Respondents.\n\n\nPRAYER\n\nPetition filed under Article 226 of the Constitution of India, praying\nfor a Writ of Certiorari, to call for the records of the second respondent in\nLetter No.AO\/R\/HTS\/F.Peak Hr.Quota\/D.263\/2009, dated 7.11.2009, signed on\n21.11.2009, and quash the same in so far a it relates to levy of penalty for\nexceeding quota during evening peak hours as illegal, arbitrary, without\nauthority of law and against the order of the 3rd respondent made in\nMiscellaneous Petition No.42 of 2008, dated 28.11.2008 and consequently,\nrestrain the 1st and 2nd respondents from levying\/demand\/collecting penalty\ncharges for the consumption of demand and energy over and above th quota during\nevening peak hour as demanded in Lr.No.AO\/R\/HTS\/F.Peak Hr.Quota\/D.263\/2009,\ndated 7.11.2009, signed on 21.11.2009, in respect of the petitioner's Service\nconnection HTSC No.180 at Kovilpatti, Tamil Nadu Electricity Board, Tirunelveli\nElectricity Distribution Circle.\n\n!For Petitioner    ... Mr.M.Suresh Kumar (TNEB) (R1 &amp; R2)\n\t\t       No Appearance (R3)\n\n:ORDER\n<\/pre>\n<p>\tHeard the learned counsels appearing on behalf of the parties concerned.\n<\/p>\n<p>\t2. Even though various averments have been made and many grounds had been<br \/>\nraised in the affidavit filed in support of the writ petition, the main<br \/>\ngrievance of the petitioner is that the impugned demand notice\/bill in respect<br \/>\nof the peak hour penalty has been issued by the second respondent, without due<br \/>\nnotice being given to the petitioner and without affording sufficient<br \/>\nopportunity of hearing to the petitioner.\n<\/p>\n<p>\t3. The learned counsel appearing on behalf of the petitioner has stated<br \/>\nthat the second respondent has no authority, under the relevant provisions of<br \/>\nthe law, to levy the penalty, without the prior approval of the Tamil Nadu<br \/>\nElectricity Regulatory Commission, which is the competent statutory authority,<br \/>\nestablished in accordance with the Electricity Act, 2003.\n<\/p>\n<p>\t4. It has been further stated that the second respondent had failed to<br \/>\nfollow the procedures laid down, under paragraph No.33 of the order, made in<br \/>\nM.P.No.42 of 2008, dated 28.11.2008, issued by the Tamil Nadu Electricity<br \/>\nRegulatory Commission. Therefore, the impugned demand notice\/bill issued by the<br \/>\nsecond respondent is liable to be set aside.\n<\/p>\n<p>\t5. Mr.M.Suresh Kumar the learned counsel, appearing on behalf of the first<br \/>\nand the second respondents, had not refuted the claims made by the learned<br \/>\ncounsel appearing on behalf of the petitioner. However, he had submitted that if<br \/>\nthis Court deems it fit to set aside the impugned demand notice\/bill of the<br \/>\nsecond respondent, liberty may be granted to the second respondent to pass<br \/>\nappropriate orders, afresh, after due notice is issued to the petitioner.\n<\/p>\n<p>\t6. In view of the submissions made by the learned counsels appearing for<br \/>\nthe petitioner, as well as the respondents, and in view of the orders passed by<br \/>\nthis Court, in a number of writ petitions, wherein similar issues have been<br \/>\nraised, the impugned demand notice\/bill, issued by the second respondent, is set<br \/>\naside. However, it would be open to the second respondent to pass appropriate<br \/>\norders, afresh, including the issuing of the appropriate demand notice\/bill,<br \/>\nafter giving due notice and after affording sufficient opportunity of hearing to<br \/>\nthe petitioner.\n<\/p>\n<p>\t7. After due notice is issued by the second respondent, the petitioner<br \/>\nwould be at liberty to challenge the same, if it is found necessary to do so, by<br \/>\nraising all the grounds available to the petitioner, including those which have<br \/>\nbeen raised in this writ petition. It would also be open to the petitioner to<br \/>\nraise the ground that the second respondent has no authority to levy the<br \/>\npenalty, on the ground that it is against the dictum laid down by the Tamil Nadu<br \/>\nRegulatory Commission, in M.P.No.42 of 2008, dated 28.11.2008.\n<\/p>\n<p>\t8. In case the petitioner had already paid the bill amount it would be<br \/>\nadjusted to the amounts that may be claimed by the Tamilnadu Electricity Board,<br \/>\nin the future bills relating to the petitioner, in case the final decision is in<br \/>\nfavour of the petitioner. The petitioner shall fully cooperate by participating<br \/>\nin the inquiry or hearing that may be held by the concerned authorities of the<br \/>\nrespondent Electricity Board.\n<\/p>\n<p>\t\tThe writ petition is ordered accordingly.
