District<br \/>\nJudge, Rajkot in Regular Civil Appeal No. 8\/2001.\n<\/p>\n<p>2.\tHeard<br \/>\nlearned advocate Ms. Vinita Vinayak for M\/s. Thakkar Associates for<br \/>\nthe appellants and learned counsel Mr. R.M. Chhaya for respondent No.<br \/>\n1, original defendant.\n<\/p>\n<p>3.\tPursuant<br \/>\nto the notice issued, learned counsel Mr. Chhaya has submitted that<br \/>\nrespondent No.1-Rajkot Municipal Corporation has evolved a scheme<br \/>\nwith regard to providing space in the hawking plots to enable persons<br \/>\nlike appellant Nos. 1 to 3 to earn their livelihood as a social<br \/>\nmeasure.\n<\/p>\n<p>4.\tLearned<br \/>\nCounsel Mr. Chhaya has also stated that earlier the High Court in<br \/>\nSecond Appeal No. 61 of 2010 has passed an order dated 29.3.2010 in<br \/>\nan identical situation and the same order could be passed when the<br \/>\nCorporation is willing to give space in the hawking plots as per the<br \/>\nscheme evolved by the Corporation in the city of Rajkot.\n<\/p>\n<p>5.\tHowever,<br \/>\nhe has clarified that this is subject to completing the formalities<br \/>\nand procedure as well as the conditions of the scheme for which<br \/>\nnecessary application may be made by appellant Nos. 1 to 3.  He<br \/>\nsubmitted that it may be clarified that this would be applicable and<br \/>\nconfined to appellant Nos. 1 to 3 only and appellant No. 4 has died.\n<\/p>\n<p>6.\tLearned<br \/>\nadvocate Ms. Vinayak for the appellants has no objection. She has<br \/>\nstated that her clients, appellant Nos. 1 to 3, would complete the<br \/>\nnecessary formalities and comply with the requirements for allotment<br \/>\nof such space in the hawking plots subject to fulfillment of the<br \/>\nconditions.\n<\/p>\n<p>7.\tLearned<br \/>\nadvocate Ms. Vinayak has stated that the cabin\/stall in question is<br \/>\nin the public street and the appellants-original plaintiffs shall<br \/>\nhand over vacant and peaceful possession of the said cabin\/stall<br \/>\noccupied by them within a period of 15 days.  She has also stated<br \/>\nthat handing over peaceful and vacant possession of the cabin\/stall<br \/>\nin question is without waiting for the alternative space being<br \/>\nallotted in the hawking plots. She has also stated that the<br \/>\nappellants shall submit the formal application to the Corporation for<br \/>\nallotment of the space in the hawking plots which will be considered<br \/>\nas stated above.\n<\/p>\n<p>8.\tThe<br \/>\nlearned advocates appearing on behalf of the parties have requested<br \/>\nto dispose of this second appeal in terms of the above statement.\n<\/p>\n<p>9.\tIn<br \/>\nview of the above understanding arrived at, the present appeal hereby<br \/>\nstands disposed of.  The appellant Nos. 1 to 3, original plaintiffs,<br \/>\nare directed to act as per the statement made by learned advocate Ms.<br \/>\nVinayak for the appellants and shall make necessary application as<br \/>\nrequired under the scheme  and shall also comply with the terms and<br \/>\nconditions of the scheme subject to which space in the hawking plots<br \/>\ncould be allotted to them.  If such application is made within 10<br \/>\ndays, the same will be considered by the respondent No.1 corporation<br \/>\nwithin a period of one month thereafter.\n<\/p>\n<p>10.\tIt<br \/>\nwill be open for the respondent Corporation to seek any further<br \/>\nclarification for the purpose of such allotment of space in the<br \/>\nhawking plots and the entire exercise would be completed as early as<br \/>\npossible.  However, it is made clear that the allotment of the<br \/>\naforesaid space in the hawking plots to appellant Nos. 1 to 3 is made<br \/>\nin the facts and circumstances without prejudice to the rights and<br \/>\nalso without being cited as a precedent.\n<\/p>\n<p>11.\tIn<br \/>\nview of the above, the present second appeal stands disposed of.   No<br \/>\norder as to costs.\n<\/p>\n<p>(Rajesh<br \/>\nH.
