Learned APP appearing for the respondent &#8211; State<br \/>\n\tsubmitted that an appeal from the same judgment is filed by the<br \/>\n\tState and that Criminal Appeal No.15 of 2011 is admitted on<br \/>\n\t29.8.2011. It was, therefore, submitted even by learned counsel,<br \/>\n\tMr.Brijesh Limbachiya, appearing with learned counsel Mr.Mitesh<br \/>\n\tR.Amin, appearing for the original accused persons and respondents<br \/>\n\tNo.2 to 5 herein that entertaining present application and appeal is<br \/>\n\tnot necessary while the applicant shall have the right to assist<br \/>\n\tlearned PP or learned APP, as the case may be, in the appeal of the<br \/>\n\tState. It was, however, insisted by learned counsel, Ms.Sancheti,<br \/>\n\tappearing for the applicant that the applicant\/appellant has the<br \/>\n\tstatutory right u\/s.372 of the Cr.P.C. to present the appeal as the<br \/>\n\tvictim, and the appellant would insist upon her independent right of<br \/>\n\taudience as the victim of the serious offences alleged to have been<br \/>\n\tcommitted upon her.\n<\/p>\n<p>\tThere was limited<br \/>\n\tconsensus amongst learned counsel to the effect and to the extent<br \/>\n\tthat as long as the statutory right of the appellant herein to<br \/>\n\taddress the Court in the acquittal appeal was reserved and<br \/>\n\tprotected, duplication of the appeals was neither necessary nor<br \/>\n\tdesirable. Therefore, learned counsel for the respondent fairly<br \/>\n\tconceded that counsel for the appellant herein shall not only be<br \/>\n\tallowed to assist the State in its appeal, but may be given right of<br \/>\n\taudience before the Court and name of learned advocate for the<br \/>\n\tappellant herein may be shown as appearing for the appellant in the<br \/>\n\tState appeal i.e. Criminal Appeal No.15 of 2011.\n<\/p>\n<p>\tIn the above facts and<br \/>\n\tcircumstances, Criminal Misc.Application No.15895 of 2011 is<br \/>\n\tdisposed as unnecessary, insofar as leave to file the appeal is not<br \/>\n\trequired under the provisions of Section 372 of the Cr.P.C. and<br \/>\n\tCriminal Appeal No.2218 of 2010 is disposed, without entering into<br \/>\n\tmerits, only on the ground and subject to the direction that learned<br \/>\n\tcounsel appearing for the appellant shall have the right of audience<br \/>\n\tin the Criminal Appeal No.15 of 2011, as and when it is heard;
