Shia Central Board  of<br \/>\nWakf  through its Secretary (for short the Shia Wakf Board)<br \/>\nand  some  other  persons of the sect by special  leave\t are<br \/>\ndirected  against  the\torder passed by the  Allahabad\tHigh<br \/>\nCourt  on  2nd\tSeptember, 1994 disposing  of  two  Revision<br \/>\nPetitions,  C.R.No.284\/92  filed  by the  U.P.Sunni  Central<br \/>\nBoard of Wakf (for short the Sunni Wakf Board) through its<br \/>\nSecretary  and\tsome  other persons of the  sect  and  Civil<br \/>\nRevision  No.255\/92  filed by the Shia Wakf Board) and\tsome<br \/>\nother persons of the sect.\n<\/p>\n<p>    The\t dispute  raised in the case relates to the  mosque,<br \/>\nAhnaf  Bar  Taley Pura Chhanga Kiyari Tola, Maunath  Bhanjan<br \/>\nand  its  Sehan and the Imam Chowk, registered as a Wakf  by<br \/>\nthe U.P.  Shia Central Board of Wakf.  Aggrieved by the said<br \/>\nregistration  the  Sunni Board through its Secretary made  a<br \/>\nreference  to  the Muslim Wakf Tribunal, Azamgarh which\t was<br \/>\nregistered  as suit No.154\/88.\tThe Controller Shia  Central<br \/>\nBoard of Wakf and two others were cited as defendants in the<br \/>\nproceeding.   The  prayer  in the plaint was  for  an  award<br \/>\ndeclaring  the\tproperty  in  the suit to  be  a  Shia\tWakf<br \/>\nproperty  and  not a Sunni Wakf property and to declare\t its<br \/>\nregistration  as  null\tand void, and  further\tto  restrain<br \/>\ndefendants from interfering with or disturbing in any manner<br \/>\nwith possession, administration, management and control over<br \/>\nthe property by the plaintiffs.\n<\/p>\n<p>    The\t gist  of the case pleaded by the plaintiff is\tthat<br \/>\nthe  mosque  and  its  sehan including the  Imam  Chowk\t was<br \/>\nconstructed  by\t the  ancestors\t of Late  Abdul\t Salam\twith<br \/>\nefforts\t of his grand father Md.  Azal Bilal.  The grave  of<br \/>\nMd.  Azal Bilal lies within the compound of the mosque.\t The<br \/>\nmosque\tincluding sehan and Imam Chowk have always  remained<br \/>\nunder  control and management of the Sunni sect of  Muslims.<br \/>\nMembers\t of the said sect had always called Azan in the said<br \/>\nmosque\tand  the congregation prayer have been led by  Sunni<br \/>\nPesh-e-Imam.\tSunni  Mulims  have   been   attending\t the<br \/>\ncongregation  in  the mosque and the sehan.  Members of\t the<br \/>\nsect  have been looking after the maintenance of the  mosque<br \/>\nand  its properties.  On the application made by Members  of<br \/>\nthe  Sunni  sect  of Muslims the Wakf  Board  after  inquiry<br \/>\nregistered the mosque, its sehan and the Imam Chowk as Sunni<br \/>\nWakf in 1980.\n<\/p>\n<p>    When  in  May 1978 certain works of\t reconstruction\t and<br \/>\nadditions  in the mosque were being carried on by the  Sunni<br \/>\nMuslims\t of the locality including the plaintiff No.2,\tsome<br \/>\nShia  muslims of the same locality including defendant\tno.3<br \/>\ntried  to  stop\t the work by filing suit No.246\/78  (Zia  Ul<br \/>\nHasan  vs.   Md.Ayub  and  ors.)  in  the  Court  of  Munsif<br \/>\nMohammadabad  Gohna,  District\tAzamgarh.    The  suit\t was<br \/>\nsubsequently  withdrawn.   The\tplaintiff alleged  that\t the<br \/>\ndefendants  surreptitiously  got  the mosque and  its  sehan<br \/>\nregistered  in the office of the Shia Wakf Board behind\t the<br \/>\nback of the plaintiffs.\t In the proceeding under Section 145<br \/>\nCr.P.C.