No Affidavit in reply is filed by the<br \/>\nrespondents controverting the averments made by the petitioner.\n<\/p>\n<p>3.\tThe<br \/>\npetitioner came to be detained as &#8220;bootlegger&#8221; on his<br \/>\ninvolvement in the offence being  Prohibition CR No.292 of 2011,<br \/>\nregistered with Makarpura Police Station, Vadodara.\n<\/p>\n<p>4.\tIt<br \/>\nhas been submitted by the learned Counsel for the petitioner that it<br \/>\nis a settled legal position that on registration of single solitary<br \/>\noffence, no order of detention could have been passed as petitioner &#8211;<br \/>\ndetenu cannot be branded as &#8220;bootlegger&#8221;. It has been<br \/>\nfurther submitted that the activities of the petitioner cannot be<br \/>\nsaid to be injurious to the public health or public order. It has<br \/>\nbeen further submitted by the learned Counsel for the petitioner that<br \/>\nthere is gross delay in passing the order of detention as well as<br \/>\nthere is gross delay in executing the order of detention.\n<\/p>\n<p>5.\tI<br \/>\nhave gone through the grounds of detention and considered the<br \/>\narguments advanced by the learned Counsel for the petitioner as well<br \/>\nas the learned A.G.P.\n<\/p>\n<p>6.\tThe<br \/>\nCourt is of the opinion that there is much substance in the arguments<br \/>\nadvanced by learned Counsel for the petitioner. It is seen from the<br \/>\ngrounds that a general statement has been made by the detaining<br \/>\nauthority that consuming liquor is injurious to health. In fact, a<br \/>\nperusal of the order passed by the detaining authority shows that the<br \/>\ngrounds which are mentioned in the order are in reference to the<br \/>\nsituation of &#8220;law and order&#8221; and not &#8220;public<br \/>\norder&#8221;. Therefore, on this ground, the subjective satisfaction<br \/>\nof the detaining authority is vitiated on account of non-application<br \/>\nof mind and the impugned order, therefore, deserves to be quashed and<br \/>\nset aside.\n<\/p>\n<p>7.\tExcept<br \/>\nthe general statement, there is no material on record which shows<br \/>\nthat the petitioner &#8211; detenue is carrying out illegal<br \/>\nactivities of selling liquor which is harmful to the health of the<br \/>\npublic. In the case of ASHOKBHAI JIVRAJ @ JIVABHAI SOLANKI v\/s.<br \/>\nPOLICE COMMISSIONER, Surat, reported in 2001 (1) GLH 393,<br \/>\nhaving considered the decision of the Hon&#8217;ble Apex Court in the case<br \/>\nof Ram manohar Lohia v\/s. State of Bihar, reported in AIR<br \/>\n1966 SC 740, this Court held that the cases wherein the detention<br \/>\norder are passed on the basis of the statements of such witness fall<br \/>\nunder the maintenance of &#8220;law and order&#8221; and not &#8220;public<br \/>\nOrder&#8221;.\n<\/p>\n<p>8.\tApplying<br \/>\nthe ratio of the above decisions, it is clear that before passing an<br \/>\norder of detention, the detaining authority must come to a definite<br \/>\nfindings that there is threat to the &#8216;public order&#8217; and it is very<br \/>\nclear that the present case would not fall within the category of<br \/>\nthreat to a public order. In that view of the matter, when the order<br \/>\nof detention has been passed by the detaining authority without<br \/>\nhaving adequate grounds for passing the said order, cannot be<br \/>\nsustained and, therefore, it deserves to be quashed and set aside.\n<\/p>\n<p>9.\tIn<br \/>\nthe result, this petition is allowed. The impugned order of detention<br \/>\ndated 02.5.2011 passed by the Police Commissioner, Vadodara City, is<br \/>\nhereby quashed and set aside. The detenu is ordered to be set at<br \/>\nliberty forthwith, if not required in any other case. Rule is made<br \/>\nabsolute accordingly.
