materials placed before it, has prima facie found  the<\/p>\n

defendant and also in favour of the  defe11d_eeI:,: ‘ifwa;s  :  <\/p>\n
that the ttansaction was apparently
\ntitle was transferred for    as the
\naiiegation of fraud and  is vvoorieemed, the
\nCourt below has found’  2″‘ defendant is<\/p>\n

8. At thd dstg\u00e9ge of  of the prima facic case and of<\/p>\n
 Afhe  for  temporary injunction, the Court is<\/p>\n
 the intention of the parties as discemable<\/p>\n
  dated 10.05.2006. The sa1d’ document which<\/p>\n
 a  deed appazently conveying absolute right, title<\/p>\n
Vv 0′ arid’  in favour of the purchaser and cannot be<\/p>\n
 as mortgage deed. It is for the p1ai11ti\ufb02’ to establish<\/p>\n
 A E case at the time oftrial and at this stage it has to be stated<\/p>\n

that the plainti\ufb01 has tisiled to make out a prima facie case that
\nthe transaction contained in the sale deed dated 10.05.2006 was<\/p>\n
in fact a mortgage and not a safe.\n<\/p>\n
9. Even the allegations of fraud and <\/p>\n
ievelled against the defendants is not prima facie  _&  <\/p>\n
by producing any acceptable materials;  again  <\/p>\n
for trial and it is for the plainti\ufb01’ to  <\/p>\n
these assertions and a\ufb02egations.<\/p>\n
10. It is true that the   a wrong<\/p>\n
premises   Order X)G{IX Rules 1 as.-.<\/p>\n
2 was forvdan \u00ab.orcier  injunction to restrain the
\ndefendants   the p1a1’nti\ufb01’s possession. In
\nfact   “injt1ncn’on sought is to restrain the
\n and encnmbering the suit property.<\/p>\n
   But  in the order does not further the case of
\n 3  more as even for an order of temporary
\n   restrain the defendants from alienating or<\/p>\n
 _  the property, all the ingredients of establishing a<\/p>\n
   facie case, balance of inconvenience and irreparable<\/p>\n
