HARI RANI,JJ\n\n        ==============================\n\n                  W.P.(CRL) NO. 243 OF 2010\n\n         ============================\n\n       DATED THIS THE 29TH DAY OF JUNE 2010\n\n                          JUDGMENT\n<\/pre>\n<p>Basant,J.\n<\/p>\n<p>      The petitioner has come to this Court with this petition for<\/p>\n<p>issue of a writ of habeas corpus to search for, trace and produce<\/p>\n<p>Monisha, a 21 year old adult major woman (date of birth &#8211;<\/p>\n<p>6\/1\/1989).   According to the petitioner, the alleged detenue<\/p>\n<p>Monisha was an employee of hers in a Textile shop run by her<\/p>\n<p>and her husband. The father of Monisha expired on 20th April<\/p>\n<p>2010. He was also an employee of the petitioner&#8217;s husband. The<\/p>\n<p>relationship between the alleged detenue Monisha and her<\/p>\n<p>father towards the petitioner and her husband was much more<\/p>\n<p>than that of employees and employer. Monisha was living like a<\/p>\n<p>member of the family of the petitioner. At the time of death of<\/p>\n<p>her   deceased father, he had wanted the petitioner and her<\/p>\n<p>husband to look after the alleged detenue Monisha. Monisha has<\/p>\n<p>some ailments. She was suffering from T.B. Later she has some<\/p>\n<p>further ailments consequent to the treatment taken. Even when<\/p>\n<p>the father was alive, Monisha was residing in the house of the<\/p>\n<p><span class=\"hidden_text\">WPCRL.243\/2010                   -2-<\/span><\/p>\n<p>petitioner and her husband along with their three children. The<\/p>\n<p>eldest of the three children is aged about 10 years. According to<\/p>\n<p>the petitioner, the alleged detenue was being detained by the 4th<\/p>\n<p>respondent, who is the brother of the deceased father of the<\/p>\n<p>alleged detenue. He resides along with his wife and the mother<\/p>\n<p>of the alleged detenue. He is looking after the mother of the<\/p>\n<p>alleged detenue. They are not allowing the alleged detenue to<\/p>\n<p>attend the shop of the petitioner. They are forcibly holding her<\/p>\n<p>back. The alleged detenue is aggrieved by such illegal restraint<\/p>\n<p>placed on her. She has been writing letters to the petitioner to<\/p>\n<p>save her from what she described to be illegal detention and<\/p>\n<p>custody. It is in these circumstances that the petitioner came to<\/p>\n<p>this Court with this petition for issue of a writ of habeas corpus.<\/p>\n<p>      2. This petition was filed on 23\/6\/2010. It was admitted on<\/p>\n<p>24\/6\/2010 and the case was posted to this date for appearance<\/p>\n<p>of the parties.\n<\/p>\n<p>      3. Today when the case is called, the petitioner has come<\/p>\n<p>to court along with her husband.         She is represented by a<\/p>\n<p>counsel. The alleged detenue has come to court along with her<\/p>\n<p>mother and the 4th respondent.\n<\/p>\n<p><span class=\"hidden_text\">WPCRL.243\/2010                 -3-<\/span><\/p>\n<p>     4. As the alleged detenue came to court along with\/in the<\/p>\n<p>custody of the 4th respondent, who is allegedly detaining her, we<\/p>\n<p>permitted the alleged detenue to remain alone in the Chamber<\/p>\n<p>before we ascertained and recorded her response. In court, she<\/p>\n<p>stated before us that she wants to speak to the petitioner.<\/p>\n<p>Accordingly, she, an adult major woman, aged about 21 years,<\/p>\n<p>was permitted to interact with the petitioner.<\/p>\n<p>     5. After the lunch recess, we interacted with the alleged<\/p>\n<p>detenue.   We interacted with her alone initially.     Later, we<\/p>\n<p>interacted with her in the presence of her mother and the 4th<\/p>\n<p>respondent. The sister of the alleged detenue was also present.<\/p>\n<p>Subsequently, we interacted with the alleged detenue in the<\/p>\n<p>presence of the petitioner and her husband. Their three children<\/p>\n<p>were also present. Learned counsel for the petitioner was also<\/p>\n<p>present. The learned counsel for the 4th respondent, the learned<\/p>\n<p>counsel for the petitioner   as also    the learned Government<\/p>\n<p>Pleader were present in the course of such interactions.<\/p>\n<p>     6. The alleged detenue states categorically that she does<\/p>\n<p>not want to return along with her mother and the 4th respondent.<\/p>\n<p>She wants to return along with the petitioner. According to her,<\/p>\n<p>she is now not permitted to continue her employment and she<\/p>\n<p><span class=\"hidden_text\">WPCRL.243\/2010                 -4-<\/span><\/p>\n<p>very much wants to continue the employment. She wants to<\/p>\n<p>reside with the petitioner. Even when her father was alive, she<\/p>\n<p>was so permitted to reside along with the petitioner. She wants<\/p>\n<p>to continue such residence with the petitioner.