BASANT, J.\n\n                        - - - - - - - - - - - - - - - - - - - - - -\n\n                         Crl.M.C.No.  2453  of   2007\n\n                        - - - - - - - - - - - - - - - - - - - - - -\n\n                 Dated this the  1st   day of   August, 2007\n\n\n                                     O R D E R\n<\/pre>\n<p>        The  petitioner faces indictment  in a prosecution under Section<\/p>\n<p>138 of the N.I. Act.  Cognizance has been taken.  The petitioner had<\/p>\n<p>entered   appearance.     He   was   released   on   bail   on   8.1.07.     The<\/p>\n<p>petitioner was   later absent.   The application to condone the absence<\/p>\n<p>was  dismissed.    A non-bailable  warrant  has  been  issued   against  the<\/p>\n<p>petitioner.   The   petitioner   now   finds   such   warrant   of   arrest   chasing<\/p>\n<p>him.\n<\/p>\n<\/p>\n<p>        2.   According to the petitioner he is absolutely innocent.   His<\/p>\n<p>failure\/omission   to   appear   earlier   was   not   wilful,   but   was   due   to<\/p>\n<p>reasons   beyond   his   control.     He   is   willing   to   surrender   before   the<\/p>\n<p>learned Magistrate and seek bail.  He shall co-operate with the Court<\/p>\n<p>for the expeditious disposal of the case.   But he apprehends that his<\/p>\n<p>application for bail may not be considered  by the learned Magistrate<\/p>\n<p>on   merits,   in   accordance   with   law   and   expeditiously.       In     these<\/p>\n<p>circumstances it is   prayed   that appropriate directions may be issued<\/p>\n<p>to the learned Magistrate to release the petitioner on bail on the date<\/p>\n<p>of surrender itself.\n<\/p>\n<p>\nCrl.M.C.No.  2453  of   2007<\/p>\n<p><span class=\"hidden_text\">                                                      2<\/span><\/p>\n<p>           3.       It   is     certainly   for   the   petitioner   to     appear   before   the   learned<\/p>\n<p>Magistrate and   explain to the learned Magistrate the circumstances  under<\/p>\n<p>which he could not earlier appear before the learned Magistrate.  I have no<\/p>\n<p>reason   to   assume   that   the   learned   Magistrate   would   not   consider   the<\/p>\n<p>application for bail to be filed by the petitioner when he surrenders before<\/p>\n<p>the   learned   Magistrate,   on   merits,   in   accordance   with   law     and<\/p>\n<p>expeditiously.     Every   court   must   do   the   same.     No   special   or   specific<\/p>\n<p>direction   appears   to   be   necessary.     Sufficient   general   directions   have<\/p>\n<p>already   been   issued   by   this   Court   in   the   decision   in  <a href=\"\/doc\/147290035\/\">Alice   George    v.<\/p>\n<p>Dy.S.P. of Police<\/a>  (2003 (1) KLT 339).\n<\/p>\n<\/p>\n<p>           4.  This application  is accordingly dismissed.   I may however hasten<\/p>\n<p>to  observe  that if the petitioner appears before the learned Magistrate and<\/p>\n<p>applies  for  bail  after  giving  sufficient  prior  notice to  the  Prosecutor  in<\/p>\n<p>charge of the case,   the  learned Magistrate must  proceed to pass orders on<\/p>\n<p>merits, in accordance with law and expeditiously &#8211; on the date of surrender<\/p>\n<p>itself.\n<\/p>\n<\/p>\n<p>                                                                     (R.
