         Petitioner is the decree holder in<\/p>\n
E.P.No.69\/2004 in O.S.No.45\/2003 on the file<\/p>\n
of the Munsiff’s Court, Thodupuzha.                         The above<\/p>\n
execution petition filed by the petitioner to<\/p>\n
realise the decree debt from the respondent<\/p>\n
judgment debtor was dismissed accepting the<\/p>\n
plea of ‘no means’ canvassed by the judgment<\/p>\n
debtor. Propriety and correctness of the order<\/p>\n
passed by the learned Munsiff is challenged in<\/p>\n
the revision.\n<\/p>\n
         2.     I     heard        the       counsel        for  the\n\npetitioner.\n\n<\/pre>\n
         3.     Perusing the order passed by the<\/p>\n
court below, it is seen that the evidence let<\/p>\n
in by the judgment debtor, who was examined as<\/p>\n
DW1.1 in the enquiry over his plea of ‘no<\/p>\n
means’ was found acceptable to the learned<\/p>\n
C.R.P.No.557 of 2006<\/p>\n
                     :: 2 ::\n<\/p>\n
\nMunsiff to conclude that he had ‘no means’ to<\/p>\n
pay the decree debt.    The learned counsel for<\/p>\n
the petitioner\/decree holder has read over to<\/p>\n
me the evidence of the judgment debtor. To<\/p>\n
disprove the case canvassed by the decree<\/p>\n
holder that he had possessed two motor bikes,<\/p>\n
one after the other, just a few months before<\/p>\n
the institution of the suit for recovery of<\/p>\n
money against him the judgment debtor produced<\/p>\n
records to show that one of his bikes had been<\/p>\n
stolen and the other one already disposed of<\/p>\n
by sale, both such events occurring before the<\/p>\n
institution of the suit.    In cross-examination<\/p>\n
of the judgment debtor it had come out that he<\/p>\n
is in occupation of a building comprised in 4<\/p>\n
cents of property which originally belonged to<\/p>\n
his mother, who had passed away.     In his re-<\/p>\n
examination, the Will purported to have been<\/p>\n
executed  by   his  mother  in  favour  of  his<\/p>\n
father-in-law was produced and got marked as<\/p>\n
Ext.B3.  Other   than  making  a  reference  to<\/p>\n
C.R.P.No.557 of 2006<\/p>\n
                      :: 3 ::\n<\/p>\n
\nExt.B3, as one among the documents marked by<\/p>\n
the judgment debtor, there is no reference in<\/p>\n
the order of the learned Munsiff as to its<\/p>\n
validity or genuineness. Prima facie, it would<\/p>\n
appear that on the death of the mother, the<\/p>\n
judgment debtor, one of her sons had inherited<\/p>\n
some  right   over   the     property. The  case<\/p>\n
advanced  by   the  judgment    debtor that  his<\/p>\n
mother had executed a Will in favour of his<\/p>\n
father-in-law on the      face of it could    be<\/p>\n
taken only with a pinch of salt.      Ext.B3 has<\/p>\n
not  been  proved   as   mandated   by law.  His<\/p>\n
evidence as DW.1 also indicate that he is<\/p>\n
paying the charges of the telephone installed<\/p>\n
in his house, which, according to him, comes<\/p>\n
to Rs.500\/-.    One of his children is studying<\/p>\n
in a Nursing College. The judgment debtor had<\/p>\n
canvassed a case that his father-in-law is<\/p>\n
taking care of the educational expenses of<\/p>\n
that child, which is hardly susceptible.    Plea<\/p>\n
of ‘no means’ canvassed by the judgment debtor<\/p>\n

\nin the back drop of the materials placed by<\/p>\n
him before the court was rather unconvincing.<\/p>\n
So far as the decree holder is concerned, he<\/p>\n
need lead evidence only to show that there is<\/p>\n
no merit in the plea set up by the judgment<\/p>\n
debtor  as  to   the lack   of  ‘no  means’ to<\/p>\n
discharge the decree debt. Concrete evidence<\/p>\n
from the decree holder to negative that plea<\/p>\n
for  disproving   the  claim  of  the  judgment<\/p>\n
debtor is hardly possible.     Once the decree<\/p>\n
holder leads evidence, prima facie, showing<\/p>\n
that the plea of ‘no means’ canvassed by the<\/p>\n
judgment debtor is unacceptable by mounting<\/p>\n
the box and swearing to his case disputing the<\/p>\n
case of the judgment debtor, then the burden<\/p>\n
shifts on the judgment debtor to discharge the<\/p>\n
decree debt.\n<\/p>\n
         4.   The judgment debtor, immediately<\/p>\n
prior to the filing of the suit, possessed a<\/p>\n
bike; that a telephone installed in his name<\/p>\n
in his house and a portion of the premises is<\/p>\n
C.R.P.No.557 of 2006<\/p>\n
                      :: 5 ::\n<\/p>\n
\nalso used for business purposes would indicate<\/p>\n
that   his    plea    of    ‘no means’  lacked<\/p>\n
credibility. The impugned order passed by the<\/p>\n
learned Munsiff cannot be sustained in the<\/p>\n
facts and circumstances presented in the case.<\/p>\n
Setting aside the order, the court below is<\/p>\n
directed to consider the matter afresh and<\/p>\n
pass appropriate orders on the plea of ‘no<\/p>\n
means’ canvassed by the judgment debtor taking<\/p>\n
note of the observations made above and in<\/p>\n
accordance with law.\n<\/p>\n
         5.     Parties are directed to appear<\/p>\n
before the court below on 29.03.2010.<\/p>\n
         Civil Revision Petition is disposed<\/p>\n
of as above.\n<\/p>\n
