Justice K.HEMA\n\n Dated :12\/12\/2008\n\n O R D E R\n                           K.HEMA, J.\n\n               -----------------------------------------\n                     B.A.No. 7418 of 2008\n               -----------------------------------------\n\n            Dated this the 12th December, 2008\n\n                            O R D E R\n<\/pre>\n<p>     This petition is for anticipatory bail.<\/p>\n<p>     2. The alleged offences are under Sections 417 and 420<\/p>\n<p>read with 34 of the Indian Penal Code. Petitioner and her<\/p>\n<p>husband, who are accused 2 and 1 respectively, allegedly<\/p>\n<p>cheated de facto complainant by persuading him to pay<\/p>\n<p>Rs.8,00,000\/- offering an employment as teacher in the school.<\/p>\n<p>Thereafter, no employment was given and the amount was also<\/p>\n<p>not paid.\n<\/p>\n<p>     3. Learned counsel for petitioner submitted that first<\/p>\n<p>accused is Manager of the school and petitioner is his wife.<\/p>\n<p>The allegation is that first accused received huge amount from<\/p>\n<p>various persons offering employment               and such persons,<\/p>\n<p>including de facto complainant, filed suit against first accused.<\/p>\n<p>In the suit second accused was not a defendant. Petitioner is<\/p>\n<p>implicated in criminal case only with a view to settle the civil<\/p>\n<p>cases, it is submitted. Petitioner is absolutely innocent of the<\/p>\n<p>allegations made and only vague allegations are made against<\/p>\n<p>her that it was at her instance that the amount was paid.<\/p>\n<p><span class=\"hidden_text\">  BA.7418\/08                     2<\/span><\/p>\n<p>Hence, anticipatory bail may be granted, it is submitted. It is<\/p>\n<p>also pointed out that in ten other similar cases, petitioner was<\/p>\n<p>grant anticipatory bail.\n<\/p>\n<p>     4. Learned Public Prosecutor submitted that the<\/p>\n<p>allegations against petitioner is that it is at her instance that<\/p>\n<p>the amount was paid.\n<\/p>\n<p>     5. On hearing both sides, I am satisfied that anticipatory<\/p>\n<p>bail can be granted to petitioner on conditions. Hence, the<\/p>\n<p>following order is passed:\n<\/p>\n<blockquote><p>            Petitioner   shall  surrender    before   the<\/p>\n<p>      Magistrate Court within seven days from today<\/p>\n<p>      and she shall be released on bail on her<\/p>\n<p>      executing a bond for Rs.25,000\/- with two solvent<\/p>\n<p>      sureties each for the like sum to the satisfaction<\/p>\n<p>      of the learned Magistrate, on the following<\/p>\n<p>      conditions:<\/p>\n<blockquote><p>            i)      Petitioner shall report before the<\/p>\n<p>                     investigating officer as and when<\/p>\n<p>                     directed.\n<\/p><\/blockquote>\n<blockquote><p>            ii)       Petitioner shall not commit any<\/p>\n<p>                     offence while on bail.<\/p>\n<\/blockquote>\n<\/blockquote>\n<p>     Petition is allowed.<\/p>\n<p>                                  K.HEMA, JUDGE<br \/>\nvgs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Meerabai vs The State Of Kerala on 12 December, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 7418 of 2008() 1.
