after giving an<br \/>\nopportunity of being heard to the petitioner.  Respondent No.2 is<br \/>\ndirected to dispose of the matter accordingly,  within  a period of<br \/>\nthree months from the date of receipt of the writ of this order.\n<\/p>\n<p>\t\tRule<br \/>\nis made absolute to the aforesaid extent.
