    These  appeals filed by the U.P.  Shia Central Board  of
\nWakf  through its Secretary (for short the Shia Wakf Board)
\nand  some  other  persons of the sect by special  leave\t are
\ndirected  against  the\torder passed by the  Allahabad\tHigh
\nCourt  on  2nd\tSeptember, 1994 disposing  of  two  Revision
\nPetitions,  C.R.No.284\/92  filed  by the  U.P.Sunni  Central
\nBoard of Wakf (for short the Sunni Wakf Board) through its
\nSecretary  and\tsome  other persons of the  sect  and  Civil
\nRevision  No.255\/92  filed by the Shia Wakf Board) and\tsome
\nother persons of the sect.\n<\/p>\n
    The\t dispute  raised in the case relates to the  mosque,
\nAhnaf  Bar  Taley Pura Chhanga Kiyari Tola, Maunath  Bhanjan
\nand  its  Sehan and the Imam Chowk, registered as a Wakf  by
\nthe U.P.  Shia Central Board of Wakf.  Aggrieved by the said
\nregistration  the  Sunni Board through its Secretary made  a
\nreference  to  the Muslim Wakf Tribunal, Azamgarh which\t was
\nregistered  as suit No.154\/88.\tThe Controller Shia  Central
\nBoard of Wakf and two others were cited as defendants in the
\nproceeding.   The  prayer  in the plaint was  for  an  award
\ndeclaring  the\tproperty  in  the suit to  be  a  Shia\tWakf
\nproperty  and  not a Sunni Wakf property and to declare\t its
\nregistration  as  null\tand void, and  further\tto  restrain
\ndefendants from interfering with or disturbing in any manner
\nwith possession, administration, management and control over
\nthe property by the plaintiffs.\n<\/p>\n
    The\t gist  of the case pleaded by the plaintiff is\tthat
\nthe  mosque  and  its  sehan including the  Imam  Chowk\t was
\nconstructed  by\t the  ancestors\t of Late  Abdul\t Salam\twith
\nefforts\t of his grand father Md.  Azal Bilal.  The grave  of
\nMd.  Azal Bilal lies within the compound of the mosque.\t The
\nmosque\tincluding sehan and Imam Chowk have always  remained
\nunder  control and management of the Sunni sect of  Muslims.
\nMembers\t of the said sect had always called Azan in the said
\nmosque\tand  the congregation prayer have been led by  Sunni
\nPesh-e-Imam.\tSunni  Mulims  have   been   attending\t the
\ncongregation  in  the mosque and the sehan.  Members of\t the
\nsect  have been looking after the maintenance of the  mosque
\nand  its properties.  On the application made by Members  of
\nthe  Sunni  sect  of Muslims the Wakf  Board  after  inquiry
\nregistered the mosque, its sehan and the Imam Chowk as Sunni
\nWakf in 1980.\n<\/p>\n
    When  in  May 1978 certain works of\t reconstruction\t and
\nadditions  in the mosque were being carried on by the  Sunni
\nMuslims\t of the locality including the plaintiff No.2,\tsome
\nShia  muslims of the same locality including defendant\tno.3
\ntried  to  stop\t the work by filing suit No.246\/78  (Zia  Ul
\nHasan  vs.   Md.Ayub  and  ors.)  in  the  Court  of  Munsif
\nMohammadabad  Gohna,  District\tAzamgarh.    The  suit\t was
\nsubsequently  withdrawn.   The\tplaintiff alleged  that\t the
\ndefendants  surreptitiously  got  the mosque and  its  sehan
\nregistered  in the office of the Shia Wakf Board behind\t the
\nback of the plaintiffs.\t In the proceeding under Section 145
\nCr.P.C.\t  initiated  in\t March,\t 1988 in the  Court  of\t the
\nSub-Divisional\tMagistrate No.96\/11 of 1988 it was disclosed
\nthat  the mosque and its property have been registered as  a
\nWakf under the Shia Wakf Board.\t On coming to know about the
\naction\tof the defendants in the matter the plaintiffs filed
\nthe suit within 90 days from the date of knowledge about the