\t  initiated  in\t March,\t 1988 in the  Court  of\t the<br \/>\nSub-Divisional\tMagistrate No.96\/11 of 1988 it was disclosed<br \/>\nthat  the mosque and its property have been registered as  a<br \/>\nWakf under the Shia Wakf Board.\t On coming to know about the<br \/>\naction\tof the defendants in the matter the plaintiffs filed<br \/>\nthe suit within 90 days from the date of knowledge about the<br \/>\norder of registration dated 30th October, 1978.\n<\/p>\n<p>    The\t defendants refuted the claim of the plaintiffs that<br \/>\nthe  mosque  and its sehan and the Imam Chowk constituted  a<br \/>\nSunni Wakf.  They claimed that the mosque and its properties<br \/>\nwere  Shia  Wakf and were rightly registered as such by\t the<br \/>\nShia Wakf Board.\n<\/p>\n<p>    The\t Tribunal  by  its  judgment dated  20th  May,\t1992<br \/>\nallowed\t  the  claim  of  the\tplaintiffs  in\tpart.\t The<br \/>\nregistration  of the mosque in question along with its sehan<br \/>\nby  the Shia Wakf Board was declared to be null and void and<br \/>\naccordingly set aside.\tIn respect of the Imam Chowk and its<br \/>\nsehan  the registration was held to be valid.  The relief of<br \/>\ninjunction  was granted to the plaintiff only in respect  of<br \/>\nthe  management,  supervision and control of the  mosque  in<br \/>\nquestion.  It was further made clear by the Tribunal that no<br \/>\ninjunction  was granted in respect of the offering of  Namaz<br \/>\nby  the\t defendants in the mosque.  Being aggrieved  by\t the<br \/>\nsaid  judgment\tboth  the parties filed\t Revision  Petitions<br \/>\nbefore the High Court, as noted earlier.\n<\/p>\n<p>    The High Court in its Judgment dated 2nd September, 1994<br \/>\ndismissed  the\tCivil Revision No.255\/92 filed by  the\tShia<br \/>\nWakf  Board and allowed the C.R.No.284\/92 filed by the Sunni<br \/>\nWakf  Board  relating  to the Imam Chowk  and  remanded\t the<br \/>\nmatter\tto the Tribunal for fresh trial in the light of\t the<br \/>\nobservations made in the Judgment.\n<\/p>\n<p>    Hence these appeals by the Shia Wakf Board.\n<\/p>\n<p>    The\t main  thrust of the arguments of Shri Sunil  Gupta,<br \/>\nlearned\t  counsel  for\tthe   appellants  were\tagainst\t the<br \/>\nmaintainability of the reference to the Tribunal.  According<br \/>\nto  Shri  Gupta\t the essence of the dispute  raised  in\t the<br \/>\nplaint\tis whether the mosque, its sehan and the Imam  Chowk<br \/>\nwere  the  properties  of the Sunni sect or the\t Shia  sect.<br \/>\nSuch a dispute, Shri Gupta submits, does not come within the<br \/>\npurview\t of section 29(8) of the Uttar Pradesh Muslim  Wakfs<br \/>\nAct,  1960  (for  short\t the  Act).   It  is  the  further<br \/>\nsubmission  of\tShri  Gupta  that  in  the  absence  of\t any<br \/>\nnotification  by the Commissioner under section 6(4) of\t the<br \/>\nAct  a reference under section 8(1) is not maintainable.  It<br \/>\nis  also the submission of Shri Gupta that under the proviso<br \/>\nto  section  8(1) which controls the main provision  of\t the<br \/>\nsection, the dispute is barred by limitation.\n<\/p>\n<p>    The\t Act provides for public governance,  administration<br \/>\nand  supervision of certain classes of Wakf in the State  of<br \/>\nU.P.  The Act applies to all Wakfs whether created before or<br \/>\nafter  its  commencement  and  any   part  of  the  property<br \/>\ncomprised in Wakfs situated in the State of U.P.  In section<br \/>\n3(3)  Commissioner  is defined to mean a  Commissioner\tof<br \/>\nWakfs appointed by the State Government under section 4.  