Justice ANTONY DOMINIC\n\n Dated :28\/01\/2008\n\n O R D E R\n                      ANTONY DOMINIC, J.\n                     ===============\n                  W.P.(C) NO. 760 OF 2008 M\n               =====================\n\n           Dated this the 28th day of January, 2008\n\n                          J U D G M E N T\n<\/pre>\n<p>       Petitioner is an institution imparting training in D.Pharm<\/p>\n<p>Course. According to the petitioner, there were thirty seats in the<\/p>\n<p>merit quota.     However the respondents had allotted only 9<\/p>\n<p>students and out of which 8 students joined the college and as at<\/p>\n<p>present there are 22 vacancies in the merit quota. Since students<\/p>\n<p>were not allotted to fill up these seats, this writ petition has been<\/p>\n<p>filed praying for directing the 2nd respondent to allot candidates<\/p>\n<p>for admission to the remaining seats in the merit quota for the<\/p>\n<p>year 2007-08.\n<\/p>\n<p>      2.   Learned Government pleader today on instructions<\/p>\n<p>submit that no students are available with the 2nd respondent in<\/p>\n<p>the merit\/wait list to be allotted to the petitioner&#8217;s institution and<\/p>\n<p>that the respondents are not in a position to allot the students to<\/p>\n<p>WPC 760\/08<br \/>\n<span class=\"hidden_text\">                                :2 :<\/span><\/p>\n<p>fill up the remaining 22 vacancies in the merit quota. In the<\/p>\n<p>absence of such students, seats cannot be wasted and therefore<\/p>\n<p>it is only proper that the management is allowed to fill up those<\/p>\n<p>vacant seats.\n<\/p>\n<p>      3.   Accordingly, I direct that in view of the inability of the<\/p>\n<p>2nd respondent to allot students to the remaining 22 seats in the<\/p>\n<p>merit quota, it will be open to the petitioner to fill up those<\/p>\n<p>vacancies. Counsel for the petitioner submits that in order to<\/p>\n<p>issue communications to the candidates, 2nd respondent be<\/p>\n<p>directed to make available a list of candidates, who have<\/p>\n<p>registered with the 2nd respondent for seats in the D.Pharm<\/p>\n<p>Course.\n<\/p>\n<p>      4.   I heard the learned Government pleader also on this<\/p>\n<p>request.\n<\/p>\n<p>      5.   Having regard to the submissions made by both sides,<\/p>\n<p>I direct that on the petitioner making a request in that behalf,<\/p>\n<p>the 2nd respondent shall make available to the petitioner a list of<\/p>\n<p>candidates who have registered with them for allotment of the<\/p>\n<p>WPC 760\/08<br \/>\n<span class=\"hidden_text\">                                :3 :<\/span><\/p>\n<p>aforesaid course this year.
