Nagesh, appearing on behalf of<br \/>\n\tapplicant and learned Assistant Government Pleader Ms.Sachi Mathur,<br \/>\n\tappearing on behalf of Opponent No.1.\n<\/p>\n<p>This<br \/>\n\tCourt has passed an order on 26.10.2010 in Special Civil Application<br \/>\n\tNo.13629 of 2010, Page No.6, quoted as under:-\n<\/p>\n<p> &#8221;\n<\/p>\n<p>\tHeard learned advocate<br \/>\n\tMr. VH Nangesh on behalf of petitioner, learned AGP Mr. Amit Patel<br \/>\n\tappearing for respondent no. 1.\n<\/p>\n<p>\tThe grievance voiced in<br \/>\n\tpresent petition is that petitioner has made approach by detailed<br \/>\n\trepresentation on 18\/9\/2010 to respondent no. 2.  Learned advocate<br \/>\n\tMr. Nangesh submitted that his representation is not examined by<br \/>\n\trespondent no. 2 and it remained as it is. The vehicle in question<br \/>\n\tis already attached by respondent no. 2 and not released in favour<br \/>\n\tof petitioner when petitioner is prepared to pay due amount without<br \/>\n\tcharges to respondent no. 2.\n<\/p>\n<p>\tIn light of this facts,<br \/>\n\tit is directed to respondent no. 2 Manager, SREI, BNP PARIBESH, to<br \/>\n\tdecide representation made by petitioner dated 18\/9\/2010 page 19<br \/>\n\tAnnexure C and examine grievance of petitioner and then to pass<br \/>\n\tappropriate reasoned order as early as possible within a period of<br \/>\n\tfifteen days from date of receiving copy of present order.\n<\/p>\n<p>\tIn view of above<br \/>\n\tobservation and direction, present petition is disposed of by this<br \/>\n\tCourt without expressing any opinion on merits. Direct service is<br \/>\n\tpermitted.&#8221;\n<\/p>\n<p>Prayer<br \/>\n\tmade in this application in Para-9(A) to direct other-side to comply<br \/>\n\torder passed by this Court as referred above. Once Special Civil<br \/>\n\tApplication is disposed of finally by this Court, issue direction<br \/>\n\tagainst the respondents and if that direction is not comply by<br \/>\n\tother- side then it is open for the applicant to file appropriate<br \/>\n\tproceedings under provision of Contempt of Court and such kind of<br \/>\n\tMisc. Civil Application is not maintainable or if in action of the<br \/>\n\trespondents not complying direction then also it can consider to be<br \/>\n\ta fresh cause of action for that applicant can take appropriate<br \/>\n\tsteps in challenging such in action by separate proceedings.<br \/>\n\tTherefore, present Misc.