In<br \/>\nSection\t 3(11)\tWakf  is  defined to  mean  the\t permanent<br \/>\ndedication  or\tgrant  of  any\t property  for\tany  purpose<br \/>\nrecognised by the Muslim Law or usage as religious, pious or<br \/>\ncharitable,  and includes wakfs-alal-aulad to the extent  to<br \/>\nwhich  the  property  is dedicated or granted for  any\tsuch<br \/>\npurpose\t as  aforesaid and wakf by user;  and wakif  means<br \/>\nthe person who makes such dedication or grant.\n<\/p>\n<p>    Wakf  property  as defined in section  3(12)  includes<br \/>\nofferings made at a shrine or tomb or imambara.\n<\/p>\n<p>    Section 6 makes the provision regarding Survey of Wakfs.<br \/>\nIt  provides  that  the Commissioner of\t wakfs\tshall  after<br \/>\nmaking such inquiries as he may consider necessary ascertain<br \/>\nand  determine\tthe number of all wakfs in the area  showing<br \/>\nthe  Shia wakfs and Sunni wakfs separately;  the nature\t and<br \/>\nobject\tof  each  wakf;\t the gross income  of  the  property<br \/>\ncomprised  in each wakf;  amount of revenue, cesses,  rates,<br \/>\ntaxes  and surcharge payable to the Government etc.  In\t the<br \/>\nproviso to sub-section (2) of section 6 it is laid down that<br \/>\nwhere  there is a dispute as to whether a particular wakf is<br \/>\na Shia Wakf or Sunni Wakf and there are clear indications in<br \/>\nthe  recitals of the deed of wakf as to the sect to which it<br \/>\npertains, such dispute shall be decided on the basis of such<br \/>\nrecitals.   In\tsub-section  (4) of section 6 a\t mandate  is<br \/>\nissued\tto the Commissioner, the Additional Commissioner  to<br \/>\nsubmit\this  report  of enquiry containing  the\t particulars<br \/>\nmentioned  in  sub-section (2) to each of the Board and\t the<br \/>\nState Government, and the State Government shall, as soon as<br \/>\npossible  notify the same in the official gazette the  wakfs<br \/>\nrelating  to  particular sect, to which, according  to\tsuch<br \/>\nreport,\t the  provisions  of this Act apply.  Section  8  on<br \/>\nwhich much reliance is placed by the learned counsel for the<br \/>\nappellants is quoted hereunder:\t Section:8<\/p>\n<p>    (1)\t if any dispute arises whether a particular property<br \/>\nis  wakf property or not or whether a wakf is a Shia wakf or<br \/>\nSunni wakf, the Board concerned or the mutawalli of the wakf<br \/>\nor  any\t person interested therein, may, in accordance\twith<br \/>\nthe   provisions  of  this  Act,   refer  the  dispute\t for<br \/>\nadjudication to the Tribunal:\n<\/p>\n<p>    Provided  that no such dispute shall be entertained by a<br \/>\nTribunal  after the expiry of one year from the date of\t the<br \/>\npublication  of\t the list of wakfs under sub-section (4)  of<br \/>\nSection 6.\n<\/p>\n<p>    (2)The  Commissioner,  Additional Commissioner of  Wakfs<br \/>\nand  Assistant\tCommissioner  of Wakfs shall not be  made  a<br \/>\nparty to any proceeding under sub-sction (1).\n<\/p>\n<p>    The\t next provision which is relevant for the purpose of<br \/>\nthe  Act  is  section  29 which is  in\tChapter\t III  titled<br \/>\nRegistration of Wakfs In Section 29(1) it is declared that<br \/>\nevery  other  wakf, whether subject to this Act or  not\t and<br \/>\nwhether\t created  before or after the commencement  of\tthis<br \/>\nAct,  shall be registered at the office of the Board of\t the<br \/>\nsect to which the wakf belongs.