\norder of registration dated 30th October, 1978.\n<\/p>\n
    The\t defendants refuted the claim of the plaintiffs that
\nthe  mosque  and its sehan and the Imam Chowk constituted  a
\nSunni Wakf.  They claimed that the mosque and its properties
\nwere  Shia  Wakf and were rightly registered as such by\t the
\nShia Wakf Board.\n<\/p>\n
    The\t Tribunal  by  its  judgment dated  20th  May,\t1992
\nallowed\t  the  claim  of  the\tplaintiffs  in\tpart.\t The
\nregistration  of the mosque in question along with its sehan
\nby  the Shia Wakf Board was declared to be null and void and
\naccordingly set aside.\tIn respect of the Imam Chowk and its
\nsehan  the registration was held to be valid.  The relief of
\ninjunction  was granted to the plaintiff only in respect  of
\nthe  management,  supervision and control of the  mosque  in
\nquestion.  It was further made clear by the Tribunal that no
\ninjunction  was granted in respect of the offering of  Namaz
\nby  the\t defendants in the mosque.  Being aggrieved  by\t the
\nsaid  judgment\tboth  the parties filed\t Revision  Petitions
\nbefore the High Court, as noted earlier.\n<\/p>\n
    The High Court in its Judgment dated 2nd September, 1994
\ndismissed  the\tCivil Revision No.255\/92 filed by  the\tShia
\nWakf  Board and allowed the C.R.No.284\/92 filed by the Sunni
\nWakf  Board  relating  to the Imam Chowk  and  remanded\t the
\nmatter\tto the Tribunal for fresh trial in the light of\t the
\nobservations made in the Judgment.\n<\/p>\n
    Hence these appeals by the Shia Wakf Board.\n<\/p>\n
    The\t main  thrust of the arguments of Shri Sunil  Gupta,
\nlearned\t  counsel  for\tthe   appellants  were\tagainst\t the
\nmaintainability of the reference to the Tribunal.  According
\nto  Shri  Gupta\t the essence of the dispute  raised  in\t the
\nplaint\tis whether the mosque, its sehan and the Imam  Chowk
\nwere  the  properties  of the Sunni sect or the\t Shia  sect.
\nSuch a dispute, Shri Gupta submits, does not come within the
\npurview\t of section 29(8) of the Uttar Pradesh Muslim  Wakfs
\nAct,  1960  (for  short\t the  Act).   It  is  the  further
\nsubmission  of\tShri  Gupta  that  in  the  absence  of\t any
\nnotification  by the Commissioner under section 6(4) of\t the
\nAct  a reference under section 8(1) is not maintainable.  It
\nis  also the submission of Shri Gupta that under the proviso
\nto  section  8(1) which controls the main provision  of\t the
\nsection, the dispute is barred by limitation.\n<\/p>\n
    The\t Act provides for public governance,  administration
\nand  supervision of certain classes of Wakf in the State  of
\nU.P.  The Act applies to all Wakfs whether created before or
\nafter  its  commencement  and  any   part  of  the  property
\ncomprised in Wakfs situated in the State of U.P.  In section
\n3(3)  Commissioner  is defined to mean a  Commissioner\tof
\nWakfs appointed by the State Government under section 4.  In
\nSection\t 3(11)\tWakf  is  defined to  mean  the\t permanent
\ndedication  or\tgrant  of  any\t property  for\tany  purpose
\nrecognised by the Muslim Law or usage as religious, pious or
\ncharitable,  and includes wakfs-alal-aulad to the extent  to
\nwhich  the  property  is dedicated or granted for  any\tsuch
\npurpose\t as  aforesaid and wakf by user;  and wakif  means
\nthe person who makes such dedication or grant.\n<\/p>\n
    Wakf  property  as defined in section  3(12)  includes
\nofferings made at a shrine or tomb or imambara.\n<\/p>\n
    Section 6 makes the provision regarding Survey of Wakfs.