<\/p>\n<p>     7. The grievance of the alleged detenue is that she is being<\/p>\n<p>asked   to enter matrimony.      Because of her illness, she is<\/p>\n<p>reluctant and unable to agree to a marriage now. She does not<\/p>\n<p>want to get married now.      Because of the insistence of her<\/p>\n<p>mother and the 4th respondent that she should get married and<\/p>\n<p>because of their      conduct of not allowing her to go for<\/p>\n<p>employment and reside with the petitioner, she does not now<\/p>\n<p>want to return along with the mother and the 4th respondent.<\/p>\n<p>She may be permitted to go with the petitioner, continue her<\/p>\n<p>employment and reside with the petitioner, she prays.<\/p>\n<p>     8. The petitioner and her husband state that they are<\/p>\n<p>willing to look after the alleged detenue.    The father of the<\/p>\n<p>alleged detenue was an employee of theirs. He had entrusted<\/p>\n<p>the alleged detenue to them to give necessary protection and<\/p>\n<p>patronage to her. They are willing to do the same. She was<\/p>\n<p>actually residing with them.  She was being properly attended<\/p>\n<p>to and medicines      were being taken by her promptly and<\/p>\n<p><span class=\"hidden_text\">WPCRL.243\/2010                 -5-<\/span><\/p>\n<p>properly.     The petitioner and her husband state that<\/p>\n<p>notwithstanding the present reluctance of the alleged detenue to<\/p>\n<p>enter matrimony,     they   hope to persuade her later to get<\/p>\n<p>married. That may take some time and the apprehensions of the<\/p>\n<p>alleged detenue will have to be allayed.  The petitioner and her<\/p>\n<p>husband agree that, if necessary, they shall meet all expenses of<\/p>\n<p>the marriage of the alleged detenue. They also agree that they<\/p>\n<p>shall complete construction of a house for the alleged detenue,<\/p>\n<p>her mother and siblings, if they are permitted,     at their own<\/p>\n<p>costs.\n<\/p>\n<p>     9. We have considered all the relevant inputs.           We<\/p>\n<p>specifically queried when we interacted with the mother of the<\/p>\n<p>alleged detenue and the 4th respondent whether the petitioner<\/p>\n<p>and her husband has any improper\/illegal\/immoral purposes in<\/p>\n<p>their offer to take the alleged detenue with them.       We are<\/p>\n<p>informed that there is no such dimension to the problem at all.<\/p>\n<p><span class=\"hidden_text\">WPCRL.243\/2010                     -6-<\/span><\/p>\n<p>      10. In a petition for issue of a writ of habeas corpus, we<\/p>\n<p>need only consider whether the alleged detenue is under any<\/p>\n<p>illegal confinement or detention. More particularly, we have to<\/p>\n<p>ascertain whether the free will of the alleged detenue is being<\/p>\n<p>impeded.\n<\/p>\n<p>      11. We are convinced that the alleged detenue wants to go<\/p>\n<p>with the petitioner. No objection is taken by the mother of the<\/p>\n<p>alleged detenue or the 4th respondent as to why the alleged<\/p>\n<p>detenue should not be permitted to go with the petitioner with<\/p>\n<p>whom her father had entrusted her prior to his death. We are<\/p>\n<p>satisfied that the alleged detenue, (we repeat, an adult major<\/p>\n<p>woman,aged about 21 years) wants to go along with the<\/p>\n<p>petitioner.\n<\/p>\n<p>      12. In the result,<\/p>\n<p>      a) this writ petition is allowed.\n<\/p>\n<p>     b)We have informed the alleged detenue Monisha<\/p>\n<p>     that she is free to go wherever she wants.<\/p>\n<pre>\n\n      c)We respect the wishes         of the alleged detenue\n\n      Monisha that     she wants to go along with the\n\n<\/pre>\n<p>      petitioner and her husband and accordingly she<\/p>\n<p>      leaves the court along with them.\n<\/p>\n<p><span class=\"hidden_text\">WPCRL.243\/2010                   -7-<\/span><\/p>\n<p>     13. We record the submission of the petitioner and her<\/p>\n<p>husband that the mother or the siblings of the alleged detenue as<\/p>\n<p>also the 4th respondent can, at any time they want, go and meet<\/p>\n<p>the alleged detenue at the shop or the house of the petitioner.<\/p>\n<p>Similarly, we are assured that the alleged detenue shall be at<\/p>\n<p>liberty to visit her mother, the 4th respondent and other relatives<\/p>\n<p>at the house of the 4th respondent at any time that she wants.<\/p>\n<p>                                        R.
