No.5584 of 2010\n                    INDAR MUSHHAR SON OF NAGESHWAR MANJHI, R\/O\n    MOHALLA- BAHADURPUR HOUSING COLONY, P.S.- AGAMKUAN, DISTRICT-\n                                PATNA\n                                            Versus\n                                  THE STATE OF BIHAR\n                                          -----------\n<\/pre>\n<p>5       21\/07\/2010             Heard Mr. Harendra Kumar learned counsel<\/p>\n<p>                     for the petitioner and learned APP for the State.<\/p>\n<p>                               As   prayed   for,   learned   counsel    for   the<\/p>\n<p>                     petitioner is permitted to make necessary correction in<\/p>\n<p>                     the prayer portion of the petition.\n<\/p>\n<p>                               Earlier prayer for bail of the petitioner was<\/p>\n<p>                     rejected vide order dated 30.4.2009 passed in Cr. Misc.<\/p>\n<p>                     No. 6520 of 2009.\n<\/p>\n<p>                               Submission is that the petitioner is in custody<\/p>\n<p>                     since 10.9.2008 and the process server of Nazarat has<\/p>\n<p>                     reported that the witnesses named in the chargesheet<\/p>\n<p>                     are non-existent. To ascertain this fact a report was<\/p>\n<p>                     called for which has been received. It is further<\/p>\n<p>                     submitted that supplementary affidavit has already<\/p>\n<p>                     been filed.\n<\/p>\n<p>                               Report dated 30th April, 2010 of the learned<\/p>\n<p>                     Additional Sessions Judge, Patna City shows that the<\/p>\n<p>                     process server enquired about the witnesses Om<\/p>\n<p>                     Prakash, Rajhu Manjhi, Malti Devi and Ganesh Thakur<\/p>\n<p>                     but no trace was made out.\n<\/p>\n<p><span class=\"hidden_text\">                         2<\/span><\/p>\n<p>                Considering the facts and circumstances of<\/p>\n<p>       the case, the petitioner above named is directed to be<\/p>\n<p>       released on furnishing of bail bond of Rs. 10,000\/- (ten<\/p>\n<p>       thousand) with two sureties of the like amount each to<\/p>\n<p>       the satisfaction of the learned Additional Sessions<\/p>\n<p>       Judge\/concerned Court, Patna City in Sessions Trial<\/p>\n<p>       No. 670 of 2009 arising out of Sultanganj (Agamkuan)<\/p>\n<p>       P.S.
