Rule<br \/>\n\tserved to respondent no. 3 but no appearance is filed by respondent<br \/>\n\tno. 3.\n<\/p>\n<p>The<br \/>\n\tpresent application is filed by applicant with a prayer to condone<br \/>\n\tdelay of 128 days in filing CRA.  The respondent no. 2 and 3 have<br \/>\n\tfiled affidavit in reply opposing delay condone application as<br \/>\n\tprayed by applicant while making specific averment made in para 3,<br \/>\n\twhich is quoted as under:\n<\/p>\n<p>&#8220;3.\tI<br \/>\n\tfurther say that the date on which the impugned order was received<br \/>\n\tby the application is shown as a blank in the copy supplied to the<br \/>\n\tanswering respondent.  Hence, it cannot be said that the petition<br \/>\n\twas filed within the period of limitation as averred in the<br \/>\n\tapplication.&#8221;\n<\/p>\n<p>It<br \/>\n\tis necessary to consider order passed by this Court in SCA no.<br \/>\n\t9292\/2010 dated 11\/8\/2010, which is quoted as under:\n<\/p>\n<p>&#8220;1.\tConsidering<br \/>\n judgments of the Bombay High Court in the case of Babaji Kondaji<br \/>\nMali Vs. Bala Fakira Mahar, reported in 1938 BLR (Vol.40) Page 104;<br \/>\nin the case of Dalpat Zopdoo Patil Vs. Mahadu Uka, reported in 1912<br \/>\nBLR (Vol.14) Page 259; and in the case of Purshottam Janardhan<br \/>\nChaphakar Vs. Mahadu Pandu Turmalkar, reported in 1912 BLR (Vol14)<br \/>\nPage 947,  revision application is maintainable against the order<br \/>\npassed by the Deputy Collector.  Shri Chaudhary, learned advocate<br \/>\nappearing on behalf of the petitioners has submitted that he may be<br \/>\npermitted to file a  revision application and that it may cause some<br \/>\ndelay in doing so.  It will be open for the petitioners to contend in<br \/>\nthe revision application that they were prosecuting the present<br \/>\nSpecial Civil Application, and, therefore, there is delay in filing<br \/>\nthe same and the same may be considered while deciding the<br \/>\napplication for condonation of delay.\n<\/p>\n<p>2.\tWith this<br \/>\nobservation and liberty in favour of the petitioners to file revision<br \/>\napplication, the present Special Civil Application is dismissed.&#8221;\n<\/p>\n<p>I<br \/>\n\thave considered submission made by learned advocates appearing for<br \/>\n\trespective parties. In light of aforesaid fact, which found from<br \/>\n\trecord and considering averment made in present application as well<br \/>\n\tas in reply by other side and also considering recent decision of<br \/>\n\tApex Court reported in  2011 (1) SCC 117.<br \/>\n\tAccording to my opinion, sufficient cause has shown by applicant for<br \/>\n\tcondoning delay of 128 days in filing present CRA to the<br \/>\n\tsatisfaction of this Court.
