Writ Petition No.34992 of 2010.\n<\/p>\n<p>Supplementary affidavit filed by the petitioner is taken on record.\n<\/p>\n<p>Heard the learned counsel for the petitioner and Sri V.K. Singh,<br \/>\nlearned Addl. Advocate General assisted by Sri V.K. Chandel,<br \/>\nlearned Standing Counsel representing respondent nos.1 to 3.\n<\/p>\n<p>Let counter affidavit be filed by the respondent nos.1 to 3 within<br \/>\nthree weeks. Rejoinder affidavit may be filed by the petitioner<br \/>\nwithin two weeks thereafter.\n<\/p>\n<p>Issue notice to the respondent no.4 as the allegations of malafide<br \/>\nhave been alleged against him. Notice be issued through registered<br \/>\npost. Steps may be taken within a week. Office shall issue notice<br \/>\nfixing 30.7.2010.\n<\/p>\n<p>The learned counsel for the petitioner has urged that no charge is<br \/>\nfound to be proved against the petitioner but at the behest of the<br \/>\nMinister (Respondent No.4) the Principal Secretary was compelled<br \/>\nto pass the impugned order.\n<\/p>\n<p>The petitioner was working as Chief Engineer, Minor Irrigation<br \/>\nand was due to retire on 31.8.2007. Two days prior to his<br \/>\nretirement, he was placed under suspension on alleged charges of<br \/>\nserious irregularities in purchase of M.S. Pipes for the year 2003<br \/>\nvide office order dated 29.8.2007. By same order Sri Harmindar<br \/>\nRaj Singh, Principal Secretary (Agriculture) was appointed as the<br \/>\nInquiry Officer. The Inquiry Officer submitted his report on<br \/>\n29.2.2008. All the charges mentioned in the charge sheet were<br \/>\nfound to be not proved in the inquiry report. The State<br \/>\nGovernment did not accept the said inquiry report and further by<br \/>\noffice order dated 7.7.2008 appointed Sri Saurabh Chandra,<br \/>\nPrincipal Secretary, Rural Engineering Services as the Inquiry<br \/>\n Officer. The said Inquiry Officer submitted his report dated<br \/>\n24.10.2008 in which it was found that Charge Nos.4, 5 and 6 were<br \/>\nnot proved, Charge Nos.1, 2, 3 and 8 were partly proved and<br \/>\nCharge No.7 was proved. Based upon the said inquiry report, the<br \/>\nimpugned order dated 16.4.2010 has been passed whereby 70%<br \/>\npension of the petitioner has been deducted.\n<\/p>\n<p>Both the inquiry reports have been annexed along with the<br \/>\nsupplementary affidavit. As already mentioned above in the earlier<br \/>\nreport dated 29.2.2008, none of the charges were found proved. In<br \/>\nthe second inquiry report dated 24.10.2008 submitted by Sri<br \/>\nSaurabh Chandra, Charge Nos.4, 5 and 6 have been found to be<br \/>\nnot proved, Charge Nos.1, 2, 3 and 8 have been found to be partly<br \/>\nproved and Charge No.7 was found to be proved.\n<\/p>\n<p>With regard to Charge No.1, the finding is that there was only<br \/>\nprocedural lapse on the part of the petitioner and the charge as<br \/>\nalleged that the petitioner had not taken the approval of the<br \/>\nMinister was actually found to be not proved.\n<\/p>\n<p>With regard to Charge No.2 the finding is that no fault could be<br \/>\nattributed to the single member of the purchase committee as the<br \/>\ndecision to purchase the pipes was of the committee. However, the<br \/>\nonly responsibility fixed on the petitioner was that he ought to<br \/>\nhave clearly mentioned in the agenda item of the purchase<br \/>\ncommittee that quantity of pipes being purchased was for the<br \/>\nentire year.\n<\/p>\n<p>The finding on Charge No.3 is that no financial loss was caused to<br \/>\nthe State Government and as such the charge to that extent was not<br \/>\nproved. However, it was only found that the petitioner had<br \/>\npurchased the pipes required for period of more than 6 months.\n<\/p>\n<p>The Charge No.7 was to the effect that the petitioner issued<br \/>\npurchase order 15.7.2003. Thereafter the said order was cancelled<br \/>\nby order dated 18.7.2003 and again fresh order of purchase was<br \/>\nissued on 22.7.2003. As such the petitioner had proceeded in an<br \/>\narbitrary manner in cancelling and restoring the order of<br \/>\npurchase.The petitioner in his reply had submitted that the order<br \/>\ndated 18.7.2003 for cancelling the purchase order dated 15.7.2003<br \/>\nwas issued upon the oral instructions of the Minister as the<br \/>\nMinister was interested in giving the purchase order to some other<br \/>\nparty. However, when it was informed that the firm, to which the<br \/>\norder dated 15.7.2003 had been placed had already issued the bank<br \/>\ndraft to the D.G.S.&amp;D. for inspection on 17.7.2003 and the pipes<br \/>\nhad already been made available for inspection and this could<br \/>\n result into complications, he restored the order dated 15.7.2003 by<br \/>\npassing fresh order on 22.7.2003. This charge has been found<br \/>\nproved only for the reason that the petitioner could not provide any<br \/>\nmaterial \/ evidence to show that the cancellation had taken place<br \/>\nupon the instructions of the Minister. Apparently there could be no<br \/>\nevidence of oral instructions given by the Minister.\n<\/p>\n<p>With regard to Charge No.8 the finding is the same as in Charge<br \/>\nNo.3 i.e. for purchase of material for more than period of six<br \/>\nmonths.\n<\/p>\n<p>There is no finding under any of the charges that there had been<br \/>\nany financial irregularities on the part of the petitioner. There is no<br \/>\ncharge of any misappropriation of the Government money. There<br \/>\nis no charge or finding with regard to any undue favour having<br \/>\nbeen extended to any party for personal gains by the petitioner.<br \/>\nThe only charge found proved is that there were certain minor<br \/>\nprocedural irregularities.\n<\/p>\n<p>It has been submitted by the learned counsel for the petitioner that<br \/>\nbased on the said inquiry report, a false FIR was also got registered<br \/>\nunder influence of the Minister against the petitioner by the<br \/>\npresent Chief Engineer under Sections 420\/467\/468\/471 IPC on<br \/>\nthe allegations that the petitioner had interpolated the records<br \/>\ncausing heavy financial loss to the Government. The Division<br \/>\nBench of the Lucknow Bench of this Court had already passed an<br \/>\norder that the petitioner shall not be arrested.\n<\/p>\n<p>We are thus convinced that prima facie the order of punishment is<br \/>\nperse bad in law and suffers from the vice of malice. We have<br \/>\nalready passed another detailed order in Writ Petition No.44992 of<br \/>\n2010, filed by the petitioner, wherein the order of punishment of<br \/>\n30% reduction of pension was passed on an inquiry report in<br \/>\nwhich none of the charges had been found proved, on a clear<br \/>\nmisreading of the report.\n<\/p>\n<p>Until further orders of this Court the effect and operation of the<br \/>\nimpugned order dated 16.4.2010, passed by the State<br \/>\nGovernment \/ Principal Secretary, Minor Irrigation Department,<br \/>\nU.P., Lucknow filed as Annexure-1 to the writ petition shall<br \/>\nremain stayed.\n<\/p>\n<p>List for further hearing on 30.7.2010. On the said date the Minister<br \/>\nand the Principal Secretary shall appear before this Court and file<br \/>\ntheir personal affidavits.
