The petitioner has also prayed for the<br \/>\n\tdirection to the respondent No.1 to make an inquiry into the<br \/>\n\tincident complained of by the petitioner by way of representation<br \/>\n\tdated 09.02.2008 as regards the misuse of the vehicle under<br \/>\n\tdetention.\n<\/p>\n<p>\tThis<br \/>\n\tCourt has issued notice on 19.02.2008.  Subsequent to the issuance<br \/>\n\tof notice, the vehicle was released on payment of Rs.23,625\/-.\n<\/p>\n<p>\tMr.\n<\/p>\n<p>\tR. M. Chhaya, learned advocate appearing for the petitioner submits<br \/>\n\tthat since appeal is provided against the impugned action \/<br \/>\n\tdecision, he will undertake to file the said appeal within 15 days<br \/>\n\tfrom today.  In that view of the matter, prayer A no longer<br \/>\n\tsurvives.  He has, however, submitted that the petitioner is<br \/>\n\tconcerned so far as prayer B is concerned.  He submitted that on<br \/>\n\t08.02.2008, when the petitioner&#8217;s temporary driver employed on daily<br \/>\n\twages for 3 days along with some consultants for production going to<br \/>\n\tthe factory at Mamsa, RTO officials stopped the car and pressurized<br \/>\n\tthe driver to give false statement to the effect that they are using<br \/>\n\tthe Car for the last one year.  On refusal by the driver to give<br \/>\n\tsuch a false statement, the Officer, particularly, Mr. Ninama and<br \/>\n\this staff behaved in bad manner and also abused the driver. He has<br \/>\n\tfurther submitted that the said Officer and his staff thereafter<br \/>\n\tillegally detained the Car and they prepared false papers and<br \/>\n\tdocuments.  When request was made to issue receipt for detention of<br \/>\n\tCar, the same was issued to the driver after much reluctance.\n<\/p>\n<p>\tMr.\n<\/p>\n<p>\tChhaya has further submitted that on 09.02.2008, in the morning at<br \/>\n\tabout 09.00 to 09.30 a.m., when the Manager of the petitioner was<br \/>\n\tgoing towards factory premises at Mamsa in hired Car, he saw the<br \/>\n\tsaid Car on the Highway.  He immediately stopped the Car and asked<br \/>\n\tthe person who was driving the Car.  He gave his name as Mr. Boricha<br \/>\n\tand he was the staff member of the RTO Office, Bhavnagar.  On his<br \/>\n\tinquiry, the said Mr. Boricha abused the Manager of the petitioner<br \/>\n\tand told him that he could do whatever he liked.  The petitioner is<br \/>\n\tvery much offended by these two incidents and hence, detailed<br \/>\n\trepresentation was made on 09.02.2008 to the Director \/ Commissioner<br \/>\n\tof Transport which is annexed at Annexure D.\n<\/p>\n<p>\tSince<br \/>\n\tFebruary 2008, representation is made and still, no action is taken<br \/>\n\tin this regard possibly on assumption that the petition is pending<br \/>\n\tbefore this Court.  Since the petitioner is allowed to prefer an<br \/>\n\tappeal against the grievance of the petitioner for retaining the Car<br \/>\n\tand also releasing the same on payment of Rs.23,625\/-, we dispose of<br \/>\n\tthis petition.  We, however, direct the respondent No.1 to look into<br \/>\n\tthe matter and see that the representation dated 09.02.2008 is<br \/>\n\tdecided within one month from the date of receipt of writ or<br \/>\n\tcertified copy of this order, whichever is earlier.  The Court is of<br \/>\n\tthe view that if the facts stated and averments made in the<br \/>\n\trepresentation are correct, it is a very serious matter and the<br \/>\n\tpersons involved are required to be strictly dealt with.  We could<br \/>\n\thave gone into this matter.  However, since the representation is<br \/>\n\tmade and the authorities are supposed to go into the said<br \/>\n\trepresentation, we restrain ourselves from making any further<br \/>\n\tobservation in this regard, leaving it open to the authority to look<br \/>\n\tinto the matter.\n<\/p>\n<p>We<br \/>\n\treserve liberty to the petitioner to revive this petition in case of<br \/>\n\tdifficulty.
