No.20988 of 2010\n                                  PRAMOD BHUINYAN\n                                            Versus\n                                 THE STATE OF BIHAR\n                                          -----------\n<\/pre>\n<p>3   27.09.2010.            Heard learned counsel for the parties.<\/p>\n<p>                               Petitioner has been made accused in a case lodged for<\/p>\n<p>                  offence under sections 376,511 and 302 of the I.P.C.<\/p>\n<p>                               The informant states that his sister went to the filed to<\/p>\n<p>                  attend the call of nature. In the meantime, when he heard her cry, he<\/p>\n<p>                  rushed towards bush and found the petitioner running away from the<\/p>\n<p>                  place of occurrence. He saw the neck of his sister cut by sharp<\/p>\n<p>                  cutting weapon. Informant alleges that petitioner tried to rape her<\/p>\n<p>                  but on protest he killed his sister.\n<\/p>\n<p>                               The petitioner submits that though the offence is said to<\/p>\n<p>                  be committed in field but there is no eye witness of the occurrence.<\/p>\n<p>                  Petitioner is in custody since 14.3.2008. Furthermore, no weapon<\/p>\n<p>                  was recovered from him or from near the place of occurrence. Even<\/p>\n<p>                  no blood was found near the PO.\n<\/p>\n<p>                               In view of the facts and circumstances of the case, let<\/p>\n<p>                  the petitioner as above be released on bail on furnishing bail bond of<\/p>\n<p>                  Rs. 5000\/- (five thousand) with two sureties of the like amount each<\/p>\n<p>                  to the satisfaction of the Additional Sessions Judge-cum-F.T.C.No.<\/p>\n<p>                  I, Gaya in Sessions Trial No. 62 of 2010\/251 of 2008.<\/p>\n<p>                               Petitioner would not be absent physically for more than<\/p>\n<p>                  two consecutive dates at a stretch till four witnesses are examined<\/p>\n<p>                  in trial, failing which his bail bond would be cancelled and he would<\/p>\n<p>                  be taken into custody.\n<\/p>\n<\/p>\n<pre>    Shashi.
