JUDGEMENT<br \/>\n Heard the   learned   counsel   for   the   respective<br \/>\nparties.\n<\/p>\n<p>2.The present petition is filed by the petitioner<br \/>\noriginal complainant for transferring the Criminal Case<br \/>\nNo.3763   of   2001   from   the court of Metropolitan<br \/>\nMagistrate, Court No.17, Ahmedabad to the Court of<br \/>\nlearned Judicial Magistrate (F.C.), Dahod.\n<\/p>\n<p>3.Learned counsel for the petitioner has submitted<br \/>\nthat the petitioner is a lady and there is matrimonial<br \/>\ndispute   between    the    parties and at present, the<br \/>\npetitioner is residing at her parental house at Dahod and<br \/>\nthe petitioner had lodged the complaint against the<br \/>\nrespondents accused at Dahod, but as the incident in<br \/>\nquestion had taken place at Ahmedabad, officials at the<br \/>\nDahod Police Station, after registering the complaint,<br \/>\ntransferred the said complaint to the Sardar Nagar Police<br \/>\nStation, Ahmedabad.      It is further   submitted    that<br \/>\ninvestigation of the case is over and chargesheet is<br \/>\nsubmitted against the respondents accused and it is<br \/>\npending before the Metropolitan Magistrate, Court No.17,<br \/>\nAhmedabad for trial in which the petitioner          being<br \/>\ncomplainant and other witnesses have to remain before the<br \/>\ncourt at   Ahmedabad     on every adjournment.     If the<br \/>\npetitioner fails to remain present, the court issues<br \/>\nwarrant against her. For attending Court, petitioner has<br \/>\nto travel by bus from Dahod to Ahmedabad for which the<br \/>\npetitioner has to rush early in the morning at the bus<br \/>\nstation and in case she fails to get the bus, the court<br \/>\nissues warrant against her and such type of warrant has<br \/>\nbeen issued by the court. He has further submitted that<br \/>\npetitioner being a lady, attending Court at Ahmedabad<br \/>\nfrom Dahod causes hardship and inconvenience and at the<br \/>\nsame time, it is expensive also while the respondents are<br \/>\nwell settled persons and doing wholesale business of<br \/>\ngrocery in Ahmedabad.\n<\/p>\n<p>He has also relied upon the decision of the Apex<br \/>\nCourt, reported in A.I.R. 2000 S.C.     3406(1), wherein<br \/>\nthe Apex Court transferred the case of lady keeping in<br \/>\nmind the fact that divorce petition was filed by the<br \/>\nhusband at Bombay whereas the wife was residing at Jaipur<br \/>\nwith her child and it was difficult for the wife to<br \/>\ncontest the proceedigns pending in the Court at Bombay.\n<\/p>\n<p>He has also relied upon the decisions of the Apex<br \/>\nCourt reported in 1988 Cri.L.J. 1581, wherein the case<br \/>\nwas transferred by the Allahabad High Court on the ground<br \/>\nthat the court within whose jurisdiction wife resided<br \/>\nwith her father had jurisdiction to try the offence as<br \/>\n the offence was partly committed outside the court&#8217;s<br \/>\njurisdiction, when she was maltreated and continued to be<br \/>\ncommitted within court&#8217;s jurisdiction where she had been<br \/>\nleft with her father.\n<\/p>\n<p>He has also relied upon the decision of the Apex<br \/>\nCourt reported in 2001 A.I.R. SCW 4587, head note      of<br \/>\nwhich is as under;-\n<\/p>\n<pre> \"Criminal P.C.    (2   of   1974),   S.     179 -\n        Territorial jurisdiction Court      within   whose\n<\/pre>\n<p>        jurisdiction consequence has ensued Allegations<br \/>\n        that wife was subjected to physical torture when<br \/>\n        she was in family way and she had to be taken<br \/>\n        back to her parental house       at    place   &#8220;J&#8221;\n<\/p>\n<p>        Consequence of beating i.e.      miscarriage took<br \/>\n        place at place &#8220;J&#8221; &#8211; Court at Place &#8220;J&#8221; has<br \/>\n        jurisdiction to try offence Quashment of charge<br \/>\n        solely on ground that since act alleged against<br \/>\n        accused took place at place &#8220;I&#8221; where couple<br \/>\n        resided after marriage, the Courts at place &#8220;J&#8221;<br \/>\n        acquire no jurisdiction &#8211; Illegal.