Justice ANTONY DOMINIC\n\n Dated :12\/01\/2010\n\n O R D E R\n                      ANTONY DOMINIC, J.\n             --------------------------------------------------\n                  W.P.(C) NO.591 OF 2009 (Y)\n             --------------------------------------------------\n           Dated this the 12th day of January, 2010\n\n                          J U D G M E N T\n<\/pre>\n<p>      Petitioner along with others got allotment of toddy shops in<\/p>\n<p>Group No.II of Chirayinkeezhu Excise Range. This writ petition<\/p>\n<p>concerns T.S.No.3 within the aforesaid group.<\/p>\n<p>      2.    According to the petitioner, on 1.12.2009, the 3rd<\/p>\n<p>respondent instructed the petitioner to close down the shop from<\/p>\n<p>that day, due to a clash between the two groups of people in the<\/p>\n<p>neighborhood. It is stated that after two weeks, the petitioner<\/p>\n<p>approached     the 3rd respondent on his instructions when he<\/p>\n<p>opened the shop on 1.1.2010, he was again made to close down<\/p>\n<p>th shop. Petitioner submits that such closure of the shop at the<\/p>\n<p>instance of the 3rd respondent was without any justification and on<\/p>\n<p>this allegation this writ petition was filed praying for declaring<\/p>\n<p>that the petitioner and the other licensees are entitled to conduct<\/p>\n<p>the shop on the strength of Ext.P1 licence. A direction to the<\/p>\n<p>respondents not to interfere with the functioning of the toddy<\/p>\n<p>shop No.3 in Chirayinkeezhu Excise Range in terms of the licence<\/p>\n<p>is also sought for.\n<\/p>\n<p>WPC.No.591 \/09<br \/>\n<span class=\"hidden_text\">                                 :2 :<\/span><\/p>\n<p>     3. In view of the allegations in the writ petition, by order<\/p>\n<p>dated 8.1.2010, the case was adjourned with a direction to the<\/p>\n<p>learned Government Pleader to obtain instruction from the<\/p>\n<p>respondents. Accordingly, the Government Pleader has obtained<\/p>\n<p>instructions and submits that in front of the shop one Sathyan<\/p>\n<p>was murdered         and following this unfortunate incident, there<\/p>\n<p>was a public protest and that it was on account of the said public<\/p>\n<p>protest that the petitioner could not open the shop. It is stated<\/p>\n<p>that the respondents have not instructed the petitioner to close<\/p>\n<p>down the shop.\n<\/p>\n<p>     As according to the respondents they are not responsible<\/p>\n<p>for the closure of the toddy shop in question, no direction as<\/p>\n<p>sought for by the petitioner can be issued.
