The present is the glaring<br \/>\nillustration of the same.  After the expiry of the original tenant of<br \/>\ncommercial premises, an application seeking shelter under all<br \/>\nrelevant provisions of Bombay Rent Act, like Section 5(11(C) and<br \/>\nother similar provisions and the decision of this Court as well as<br \/>\nthat of the Hon&#8217;ble the Apex Court is filed and it is contended that<br \/>\nthe applicant is required to be impleaded as party defendant.\n<\/p>\n<p>3.1\tThe learned Judge in its<br \/>\norder dated 19.09.2009 has rightly referred to the conduct of the<br \/>\npresent petitioner and has observed that he is resorting to delay<br \/>\ntactics.  Application Exh.121 was filed at the stage when not only<br \/>\nthe evidence of the applicant was over but even the arguments of the<br \/>\nplaintiffs were over and still with a view to see that the<br \/>\nproceedings are stalled, if not completely stalled, they are delayed,<br \/>\nif not delayed up to the satisfaction of the applicant, atleast to<br \/>\nsome extent, the application is filed.\n<\/p>\n<p>3.2\tThe learned Judge has<br \/>\nvery succinctly discussed the facts of the case and has also taken<br \/>\ninto consideration the decisions cited before him and then came to a<br \/>\nconclusion that the application deserves to be dismissed and it is<br \/>\naccordingly dismissed.\n<\/p>\n<p>4.\tLearned Advocate<br \/>\nMr.Jasani for the petitioner submitted that during the pendency of<br \/>\nthis petition before this Court, the suit is already decreed and<br \/>\nagainst that judgment and decree, an appeal is filed.\n<\/p>\n<p>\tThis Court cannot<br \/>\nhelp the present respondent   original plaintiff in any other<br \/>\nmanner then to dismiss this petition with costs because this Court<br \/>\nhas no doubt that the applicant of application Exh.121 is out to<br \/>\nextract money from the original plaintiff and is out to see that the<br \/>\nplaintiff is not able to get fruits of a decree passed in a suit of<br \/>\n1988, in the year 2009-10.\n<\/p>\n<p>5.\tThe petition is therefore<br \/>\ndismissed with costs of Rs.15,000\/- (Rupees Fifteen Thousand Only),<br \/>\npayment of which is made a condition precedent for filing any further<br \/>\nproceedings in this petition.  Notice is discharged.
