Justice P.N.RAVINDRAN\n\n Dated :11\/06\/2010\n\n O R D E R\n            J.Chelameswar, CJ. &amp; P.N.Ravindran, J.\n           - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n                        W.A.No.945 OF 2010\n           - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n               Dated this the 11th day of June, 2010\n\n                              JUDGMENT\n<\/pre>\n<p>J.Chelameswar, CJ.\n<\/p>\n<p>       This is an appeal preferred by the State of Kerala who<\/p>\n<p>was the first respondent in W.P.(C)No.13426 of 2010.                The<\/p>\n<p>above mentioned writ petition was filed by a person whose<\/p>\n<p>younger brother admittedly died in police custody on the night<\/p>\n<p>of 29th March, 2010. The said deceased (one Sampath) was<\/p>\n<p>admittedly taken into custody by the Tamil Nadu Police on<\/p>\n<p>28.3.2010 at Coimbatore from the house of his sister.<\/p>\n<p>Subsequently, the above mentioned Sampath died while he<\/p>\n<p>still continued to be in police custody. It may not be necessary<\/p>\n<p>for us to go into the full factual matrix which culminated in the<\/p>\n<p>death of the above mentioned Sampath. The fact on record<\/p>\n<p>remains that the death of Sampath created a great deal of<\/p>\n<p>concern. A criminal case in this regard was registered. The<\/p>\n<p>investigation is entrusted to a special team which headed by<\/p>\n<p>the fourth appellant herein. Admittedly, the investigating team<\/p>\n<p>WA No.945\/2010<br \/>\n<span class=\"hidden_text\">                               -:2:-<\/span><\/p>\n<p>prima facie opined that 14 of the police personnel of the Kerala<\/p>\n<p>Police are involved in the offence which resulted in the death of<\/p>\n<p>the above mentioned Sampath.\n<\/p>\n<p>           2. Complaining that the investigation is not impartial<\/p>\n<p>and police officers at a higher level than the 14 above<\/p>\n<p>mentioned police personnel suspected are also involved in the<\/p>\n<p>perpetration of the crime which led to the death of Sampath,<\/p>\n<p>the instant writ petition came to be filed praying that the<\/p>\n<p>investigation be entrusted to what is popularly known as C.B.I,<\/p>\n<p>an investigating body functioning under the Delhi Special Police<\/p>\n<p>Establishment Act, 1946. By the judgment under appeal, the<\/p>\n<p>writ petition is disposed of with certain directions including a<\/p>\n<p>direction   to  entrust    the   investigation  of   the   Crime<\/p>\n<p>No.259\/CR\/HHW-II\/EKM\/2010 to the C.B.I.           The operative<\/p>\n<p>portion of the judgment under appeal reads as follows:<\/p>\n<blockquote><p>        &#8220;(a) The investigation of the Sampath murder<br \/>\n            case (Crime No.251 of 2010) of Town North<br \/>\n            Police Station, Palakkad and re-registered as<br \/>\n            CB CID Crime No.259\/CR\/HHW-II\/EKM\/2010<br \/>\n            shall be transferred to the C.B.I. for a<br \/>\n            detailed,    impartial      and    meaningful<br \/>\n            investigation.<\/p><\/blockquote>\n<p>        (b) The investigation files of the above case shall<br \/>\n            be     immediately      handed     over     to<br \/>\n            Superintendent     of   Police  (SPE,   C.B.I.,<\/p>\n<p>WA No.945\/2010<br \/>\n<span class=\"hidden_text\">                              -:3:-<\/span><\/p>\n<p>           Thiruvananthapuram       Branch)   who    shall<br \/>\n           entrust the charge of investigation with one<br \/>\n           or more officers of proven record. It shall be<br \/>\n           within the discretion of the C.B.I. to conduct<br \/>\n           a de novo investigation of the case or to<br \/>\n           continue the investigation from the stage<br \/>\n           where the Crime Branch Police had reached.