SHAH\n\t\t\n\t\n\n \n\nDate\n: 24\/08\/2011 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\t\tRule.\n<\/p>\n<p>Mr.K.P.Rawal, learned Additional Public Prosecutor waives service of<br \/>\nnotice of Rule on behalf of respondent No.1.  Mr.Kamal Sojitra,<br \/>\nlearned advocate waives service of notice of Rule on behalf of<br \/>\nrespondent No.2.\n<\/p>\n<p>2.\t\tIn<br \/>\nthe facts and circumstances of the case and with the consent of the<br \/>\nlearned advocates appearing on behalf of the respective parties and<br \/>\nas it is reported that the parties have amicably settled the dispute,<br \/>\nthe present application is taken up for final hearing today.\n<\/p>\n<p>3.\t\tThe<br \/>\npresent application under Section 482 of the Code of Criminal<br \/>\nProcedure has been preferred by the applicants &#8211; original<br \/>\naccused of FIR being C.R.No.I-92\/2011 registered with Sanand Police<br \/>\nStation, Ahmedabad (Rural) lodged against the applicants &#8211;<br \/>\noriginal accused  for the offences punishable under Sections 147,<br \/>\n148, 149, 395, 504, 506(2) and 342 of the Indian Penal Code.\n<\/p>\n<p>4.\t\tMr.Sojitra,<br \/>\nlearned advocate appearing on behalf of respondent No.2 &#8211;<br \/>\noriginal complainant has submitted that an affidavit is also filed,<br \/>\nwhich is affirmed by respondent No.2 &#8211; original complainant<br \/>\nconfirming that settlement has been arrived at between the parties<br \/>\nand by submitting that he has no objection, if the impugned<br \/>\ncomplaint\/FIR is quashed and set aside.\n<\/p>\n<p>5.\t\tLearned<br \/>\nadvocates appearing on behalf of the respective parties have relied<br \/>\nupon the decision of the Hon&#8217;ble Supreme Court in the case of Madan<br \/>\nMohan Abbot V\/s. State of Punjab reported in 2008(4) SCC 582;<br \/>\nin the case of  Nikhil Merchant V\/s. Central Bureau of<br \/>\nInvestigation and another reported in 2009(1) GLH 31 as<br \/>\nwell as in the case of Manoj Sharma V\/s. State and others reported<br \/>\nin 2009(1) GLH 190.\n<\/p>\n<p>6.\t\tHaving<br \/>\nheard the learned advocates appearing on behalf of the respective<br \/>\nparties and considering the fact that settlement has been arrived at<br \/>\nbetween the parties and considering the aforesaid decisions of the<br \/>\nHon&#8217;ble Supreme Court, it appears to the Court that the impugned FIR<br \/>\nbe quashed and set aside in exercise of power under Section 482 of<br \/>\nthe Code of Criminal Procedure and to continue criminal proceedings<br \/>\nagainst the applicants &#8211; original accused is unnecessary<br \/>\nharassment to the applicants and the same shall not be in the<br \/>\ninterest of the parties.\n<\/p>\n<p>7.\t\tIn<br \/>\nview of the above and for the reasons stated hereinabove, the<br \/>\nimpugned FIR being C.R.No.I-92\/2011 registered with Sanand Police<br \/>\nStation, Ahmedabad (Rural) lodged against the applicants &#8211;<br \/>\noriginal accused  for the offences punishable under Sections 147,<br \/>\n148, 149, 395, 504, 506(2) and 342 of the Indian Penal Code is hereby<br \/>\nquashed and set aside so far as the applicants are concerned.