\nIt  provides  that  the Commissioner of\t wakfs\tshall  after
\nmaking such inquiries as he may consider necessary ascertain
\nand  determine\tthe number of all wakfs in the area  showing
\nthe  Shia wakfs and Sunni wakfs separately;  the nature\t and
\nobject\tof  each  wakf;\t the gross income  of  the  property
\ncomprised  in each wakf;  amount of revenue, cesses,  rates,
\ntaxes  and surcharge payable to the Government etc.  In\t the
\nproviso to sub-section (2) of section 6 it is laid down that
\nwhere  there is a dispute as to whether a particular wakf is
\na Shia Wakf or Sunni Wakf and there are clear indications in
\nthe  recitals of the deed of wakf as to the sect to which it
\npertains, such dispute shall be decided on the basis of such
\nrecitals.   In\tsub-section  (4) of section 6 a\t mandate  is
\nissued\tto the Commissioner, the Additional Commissioner  to
\nsubmit\this  report  of enquiry containing  the\t particulars
\nmentioned  in  sub-section (2) to each of the Board and\t the
\nState Government, and the State Government shall, as soon as
\npossible  notify the same in the official gazette the  wakfs
\nrelating  to  particular sect, to which, according  to\tsuch
\nreport,\t the  provisions  of this Act apply.  Section  8  on
\nwhich much reliance is placed by the learned counsel for the
\nappellants is quoted hereunder:\t Section:8<\/p>\n
    (1)\t if any dispute arises whether a particular property
\nis  wakf property or not or whether a wakf is a Shia wakf or
\nSunni wakf, the Board concerned or the mutawalli of the wakf
\nor  any\t person interested therein, may, in accordance\twith
\nthe   provisions  of  this  Act,   refer  the  dispute\t for
\nadjudication to the Tribunal:\n<\/p>\n
    Provided  that no such dispute shall be entertained by a
\nTribunal  after the expiry of one year from the date of\t the
\npublication  of\t the list of wakfs under sub-section (4)  of
\nSection 6.\n<\/p>\n
    (2)The  Commissioner,  Additional Commissioner of  Wakfs
\nand  Assistant\tCommissioner  of Wakfs shall not be  made  a
\nparty to any proceeding under sub-sction (1).\n<\/p>\n
    The\t next provision which is relevant for the purpose of
\nthe  Act  is  section  29 which is  in\tChapter\t III  titled
\nRegistration of Wakfs In Section 29(1) it is declared that
\nevery  other  wakf, whether subject to this Act or  not\t and
\nwhether\t created  before or after the commencement  of\tthis
\nAct,  shall be registered at the office of the Board of\t the
\nsect to which the wakf belongs.\n<\/p>\n
    In\tsub-section (2) it is provided that application\t for
\nregistration  shall be made by the mutawalli within 3 months
\nof  his entering into possession of Wakf property,  provided
\nthat  such  application\t may  be made by  the  wakf  or\t his
\ndescendants  or\t a  beneficiary of the wakf  or\t any  Muslim
\nbelonging to the sect to which the Wakf belongs.\n<\/p>\n
    Sub-sections  (3), (4) and (5) deal with the contents of
\nthe application for registration and the manner in which the
\napplication  shall  be filed.  Sub-sections (7) & (8)  which
\nare  relevant  for  the purpose of the\tcase  are  extracted
\nhereunder:\n<\/p>\n
    7.\t On receipt of an application for registration, the
\nBoard  may,  before the registration of the wakf, make\tsuch
\ninquiries as it thinks fit in respect of the genuineness and
\nvalidity  of  the  application and the\tcorrectness  of\t any
\nparticular therein, and, when the application is made by any
\nperson\t other\tthan  the   person  administering  the\twakf
\nproperty, the Board shall, before registering the wakf, give
\nnotice\tof  the application to the person administering\t the
\nwakf  property\tand shall after affording him  a  reasonable
\nopportunity  of being heard, pass such order as it may\tdeem
\nfit.\n<\/p>\n
    (8)\t Any person aggrieved by an order of the Board under
\nsub-section(7)\tmay, by application within 90 days from\t the
\ndate  of that order, refer the dispute to the Tribunal which
\nshall give its decision thereon.\n<\/p>\n
    From  the  conspectus of the statutory provisions  noted
\nabove,\tthe  scheme of the statute is clear that in case  of
\nany  dispute, whether a particular property is Wakf property
\nor  not\t or whether a Wakf is a Shia Wakf or Sunni Wakf\t the
\nBoard  concerned or the mutawalli of the Wakf or any  person
\ninterested in the Wakf may in accordance with the provisions
\nof  the\t law  refer  the dispute  for  adjudication  to\t the
\nTribunal.  Under the proviso to sub-section(1) a restriction
