Justice K.T.SANKARAN\n\n Dated :20\/10\/2010\n\n O R D E R\n                 K.T.SANKARAN, J.\n          ------------------------------\n             W.P.(C).No.25435 OF 2008\n          ------------------------------\n      Dated this the 20th day of October, 2010\n\n\n\n\n                     JUDGMENT\n<\/pre>\n<p>    The petitioners, who are working as Full-time<\/p>\n<p>Arabic Teacher and Sanskrit Teacher respectively in<\/p>\n<p>two different schools challenge Exts.P3, P3(a) and<\/p>\n<p>P3(b) audit objection.     The audit objection was<\/p>\n<p>issued based on Ext.P7 Circular dated 17.5.2002<\/p>\n<p>issued by the General Education Department.       In<\/p>\n<p>Ext.P12 judgment dated 7th August, 2008 in WP(C)<\/p>\n<p>No.20914 of 2003, this court held that Ext.P7<\/p>\n<p>Circular cannot have the effect of amending a<\/p>\n<p>notification  and  that    too  with   retrospective<\/p>\n<p>effect.  The decision in OP No.23261 of 1998 was<\/p>\n<p>also relied on in Ext.P12 judgment.     It was held<\/p>\n<p>that the pay fixed before Ext.P7 Circular issued in<\/p>\n<p>2002 could not be revised based on the Circular<\/p>\n<p>issued later in point of time. The audit objection<\/p>\n<p>was held to be unfounded.     It is submitted that<\/p>\n<p>Ext.P12 judgment squarely applies to the facts in<\/p>\n<p><span class=\"hidden_text\">W.P.(C).No.25435 OF 2008     2<\/span><\/p>\n<p>the present case and therefore, the audit objection<\/p>\n<p>impugned in this Writ Petition is unsustainable.<\/p>\n<p>The   learned   counsel    for   the   petitioners    also<\/p>\n<p>pointed out that after Ext.P12 judgment was passed,<\/p>\n<p>Ext.P18 Circular No.26790\/J2\/07\/G.Edn. dated 23rd<\/p>\n<p>June,   2009    was   issued.       For    the   sake   of<\/p>\n<p>convenience, the Circular is extracted below:<\/p>\n<p>    &#8221;                      CIRCULAR<\/p>\n<p>    Sub:- General Education &#8211; Teaching Staff &#8211; Junior<br \/>\n          Senior  Anomaly  in   Pay  Fixation-Modified<br \/>\n          instruction- Issued<\/p>\n<p>    Ref:- Circular   No. 59151\/ J2\/ 2000\/ G.Edn. Dated<br \/>\n          17.5.2002<\/p>\n<p>               As per the reference cited Government<br \/>\n          have   clarified  that   integrated\/combined<br \/>\n          seniority list of teachers maintained for<br \/>\n          promotion to the post of Head Master\/Head<br \/>\n          Mistress  cannot  be  a  parameter  for the<br \/>\n          purpose of fixation of pay and pay of a<br \/>\n          senior belonging to any of the category<br \/>\n          cannot be stepped up to the level of pay of<br \/>\n          the junior in another category since Junior<br \/>\n          Language    Teacher,   Primary    Department<br \/>\n          Teacher, High School Assistant (Language)<br \/>\n          and  High  School  Assistant(core  subjects)<br \/>\n          belong to four different categories.<\/p>\n<p>               Now  it  has  come  to  the  notice  of<br \/>\n          Government that the Hon&#8217;ble High Court in<br \/>\n          many  judgments  (eg.   judgments  in  WP(C)<br \/>\n          Nos.20914\/03, 10482\/04, 35325\/05 &amp; 21604\/06)<br \/>\n          observed that the directions contained in<br \/>\n          the Circular read above is contrary to the<br \/>\n          Pay Revision Order 1998 and the Hon&#8217;ble High<br \/>\n          Court quashed Para 2 of the Circular. Also<\/p>\n<p><span class=\"hidden_text\">W.P.(C).No.25435 OF 2008     3<\/span><\/p>\n<p>          as per Rule 34 of Chapter XIV A KER, every<br \/>\n          management  shall  prepare  and  maintain  a<br \/>\n          staff list otherwise called the seniority<br \/>\n          list of teachers specified thereunder for<br \/>\n          promotion  to  the   post  Head  Master\/Head<br \/>\n          Mistress.\n<\/p>\n<p>               In the circumstances, it is clarified<br \/>\n          that the above seniority list will be the<br \/>\n          criteria   for  rectifying   junior   senior<br \/>\n          anomaly in pay fixation, with effect from<br \/>\n          the Pay Revision Order 1998.\n<\/p>\n<p>               The Circular read above stands modified<br \/>\n          to this extent.&#8221;\n<\/p>\n<\/p>\n<p>    2. It is submitted by the learned counsel for<\/p>\n<p>the  petitioners     that   in  the   light   of   Ext.P12<\/p>\n<p>judgment and Ext.P18 Circular, the audit objection<\/p>\n<p>is liable to be quashed. The contention of the<\/p>\n<p>petitioners is well founded. Accordingly, the Writ<\/p>\n<p>Petition is allowed and Exts.P3, P3(a) and P3(b)<\/p>\n<p>are quashed.
