Justice P.N.RAVINDRAN\n\n Dated :23\/09\/2010\n\n O R D E R\n                        P.N.RAVINDRAN, J.\n\n                     -------------------------------\n\n                    W.P.(C) No. 29270 of 2010\n\n                     -------------------------------\n\n          Dated this the 23rd day of September, 2010\n\n                           J U D G M E N T\n<\/pre>\n<p>            The petitioner is a former employee of the Kerala State<\/p>\n<p>Road Transport Corporation (hereinafter referred to as the &#8216;KSRTC&#8217; for<\/p>\n<p>short). He retired from service on 31.3.2010 while he was working as<\/p>\n<p>Inspector in the KSRTC.        Thereupon, payment of pension was<\/p>\n<p>sanctioned to him reckoning his total qualifying service as 28 years.<\/p>\n<p>The grievance voiced by the petitioner is that the Corporation has<\/p>\n<p>arbitrarily reduced one month&#8217;s      service from his total qualifying<\/p>\n<p>service of 28 years 6 months and 27 days, and as a result thereof,<\/p>\n<p>instead of treating his qualifying service as 29 years, the total<\/p>\n<p>qualifying service was reckoned as 28 years, thereby resulting in<\/p>\n<p>reduced pension. The petitioner submits that aggrieved thereby, he<\/p>\n<p>has filed Ext.P2 representation dated 18.8.2010 before the Managing<\/p>\n<p>Director of the Corporation. In this writ petition, he seeks a direction<\/p>\n<p>to the Corporation to consider his request in Ext.P2 within a time limit<\/p>\n<p>to be fixed by this Court.\n<\/p>\n<p>            2. Sri.V.V.Nandagopal Nambiar, the learned standing<\/p>\n<p>counsel appearing for the KSRTC, submits that if the original of Ext.P2<\/p>\n<p>W.P.(C) No.29270 of 2010<\/p>\n<p><span class=\"hidden_text\">                                      2<\/span><\/p>\n<p>representation has been received and is pending with the Managing<\/p>\n<p>Director of Corporation, the Managing Director will take an<\/p>\n<p>appropriate decision in the matter expeditiously and in any event,<\/p>\n<p>within a period of three months.\n<\/p>\n<p>              In the light of the said submission, I dispose of this writ<\/p>\n<p>petition with a direction to the Managing Director of the Corporation to<\/p>\n<p>consider     Ext.P2     and  take  an    appropriate decision   thereon<\/p>\n<p>expeditiously and in any event, within a period of three months from<\/p>\n<p>the date of production of a copy of this judgment.
