The appellants are employees of the respondent-Mint and<br \/>\nare also in occupation of the official quarters.  They filed<br \/>\na  claim  under Section 33-C(2) of the\tIndustrial  Disputes<br \/>\nAct,  1947  before the labour court  for  calculating  their<br \/>\novertime  wages on the basis of their basic wages  plus\t the<br \/>\nhouse rent allowance to which, according to them, they\twere<br \/>\nentitled.   Their  contention  was that even  if  they\twere<br \/>\noccupying the official accommodation, since under the  rules<br \/>\nthey were entitled to house rent allowance when no  official<br \/>\naccommodation was given to them, under Section 59(2) of\t the<br \/>\nFactories  Act the overtime wages payable to them should  be<br \/>\ncalculated   taking  into  consideration  the\thouse\trent<br \/>\nallowance   as\twell.\tThe  labour  court  accepted   their<br \/>\ncontention  and granted the appellants&#8217; claim.\tHowever,  in<br \/>\nwrit petition filed by the respondents, the High Court\theld<br \/>\nthat  since  the  appellants  were  occupying  the  official<br \/>\naccommodation,<br \/>\n<span class=\"hidden_text\">149<\/span><br \/>\nthey  were  not entitled to the payment of  the\t house\trent<br \/>\nallowance  within  the\tmeaning\t of  Section  59(2)  of\t the<br \/>\nFactories  Act.\t  Hence the said allowance could not  to  be<br \/>\ntaken into consideration for calculating the overtime  wage.<br \/>\nIn  this  view of the matter, the High Court set  aside\t the<br \/>\norder of the labour court and allowed the writ petition.  It<br \/>\nis this order which is challenged before us.\n<\/p>\n<p>\t      2.    Section 59(2) of the Factories Act reads<br \/>\n\t      as follows<br \/>\n\t      &#8220;59.  Extra wages for overtime.- (1) &#8230;.<br \/>\n\t      (2)For  the  purposes of sub-section  (  1)<br \/>\n\t\t\t    &#8216;ordinary rate of wages&#8217; means the basic  wage<br \/>\ns<br \/>\n\t      plus  such  allowances,  including  the\tcash<br \/>\n\t      equivalent  of the advantage accruing  through<br \/>\n\t      the concessional sale to workers of foodgrains<br \/>\n\t      and  other articles, as the worker is for\t the<br \/>\n\t      time being entitled to, but does not include a<br \/>\n\t      bonus and wages for overtime work.&#8221;\n<\/p>\n<p>The  language of this section is very clear.  It  says\tthat<br \/>\nthe  ordinary  rate of wages which is referred\tto  in\tsub-<br \/>\nsection\t (1)  of  Section 59 means  basic  wages  plus\tsuch<br \/>\nallowance  &#8230; as the worker is for the time being  entitled<br \/>\nto, but excludes bonus and wages for overtime work.\n<\/p>\n<p>3.Admittedly,  the  appellants are not\tentitled  to  the<br \/>\npayment of the house rent allowance since they are occupying<br \/>\nthe  official quarters.\t Hence for calculating the  overtime<br \/>\nwages,\tthe  house  rent  allowance  cannot  be\t taken\tinto<br \/>\naccount.  What Section 59(2) contemplates is the eligibility<br \/>\nto  the\t payment of the house rent allowance.\tThe  service<br \/>\nconditions  envisage  employees\t who are  and  who  are\t not<br \/>\nprovided  with\tthe official accommodation and\tprovide\t for<br \/>\nhouse rent allowance only to those who are not provided with<br \/>\nthe  accommodation.   The  mere fact,  therefore,  that\t the<br \/>\nservice\t rules\tprovide\t for house rent\t allowance  when  no<br \/>\naccommodation  is given, will not entitle the  employees  to<br \/>\nsucceed\t in  their  present claim.   The  labour  court\t had<br \/>\nobviously erred in holding otherwise.  We are, therefore, in<br \/>\nagreement with the view taken by the High Court.\n<\/p>\n<p>4.   In this view of the matter, we dismiss the appeal\twith<br \/>\nno  order  as  to costs.
