J U D G M E N T<\/p>\n
Dr. ARIJIT PASAYAT, J.\n<\/p>\n
1.\tChallenge in this appeal is to the order passed by a
\nlearned Single Judge of the Allahabad High Court dismissing
\nthe writ petitions filed by the appellants.  Challenge before the
\nHigh Court was to the order passed by the Presiding Labour
\nCourt (II) U.P. Kanpur in Adjudication case-Arbitration dispute
\nNo. 164 of 1989.\n<\/p>\n
2.\tThe following question was sent to the Labour Court for
\ndecision under Section 4(iv) of the U.P. State Industrial
\nDisputes Act, 1947 (in short the ‘State Act):\n<\/p>\n
“Whether 61 labourers mentioned in the
\nAppendix should be declared permanent?   If
\nso, then from which date and with what other
\nparticulars?”\n<\/p>\n
3.\tThe Labour Court held that 61 labourers connected with
\nthe case do not possess the right to be declared permanent
\nunder the employer- respondent No. 1.  So far as the question
\nto be made permanent under the contractor, it was found that
\nthey did not want to be declared permanent under the
\ncontractor.\n<\/p>\n
4.\tChallenge in the writ petition revolved around the
\nquestion as to the effect of the Contract Labour (Regulation
\nand Abolition) Act, 1970 (in short the “Act”).  In the
\nbackground of the definition of the word “employer” as in
\nclause IV of Section 2(i)(iv) of the State Act, The Indian
\nExplosive Limited is a manufacturer of Urea and is covered
\nunder the Act.  It is registered under Chapter III of the same
\nAct and has many licensed contractor including one Abdul
\nRehman (hereinafter referred to as the ‘Contractor’).  These
\nlicensed contractors engaged many persons to do the work
\ncontracted with them.  Fertilizer Workers Union (hereinafter
\nreferred to as the ‘Union’) filed an application under Rule 25\n<\/p>\n
(v)(a) of the U.P. Contract Labour (Regularisation and
\nAbolition) Rules, 1975 (in short the “Rules”) framed  under the
\nAct before the Labour Commissioner.\n<\/p>\n
5.\tThis was for the relief that the different persons working
\nunder the different licensed contractors are doing work similar
\nto the work assigned to the workmen of the company and
\nshould have similar conditions of service regarding wages,
\nholidays etc. Proceedings were initiated.  In the proceedings
\nunder Rule 25 of the Rules, the Labour Commissioner by his
\norder dated 15.12.1984 allowed the application so far as
\npersons engaged by the Contractor Rehman and one more
\nlicensed contractor but for rest of the persons application for
\nthe Union was dismissed.  The order of the Labour
\nCommissioner was upheld by the High Court. During
\npendency of the proceedings, under Rule 25 disputes were
\nraised by the Union which is the subject matter of
\nconsideration for the benefit of the workmen engaged by the
\nContractor-Rehman. As noted above, the Labour Court
\nrejected the application.\n<\/p>\n
6.\tMr. P.K.  Jain, learned counsel for the appellants
\nsubmitted that the High Court’s approach is hyper technical
\nand the benefits intended by various beneficial Statutes have
\nnot been kept in view.\n<\/p>\n
7.\tLearned counsel for the respondents on the other hand
\nsupported the judgment.\n<\/p>\n
8.\tA few observations made by the High Court which are
\nrelevant need to be noted.  It was held by the High Court as
\nfollows:\n<\/p>\n
“The labour court has held that the petitioners
\nwere not working as helpers to the fitters; they
\nwere not paid by the company; and were
\nengaged on contract for intermittent work i.e.
\nthey did not have regular or permanent work.
\nThe work that the petitioners do may be similar
\nto the work of the workman of the company,
\nbut they are not doing the work that is ordinary
\npart of the industry.  This is for reason that
\nthey-\n<\/p>\n
?\tdid not have permanent work;\n<\/p>\n
?\twere engaged in intermittent work
\nand
\n?\tthemselves claimed to be workmen of
\nthe contractor Rehman in proceedings
\nunder Rule 25 of the Labour Contract Act
\nand got benefit under the same.”\n<\/p>\n
9.\tSimilarly, the Labour Court noted that contractor
\nRehman had applied to the administration for licence under
\nthe State Contract Labour Act and considering the nature of
\nthe contract licence has been granted to him.\n<\/p>\n
10.\tIn Steel Authority of India Ltd. v. Union of India & Ors.<\/a>
\n[2006(12) SC 233] it was inter-alia held as follows:
\n“The workmen whether before the Labour
\nCourt or in writ proceedings were represented
\nby the same union. A trade union registered
\nunder the Trade Unions Act is entitled to
\nespouse the cause of the workmen. A definite
\nstand was taken by the employees that they
\nhad been working under the contractors. It
\nwould, thus, in our opinion, not lie in their
\nmouth to take a contradictory and
\ninconsistent plea that they were also the
\nworkmen of the principal employer. To raise
\nsuch a mutually destructive plea is
\nimpermissible in law. Such mutually
\ndestructive plea, in our opinion, should not be
\nallowed to be raised even in an industrial
\nadjudication. Common law principles of
\nestoppel, waiver and acquiescence are
\napplicable in an industrial adjudication.”\n<\/p>\n
11.\tIn view of the factual position highlighted above and the
\nratio of the decision in Steel Authority’s case (supra), the
\ninevitable result is that the appeal is sans merit, deserves
\ndismissal, which we direct with no order as to costs.<\/p>\n","protected":false},"excerpt":{"rendered":"
