No. 289 of 2010\n           ````````````````````````````````````````````````````````````\n              Dated this the 19th day of February, 2010\n\n                             J U D G M E N T\n<\/pre>\n<p>Balakrishnan Nair, J.\n<\/p>\n<\/p>\n<p>           Appellant is the writ petitioner. He claims to be the<\/p>\n<p>registered owner of the vehicle bearing registration No.KL-19-<\/p>\n<p>1323. The vehicle was involved in Crime No.258\/2009 of Neyyar<\/p>\n<p>Dam Police Station, which was registered under sub-sections (1)<\/p>\n<p>and (2) of Section 8 of the Kerala Abkari Act. The allegation was<\/p>\n<p>that the above said vehicle, which is a motor car, was used for<\/p>\n<p>transporting illicit arrack. The vehicle was seized along with the<\/p>\n<p>contraband arrack.          The Deputy Commissioner of Excise,<\/p>\n<p>Thiruvananthapuram has initiated steps to confiscate the vehicle.<\/p>\n<p>Pending confiscation, the appellant moved for release of the<\/p>\n<p>vehicle. The Deputy Commissioner of Excise, the first respondent<\/p>\n<p>herein, issued Ext.P4 communication directing him to remit the<\/p>\n<p>market value of the vehicle as provided under Rule 4(2)(a) of the<\/p>\n<p>Kerala Abkari (Disposal of Confiscated Articles) Rules, 1996. In<\/p>\n<p>the above background, the writ petition is filed seeking the<\/p>\n<p>following relief:-\n<\/p>\n<p>WA.289\/2010<br \/>\n<span class=\"hidden_text\">                                  : 2 :<\/span><\/p>\n<p>                  &#8221; Issue a writ of mandamus or any other<\/p>\n<p>           appropriate writ, order or direction commanding<\/p>\n<p>           the 1st respondent to release the vehicle forthwith<\/p>\n<p>           to the petitioner.&#8221;\n<\/p>\n<p>      2.   We notice that Ext.P4 is not under challenge in the writ<\/p>\n<p>petition. Therefore, no relief can be granted to the appellant. The<\/p>\n<p>learned Single Judge dismissed the writ petition.           Hence, this<\/p>\n<p>appeal.\n<\/p>\n<p>      3.   We heard the learned counsel for the appellant. The<\/p>\n<p>Rule under which Ext.P4 is passed reads as follows:-<\/p>\n<p>                   &#8221; R.4(2)(a).       The  cart,   vessel  or<\/p>\n<p>           other conveyance liable to be confiscated under<\/p>\n<p>           the Act may be released temporarily by the<\/p>\n<p>           authorised officer to its owner on depositing an<\/p>\n<p>           amount equivalent to the market value of the<\/p>\n<p>           cart, vessel or other conveyance, fixed by the<\/p>\n<p>           Mechanical Engineer of the Excise Department<\/p>\n<p>           or any Mechanical Engineer of and above the<\/p>\n<p>           rank of an Assistant Executive Engineer of the<\/p>\n<p>           Public Works Department of the State in the<\/p>\n<p>           Treasury Savings Account in favour of the<\/p>\n<p>           Commissioner of Excise.&#8221;\n<\/p>\n<p>      4.   The order of the first respondent is strictly in conformity<\/p>\n<p>WA.289\/2010<br \/>\n<span class=\"hidden_text\">                                  : 3 :<\/span><\/p>\n<p>with the above Rule. This Court can issue a writ of mandamus as<\/p>\n<p>prayed for if the first respondent owes a duty to release the vehicle<\/p>\n<p>unconditionally and the appellant has got a legal right to the<\/p>\n<p>performance of that duty. The appellant has failed to show any<\/p>\n<p>such duty in the first respondent or corresponding right in the<\/p>\n<p>appellant. Therefore, the writ petition itself was not maintainable.<\/p>\n<p>So, we find no reason to interfere with the judgment under appeal.<\/p>\n<p>The writ appeal is accordingly dismissed.
