Misc. No.15638 of 2011\n                           Ramdeo Sah son of Late Moti Sah\n                                       Versus\n                                 The State Of Bihar\n                                      -----------\n<\/pre>\n<p>3\/   26.07.2011                    Heard learned counsel for the petitioner and the State.<\/p>\n<p>                                   The petitioner seeks bail in a case instituted for the<\/p>\n<p>                      offence under sections 364\/34 of the Indian Penal Code.<\/p>\n<p>                                   Considering that apart from suspicion there is no cogent<\/p>\n<p>                      material against the petitioner and there was earlier land dispute<\/p>\n<p>                      between the parties, let the petitioner, above named, be released on<\/p>\n<p>                      bail on furnishing bail bond of Rs.5,000\/- (five thousand) with two<\/p>\n<p>                      sureties of the like amount each or any other surety to be fixed by<\/p>\n<p>                      the court below to the satisfaction of the Chief Judicial Magistrate,<\/p>\n<p>                      Purnea, in connection with Barhara P.S. Case No.105 of 2010,<\/p>\n<p>                      subject to the conditions (i) That one of the bailors will be a close<\/p>\n<p>                      relative of the petitioner, who will give an affidavit giving<\/p>\n<p>                      genealogy as to how he is related with the petitioner and another<\/p>\n<p>                      bailor shall be Jitan Kumr Sah, son of the petitioner. The bailors will<\/p>\n<p>                      undertake to furnish information to the court about any change in the<\/p>\n<p>                      address of the petitioner, (ii) That the affidavit shall clearly state that<\/p>\n<p>                      the petitioner is not an accused in any other case and, if he is, he<\/p>\n<p>                      shall not be released on bail, (iii) That the bailors shall also state on<\/p>\n<p>                      affidavit that they will inform the court concerned if the petitioner is<\/p>\n<p>                      implicated in any other case of similar nature after his release in the<\/p>\n<p>                      present case and thereafter the court below will be at liberty to<\/p>\n<p>                      initiate the proceeding for cancellation of bail on the ground of<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>       misuse, (iv) That the petitioner will give an undertaking that he will<\/p>\n<p>       receive the police papers on the given date and be present on date<\/p>\n<p>       fixed for charge and if he fails to do so on two given dates and<\/p>\n<p>       delays the trial in any manner, his bail will be liable to be cancelled<\/p>\n<p>       for reasons of misuse, and (v) That the petitioner will be well<\/p>\n<p>       represented on each date and if he fails to do so on two consecutive<\/p>\n<p>       dates, his bail will be liable to be cancelled.\n<\/p>\n<\/p>\n<pre>JA\/-                                             (Anjana Prakash,J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Ramdeo Sah vs The State Of Bihar on 26 July, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.