\nis  imposed  that no such dispute shall be entertained by  a
\nTribunal  after\t the  expiry of one year from  the  date  of
\npublication  of\t the list of Wakfs under sub- section(4)  of
\nSection\t 6.   On  a  plain   reading  of  the  provision  in
\nsub-section(1)\tit  is\tclear that it is expressed  in\twide
\nterms  taking  within its fold different types\tof  disputes
\nrelating  to a Wakf and its properties.\t The statute enables
\ndifferent  classes of persons interested in the Wakf and its
\nproperties  like the Board concerned, the mutawalli and\t any
\nperson\tinterested in the Wakf to raise a dispute.  The only
\nrestriction  sought  to be placed on such a reference is  in
\nthe  proviso, wherein it is laid down that after the list of
\nWakfs  is published by the Commissioner under sub-section(4)
\nof  section 6 of the Act then the dispute has to be made  to
\nthe  Tribunal  within one year from the date of\t publication
\nand  the Tribunal is precluded from entertaining the dispute
\nafter the expiry of one year.  The section does not make any
\nprovision  that\t the publication of a list of Wakfs  by\t the
\nCommissioner  under  section  6\t is a sine  qua\t non  for  a
\nreference  under section 8(1) of the Act.  All that is\tlaid
\ndown  in the proviso to sub-section(1) is that after a\tlist
\nof  Wakfs  has\tbeen published by the  Commissioner  then  a
\ndispute\t as  contemplated  in the proviso has to  be  raised
\nwithin one year from the date of the publication of the list
\nof  Wakfs and not thereafter.  It is pertinent to note\there
\nthat in the present case no list of Wakfs has been published
\nby  the\t Commissioner  under section 6(4).   Therefore,\t the
\nlimitation  prescribed\tin the proviso to sub-section(1)  of
\nsection 8 has no application in the case.\n<\/p>\n
    In\tthe present case as noted earlier, both the sects of
\nMuslims\t in  the locality have claimed the mosque its  sehan
\nand  the  Imam\tChowk as Wakf belonging to  their  sect\t and
\nregistration  of  the  properties accordingly.\t It  is\t not
\ndisputed  that\ta  dispute of this nature comes\t within\t the
\npurview of sub-section(1) of section (8) of the Act.  In the
\ncircumstances  of  the case the contentions raised  by\tShri
\nGupta  against maintainability of the reference made to\t the
\nTribunal  under\t section 8(1) of the Act on the ground\tthat
\nsuch  a\t reference  does  not  lie   in\t the  absence  of  a
\npublication of the list of Wakfs by the Commissioner or that
\nthe  reference\tis barred by limitation cannot be  accepted.
\nShri  Gupta heavily relied on the decision of the  Allahabad
\nHigh  Court  in\t the case of Mukhtar Husain  and  ors.\t Vs.
\nFattu  and  others  (1975  A.W.C.   462)  in  which  a\tview
\nsupporting  his contention was taken and submitted that\t the
\nlaw  laid down in that case has held the field for all these
\nyears.\t In view of the discussions made above we need\tonly
\nsay  that the view taken by the Allahabad High Court in\t the
\naforementioned\tcase is contrary to the statutory provisions
\nand  not  in  accord  with the intent  and  purpose  of\t the
\nlegislature  as\t expressed  in\tthe  sections.\t It  is\t our
\nconsidered  view  that\tthe decision does not lay  down\t the
\ncorrect position of law.\n<\/p>\n
    Coming to sub-section (8) of section 29 the provision in
\nour view vests an independent right in a person aggrieved by
\nan  order  of  the  Board under sub-section(7)\tto  make  an
\napplication  to\t refer\tthe dispute to the  Tribunal.\tSuch
\napplication  is\t to be made within 90 days from the date  of
\nthe order by which the applicant feels aggrieved.\n<\/p>\n
    In\tthis  regard the case of the respondents  that\tthey
\ncame  to know about the registration of the mosque its sehan
\nand  the  Imam Chowk by the Sunni Wakf Board in course of  a
\nproceeding  under  section 145 Cr.P.C.\tand within  90\tdays
\nthereafter they filed a dispute before the Tribunal has been
\naccepted  by  the Tribunal and confirmed by the High  Court.
\nThere  is  little scope to disturb the findings of  fact  in
\nthese appeals.\tTherefore, the contention of Shri Gupta that
\nthe  dispute raised before the Tribunal under section  29(8)
\nof the Act was barred by limitation also cannot be accepted.
\nNo  other contention was raised on behalf of the  appellant.
\nIn  the\t result\t the  appeals\tare  dismissed\tbut  in\t the
\ncircumstances  of  the case without any order as  to  costs.<\/p>\n","protected":false},"excerpt":{"rendered":"