\n<\/p>\n<p>    In\tsub-section (2) it is provided that application\t for<br \/>\nregistration  shall be made by the mutawalli within 3 months<br \/>\nof  his entering into possession of Wakf property,  provided<br \/>\nthat  such  application\t may  be made by  the  wakf  or\t his<br \/>\ndescendants  or\t a  beneficiary of the wakf  or\t any  Muslim<br \/>\nbelonging to the sect to which the Wakf belongs.\n<\/p>\n<p>    Sub-sections  (3), (4) and (5) deal with the contents of<br \/>\nthe application for registration and the manner in which the<br \/>\napplication  shall  be filed.  Sub-sections (7) &amp; (8)  which<br \/>\nare  relevant  for  the purpose of the\tcase  are  extracted<br \/>\nhereunder:\n<\/p>\n<p>    7.\t On receipt of an application for registration, the<br \/>\nBoard  may,  before the registration of the wakf, make\tsuch<br \/>\ninquiries as it thinks fit in respect of the genuineness and<br \/>\nvalidity  of  the  application and the\tcorrectness  of\t any<br \/>\nparticular therein, and, when the application is made by any<br \/>\nperson\t other\tthan  the   person  administering  the\twakf<br \/>\nproperty, the Board shall, before registering the wakf, give<br \/>\nnotice\tof  the application to the person administering\t the<br \/>\nwakf  property\tand shall after affording him  a  reasonable<br \/>\nopportunity  of being heard, pass such order as it may\tdeem<br \/>\nfit.\n<\/p>\n<p>    (8)\t Any person aggrieved by an order of the Board under<br \/>\nsub-section(7)\tmay, by application within 90 days from\t the<br \/>\ndate  of that order, refer the dispute to the Tribunal which<br \/>\nshall give its decision thereon.\n<\/p>\n<p>    From  the  conspectus of the statutory provisions  noted<br \/>\nabove,\tthe  scheme of the statute is clear that in case  of<br \/>\nany  dispute, whether a particular property is Wakf property<br \/>\nor  not\t or whether a Wakf is a Shia Wakf or Sunni Wakf\t the<br \/>\nBoard  concerned or the mutawalli of the Wakf or any  person<br \/>\ninterested in the Wakf may in accordance with the provisions<br \/>\nof  the\t law  refer  the dispute  for  adjudication  to\t the<br \/>\nTribunal.  Under the proviso to sub-section(1) a restriction<br \/>\nis  imposed  that no such dispute shall be entertained by  a<br \/>\nTribunal  after\t the  expiry of one year from  the  date  of<br \/>\npublication  of\t the list of Wakfs under sub- section(4)  of<br \/>\nSection\t 6.   On  a  plain   reading  of  the  provision  in<br \/>\nsub-section(1)\tit  is\tclear that it is expressed  in\twide<br \/>\nterms  taking  within its fold different types\tof  disputes<br \/>\nrelating  to a Wakf and its properties.\t The statute enables<br \/>\ndifferent  classes of persons interested in the Wakf and its<br \/>\nproperties  like the Board concerned, the mutawalli and\t any<br \/>\nperson\tinterested in the Wakf to raise a dispute.  The only<br \/>\nrestriction  sought  to be placed on such a reference is  in<br \/>\nthe  proviso, wherein it is laid down that after the list of<br \/>\nWakfs  is published by the Commissioner under sub-section(4)<br \/>\nof  section 6 of the Act then the dispute has to be made  to<br \/>\nthe  Tribunal  within one year from the date of\t publication<br \/>\nand  the Tribunal is precluded from entertaining the dispute<br \/>\nafter the expiry of one year.  The section does not make any<br \/>\nprovision  that\t the publication of a list of Wakfs  by\t the<br \/>\nCommissioner  under  section  6\t is a sine  qua\t non  for  a<br \/>\nreference  under section 8(1) of the Act.  