JOSEPH, J.\n\n           ````````````````````````````````````````````````````\n                W.P.(C) No. 25012 OF 2008 C\n           ````````````````````````````````````````````````````\n           Dated this the 19th day of August, 2008\n\n                         J U D G M E N T\n<\/pre>\n<p>          Petitioner has approached this Court aggrieved by<\/p>\n<p>Exts.P1 and P2. There was a personal hearing on the basis<\/p>\n<p>of Exts.P3 and P4 objections filed by the petitioner. The 1st<\/p>\n<p>respondent passed Exts.P6 and P7 and the petitioner<\/p>\n<p>preferred Exts.P8 and P9 appeals before the Deputy Chief<\/p>\n<p>Engineer who called upon the petitioner to remit 50% of the<\/p>\n<p>amount. The petitioner has approached this Court aggrieved<\/p>\n<p>by the said direction.       The petitioner seeks a direction to<\/p>\n<p>consider Exts.P8 and P9 statutory appeals without insisting to<\/p>\n<p>pay 50% of the amount.\n<\/p>\n<p>     2.   I heard      learned counsel for the petitioner and<\/p>\n<p>learned standing counsel. Learned standing counsel points<\/p>\n<p>out that actually the appeal may not lie before the Deputy<\/p>\n<p>Chief Engineer under section 127 as it is a re-assessment<\/p>\n<p>under section 24 and it is open to the petitioner to approach<\/p>\n<p>WPC.25012\/08<br \/>\n<span class=\"hidden_text\">                               : 2 :<\/span><\/p>\n<p>the Consumer Grievance Redressal Forum, Ernakulam. In<\/p>\n<p>such circumstances, writ petition is disposed of as follows.<\/p>\n<p>     If the petitioner prefers separate petitions in regard to<\/p>\n<p>the separate complaints before the Consumer Grievance<\/p>\n<p>Redressal Forum, Ernakulam, within three weeks from today,<\/p>\n<p>the Consumer Grievance Redressal Forum, Ernakulam will<\/p>\n<p>consider the same and take a decision in the matter, in<\/p>\n<p>accordance with law, after affording an opportunity for hearing<\/p>\n<p>to the petitioner, within three months from the date of receipt<\/p>\n<p>of a copy of this judgment.
