Justice K.HEMA\n\n Dated :10\/06\/2008\n\n O R D E R\n                            K.HEMA, J.\n                   -------------------------------------------\n                         B.A.No.3396 of 2008\n                   -------------------------------------------\n               Dated this the 10th day of June, 2008\n\n                                   ORDER\n<\/pre>\n<p>      Petition for anticipatory bail.\n<\/p>\n<p>      2.    According to the prosecution, petitioners allegedly<\/p>\n<p>assaulted the defacto complainant and committed offences under<\/p>\n<p>Sections 341, 323 and 324 read with 34 IPC.<\/p>\n<p>      3.    Learned     public       prosecutor         submitted that the<\/p>\n<p>petitioners are required for recovery of weapon and a fracture is<\/p>\n<p>also caused to the defacto complainant and hence, the<\/p>\n<p>application is opposed.\n<\/p>\n<p>      4.    Learned counsel for the petitioners submitted that the<\/p>\n<p>incident happened in front of the house of the first accused. It is<\/p>\n<p>alleged that the defacto complainant was under the influence of<\/p>\n<p>alcohol at the time offence and later, realising the mistake<\/p>\n<p>committed by him, he settled the entire issues and both parties<\/p>\n<p>have come to an amicable settlement. They are maintaining a<\/p>\n<p>good relationship between each other now. Annexure I is an<\/p>\n<p>affidavit sworn to by the defacto complainant and filed before<\/p>\n<p>the Sessions Court, Kasaragod in the bail application filed by<\/p>\n<p>him. It is also submitted that the petitioner is undergoing a<\/p>\n<p><span class=\"hidden_text\">BA NO.3396\/2008                  2<\/span><\/p>\n<p>training at &#8216;TELK&#8217; and in case, he is remanded to custody his<\/p>\n<p>future will be spoiled.\n<\/p>\n<p>     5.    On hearing both sides, I find that anticipatory bail can<\/p>\n<p>be granted. Hence, the following order is passed:<\/p>\n<p>     (i)   The    petitioners   shall  surrender     before     the<\/p>\n<p>Investigating officer within ten days from today and make<\/p>\n<p>themselves available for interrogation and co-operate with the<\/p>\n<p>investigation.\n<\/p>\n<p>     (ii)  The petitioners shall, in the event of their arrest by<\/p>\n<p>the police, be produced before the Magistrate court concerned,<\/p>\n<p>in accordance with law.\n<\/p>\n<p>     (iii) On production of the accused before the Magistrate<\/p>\n<p>court they shall be released on bail on their executing bond for<\/p>\n<p>Rs.25,000\/- each with two solvent sureties each for the like sum<\/p>\n<p>to the satisfaction of the court below on condition that they will<\/p>\n<p>appear before the Investigating officer as and when directed by<\/p>\n<p>him and co-operate with the investigation.<\/p>\n<p>     The petition is allowed.\n<\/p>\n<\/p>\n<p>                                               K.HEMA, JUDGE<br \/>\ncsl<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court K.M.Rakesh vs State Of Kerala on 10 June, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 3396 of 2008() 1.