All that is\tlaid<br \/>\ndown  in the proviso to sub-section(1) is that after a\tlist<br \/>\nof  Wakfs  has\tbeen published by the  Commissioner  then  a<br \/>\ndispute\t as  contemplated  in the proviso has to  be  raised<br \/>\nwithin one year from the date of the publication of the list<br \/>\nof  Wakfs and not thereafter.  It is pertinent to note\there<br \/>\nthat in the present case no list of Wakfs has been published<br \/>\nby  the\t Commissioner  under section 6(4).   Therefore,\t the<br \/>\nlimitation  prescribed\tin the proviso to sub-section(1)  of<br \/>\nsection 8 has no application in the case.\n<\/p>\n<p>    In\tthe present case as noted earlier, both the sects of<br \/>\nMuslims\t in  the locality have claimed the mosque its  sehan<br \/>\nand  the  Imam\tChowk as Wakf belonging to  their  sect\t and<br \/>\nregistration  of  the  properties accordingly.\t It  is\t not<br \/>\ndisputed  that\ta  dispute of this nature comes\t within\t the<br \/>\npurview of sub-section(1) of section (8) of the Act.  In the<br \/>\ncircumstances  of  the case the contentions raised  by\tShri<br \/>\nGupta  against maintainability of the reference made to\t the<br \/>\nTribunal  under\t section 8(1) of the Act on the ground\tthat<br \/>\nsuch  a\t reference  does  not  lie   in\t the  absence  of  a<br \/>\npublication of the list of Wakfs by the Commissioner or that<br \/>\nthe  reference\tis barred by limitation cannot be  accepted.<br \/>\nShri  Gupta heavily relied on the decision of the  Allahabad<br \/>\nHigh  Court  in\t the case of Mukhtar Husain  and  ors.\t Vs.<br \/>\nFattu  and  others  (1975  A.W.C.   462)  in  which  a\tview<br \/>\nsupporting  his contention was taken and submitted that\t the<br \/>\nlaw  laid down in that case has held the field for all these<br \/>\nyears.\t In view of the discussions made above we need\tonly<br \/>\nsay  that the view taken by the Allahabad High Court in\t the<br \/>\naforementioned\tcase is contrary to the statutory provisions<br \/>\nand  not  in  accord  with the intent  and  purpose  of\t the<br \/>\nlegislature  as\t expressed  in\tthe  sections.\t It  is\t our<br \/>\nconsidered  view  that\tthe decision does not lay  down\t the<br \/>\ncorrect position of law.\n<\/p>\n<p>    Coming to sub-section (8) of section 29 the provision in<br \/>\nour view vests an independent right in a person aggrieved by<br \/>\nan  order  of  the  Board under sub-section(7)\tto  make  an<br \/>\napplication  to\t refer\tthe dispute to the  Tribunal.\tSuch<br \/>\napplication  is\t to be made within 90 days from the date  of<br \/>\nthe order by which the applicant feels aggrieved.\n<\/p>\n<p>    In\tthis  regard the case of the respondents  that\tthey<br \/>\ncame  to know about the registration of the mosque its sehan<br \/>\nand  the  Imam Chowk by the Sunni Wakf Board in course of  a<br \/>\nproceeding  under  section 145 Cr.P.C.\tand within  90\tdays<br \/>\nthereafter they filed a dispute before the Tribunal has been<br \/>\naccepted  by  the Tribunal and confirmed by the High  Court.<br \/>\nThere  is  little scope to disturb the findings of  fact  in<br \/>\nthese appeals.\tTherefore, the contention of Shri Gupta that<br \/>\nthe  dispute raised before the Tribunal under section  29(8)<br \/>\nof the Act was barred by limitation also cannot be accepted.<br \/>\nNo  other contention was raised on behalf of the  appellant.<br \/>\nIn  the\t result\t the  appeals\tare  dismissed\tbut  in\t the<br \/>\ncircumstances  of  the case without any order as  to  costs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India U.P.