<br \/>\n           Every person directly or indirectly involved in<br \/>\n           the custodial torture of Sampath, howsoever<br \/>\n           high he may be, shall be brought to justice.<\/p>\n<p>      c) The state Government shall extend all<br \/>\n           infrastructural and other facilities to the<br \/>\n           officers of the C.B.I. investigating the above<br \/>\n           case.\n<\/p>\n<p>      d) Entrustment of the investigation of &#8220;Sampath<br \/>\n           murder case&#8221; with the C.B.I. shall not in any<br \/>\n           way affect the proper, meaningful and<br \/>\n           efficient investigation of &#8220;Sheela murder<br \/>\n           case&#8221; and, if need be, the State Government<br \/>\n           may entrust the investigation of that case<br \/>\n           with an officer of unquestionable integrity<br \/>\n           and having the proper investigation skills.&#8221;<\/p>\n<p>The deceased Sampath was taken into custody on the suspicion<\/p>\n<p>that he was involved in the murder of one Sheela who was<\/p>\n<p>murdered on 23.3.2010 at Puthoor in Palakkad District.       It<\/p>\n<p>appears from the judgment under appeal that the above<\/p>\n<p>mentioned Sheela is the sister of a senior officer in the State<\/p>\n<p>Tourism Department. The very fact that a special investigating<\/p>\n<p>team entrusted with the investigation of the crime resulting in<\/p>\n<p>the death of the above mentioned Sampath prima facie opined<\/p>\n<p>WA No.945\/2010<br \/>\n<span class=\"hidden_text\">                               -:4:-<\/span><\/p>\n<p>that 14 of the police personnel of the State of Kerala are<\/p>\n<p>required to be investigated itself in our view establishes that<\/p>\n<p>there was something unusual about the crime, coupled with<\/p>\n<p>the fact that admittedly the deceased Sampath was found to<\/p>\n<p>have suffered 63 ante mortem injuries in his body enhances<\/p>\n<p>the gravity of the crime.\n<\/p>\n<p>          3. There are allegations made by the petitioner that<\/p>\n<p>some of the persons at a higher level either belonging to the<\/p>\n<p>police department or other department of the State possibly<\/p>\n<p>played a role in the inhuman treatment meted out to the<\/p>\n<p>deceased Sampath. At this stage it remains only an allegation.<\/p>\n<p>Whether there is any truth in such allegation or not is a matter<\/p>\n<p>required to be investigated by an impartial body, not only in<\/p>\n<p>the interest of reaching a        just conclusion in the crime<\/p>\n<p>registered against the death of the above mentioned Sampath<\/p>\n<p>but also in the interest of the credibility of the system itself.<\/p>\n<p>The very fact that none of the 14 suspected police personnel of<\/p>\n<p>the   State   of  Kerala   have     been  apprehended    so  far<\/p>\n<p>notwithstanding the fact that the incident occurred more than<\/p>\n<p>two months back only goes to create further doubts regarding<\/p>\n<p>the impartiality of the law enforcement process in so far as the<\/p>\n<p>WA No.945\/2010<br \/>\n<span class=\"hidden_text\">                             -:5:-<\/span><\/p>\n<p>above mentioned crime is concerned.\n<\/p>\n<p>          In the circumstances, we are in total agreement with<\/p>\n<p>the conclusion reached by the learned Judge by the judgment<\/p>\n<p>under appeal directing the investigation of Crime No.<\/p>\n<p>259\/CR\/HHW-II\/EKM\/2010 be entrusted to C.B.I. At any rate,<\/p>\n<p>we do not understand as to how the State of Kerala is an<\/p>\n<p>aggrieved party by the said judgment. It is a different matter<\/p>\n<p>that aggrieved by some of the observations made by the<\/p>\n<p>judgment under appeal individuals aggrieved have already<\/p>\n<p>approached this Court by appeals and those matters have<\/p>\n<p>already admitted . But, we do not see any reason to admit this<\/p>\n<p>appeal at the instance of the State of Kerala.
