Justice V.GIRI\n\n Dated :20\/07\/2009\n\n O R D E R\n                             V.GIRI,J.\n                      -------------------------\n                 W.P ( C) No.20364 of 2009\n                      --------------------------\n                Dated this the 20th July,2009\n\n                        J U D G M E N T\n<\/pre>\n<p>      Petitioners are prosecuting the 2nd semester in the<\/p>\n<p>Master of Business Administration (M.B.A) in the 3rd<\/p>\n<p>respondent institution. The stand taken by the University<\/p>\n<p>is that   the qualifying examination          acquired by the<\/p>\n<p>petitioners is not recognized by the University. This was<\/p>\n<p>considered by this Court in Exts.P1 and P2 judgments<\/p>\n<p>and the Vice Chancellor was directed to take a decision,<\/p>\n<p>as directed hereunder.    Paragraph 13 of Ext.P1 judgment<\/p>\n<p>reads as follows:\n<\/p>\n<blockquote><p>           &#8220;Accordingly, there will be a direction to<br \/>\n     the Vice Chancellor of the 3rd respondent,<br \/>\n     University, to consider whether the BTS degree<br \/>\n     offered by the M.G University, to the students<br \/>\n     who attend the Off-campus centres including<br \/>\n     the petitioners&#8217; herein, can be treated as<br \/>\n     equivalent to the BTS Degree offered by the<br \/>\n     M.G University to regular students.             Vice<br \/>\n     Chancellor shall take a decision in this regard,<br \/>\n     after   hearing   a    representative      of    the<br \/>\n     petitioners&#8217; and with reference to Ext.P6 in WP<br \/>\n     (C) No.26515\/2008. Vice chancellor may take<br \/>\n     such a decision after consultation with the Dean<\/p>\n<p>W.P ( C) No.20364 of 2009<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>     and the Board of studies. Such decision shall be<br \/>\n     taken within two months from the date of receipt<br \/>\n     of a copy of this judgment.     It is open to the<br \/>\n     petitioners to place materials before the Vice<br \/>\n     Chancellor in substantiation of their contention.<br \/>\n     Interim orders passed by this court shall continue<br \/>\n     to operate till a decision is taken by the Vice<br \/>\n     Chancellor.&#8221;<\/p><\/blockquote>\n<p>      2.    Petitioners&#8217; are aggrieved by their inability to<\/p>\n<p>take second semester MBA Examination.<\/p>\n<p>      3.    Heard    learned  standing     counsel   for  the<\/p>\n<p>University also.\n<\/p>\n<p>      4.    The question of recommendation of recognising<\/p>\n<p>the qualifying examination passed by the petitioners, is<\/p>\n<p>pending     decision by the Vice Chancellor, as already<\/p>\n<p>directed by this Court in Exts.P1 and P2.<\/p>\n<p>      5.    Therefore, the petitioners may be permitted to<\/p>\n<p>attend the 2nd semester examination on a provisional basis.<\/p>\n<p>They shall be issued with hall tickets, if not already issued.<\/p>\n<p>At any rate, they shall be permitted to attend the 2nd<\/p>\n<p>Semester MBA Examination. The results of the petitioners&#8217;<\/p>\n<p>participation shall be published only after the Vice<\/p>\n<p>Chancellor takes a decision as already directed in Exts.P1<\/p>\n<p>W.P ( C) No.20364 of 2009<br \/>\n<span class=\"hidden_text\">                                 3<\/span><\/p>\n<p>and P2 and subject to the decision to be taken by the Vice<\/p>\n<p>Chancellor.    It is further made clear that petitioners&#8217;<\/p>\n<p>participation in the examination as permitted herein will<\/p>\n<p>not be treated as consequent to any opinion expressed by<\/p>\n<p>this Court.
