The track record of the matter is that the appeal was filed<br \/>\nin the year 2008. The same came to be dismissed for non-removal of<br \/>\noffice objections. Thereafter Misc. Civil Application  No.2859 of<br \/>\n2010 was preferred which was allowed by this Court. Now, there is an<br \/>\napplication for condonation of delay in preferring the appeal.\n<\/p>\n<p>3.<br \/>\n\tThe appellant is a Municipality, which terminated the services of<br \/>\nthe respondent orally. The respondent had earlier made an application<br \/>\nfor regularising his services, which was pending at the time when the<br \/>\ntermination was effected. The respondent, therefore, moved the Labour<br \/>\nCourt with a Reference and the Labour Court by award dated 3.2.2007<br \/>\ndirected reinstatement as well as payment of 25% of backwages.<br \/>\nAggrieved thereby, Special Civil Application No.3667 of 2008 was<br \/>\npreferred which came to be dismissed by order dated 26.2.2008 and<br \/>\nhence, this appeal.\n<\/p>\n<p>4.\tHeard<br \/>\nlearned advocate Mr Gori, who is not able to justify the action of<br \/>\nterminating the services of the respondent orally while the<br \/>\napplication for regularisation was pending. This has weighed with<br \/>\nboth the Courts below. We also find that during pendency of the<br \/>\npetition and this Letters Patent Appeal, there has not been any stay<br \/>\nof the order of the Labour Court. It is an undisputed fact that<br \/>\nreinstatement is not effected to nor are the backwages paid as per<br \/>\nthe order.  The representation\/  application has also not been<br \/>\ndecided upon.\n<\/p>\n<p>5.\tIn<br \/>\nlight of the above factual scenario, we are of the view that even on<br \/>\nmerits the applicant-appellant has no case and condoning the delay<br \/>\nwould only extend the lifeline of the litigation where at the end the<br \/>\nappeal would be dismissed.\n<\/p>\n<p>6.\tIn<br \/>\nlight of the above discussion, we, having found no merits in the<br \/>\nappeal and no merits in the cause for delay, do not condone the delay<br \/>\nand dismiss the application along with Letters Patent Appeal (Stamp)<br \/>\nNo.993 of 2008.\n<\/p>\n<p>\t\t\t\t\t\t\t(A.L.\n<\/p>\n<p>DAVE, J.)\t<\/p>\n<p>\t\t\t\t\t\t\t(M.D.\n<\/p>\n<p>SHAH, J.)<\/p>\n<p>zgs\/-\n<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<blockquote><p>\t\t   Top<\/p>\n<\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Mangrol vs Chandrakant on 26 October, 2010 Author: A.L.Dave,&amp;Nbsp;Honourable Mr.Justice Shah,&amp;Nbsp;