&#8221;\n<\/p>\n<p>Submitting accordingly he has prayed to transfer<br \/>\nthe criminal case in question from the Court at Ahmedabad<br \/>\nto Dahod.\n<\/p>\n<p>4.On the other hand, learned counsel for the<br \/>\nrespondent Nos.1 to 4 &#8211; original accused has mainly<br \/>\nargued that the respondent &#8211; Nos.3 and 4 are ladies.   In<br \/>\nthe criminal case in question, presence of the petitioner<br \/>\nbeing complainant on each and every adjournment before<br \/>\nthe concerned court at Ahmedabad is not necessary, but<br \/>\nher presence is required only for recording her oral<br \/>\nevidence. It is contended that when the case in question<br \/>\nwas kept for recording the evidence of the petitioner on<br \/>\n6\/8\/2002, the petitioner sought adjournment and hence the<br \/>\nmatter was adjourned.     Thereafter also, time and again<br \/>\napplications for adjournment was made and matter was<br \/>\nbeing adjourned.      Therefore, it is contended that<br \/>\npetitioner is not interested to proceed further with the<br \/>\nmatter and is not giving cooperation in disposing of the<br \/>\ncriminal case in question and almost on all adjournments,<br \/>\nthe respondents being original accused have to remain<br \/>\npresent before court on account of the act of the<br \/>\npetitioner. It is submitted that the criminal case is<br \/>\npending at the stage of recording her evidence and the<br \/>\ncourt is ready to record the evidence of the petitioner<br \/>\nand awaiting for presence of the petitioner for recording<br \/>\nher evidence, but the petitioner does not want to enter<br \/>\ninto witness box and finalize the criminal case in<br \/>\n question.    It is submitted that the petitioner is<br \/>\ninterested in delaying the case in question and instead<br \/>\nof appearing before the concerned court and giving her<br \/>\noral evidence, the petitioner has filed the present<br \/>\npetition with a view to harass the respondent Nos.1 to 4\n<\/p>\n<p>&#8211; original accused. It is further submitted that the<br \/>\npetitioner has falsely involved all the family members<br \/>\nincluding the petitioner Nos.3 and 4 though ladies and<br \/>\nmerely because the petitioner is a lady and attendance of<br \/>\ncourt at Ahmedabad from Dahod causes inconvenience to the<br \/>\npetitioner, the case in question cannot be transferred at<br \/>\nAhmedabad.   It is submitted the respondent Nos.3 and 4<br \/>\nare also ladies and they are also facing the same<br \/>\nproblems.\n<\/p>\n<p>5.In this   matter, this Court (Coram :        D.H.<br \/>\nWaghela, J.) has issued rule making it returnable on<br \/>\n11\/2\/2003, vide order dtd.21\/1\/2003.      The respondents<br \/>\nhave filed their reply against which, the petitioner has<br \/>\nfiled rejoinder.\n<\/p>\n<p>6.Having    heard   the    learned counsel for the<br \/>\nrespective parties and considering the evidence         on<br \/>\nrecord, it is clear that the petitioner has prayed for<br \/>\ntransfer of criminal case in question on the ground of<br \/>\nthe petitioner being a lady and attendance of criminal<br \/>\ncase in question from Dahod to at Ahmedabad causes<br \/>\ninconvenience and hardship and expensive. It is to be<br \/>\nnoted that the respondent Nos.3 and 4 also ladies and,<br \/>\ntherefore if the case in question is transferred, they<br \/>\nwill have to suffer the same problem.         Further, the<br \/>\ncriminal case in question is pending for recording the<br \/>\noral evidence of the petitioner and other witnesses since<br \/>\n20\/2\/2002 and from that date, the case has been adjourned<br \/>\nseveral times at the request of the petitioner.         It<br \/>\nappears that the petitioner is avoiding her statement<br \/>\nbeing     recorded    as     result   of    which,     the<br \/>\nrespondents-original     accused have to remain present<br \/>\nbefore the concerned court. Furthermore, presence of the<br \/>\npetitioner being complainant is not necessary on each and<br \/>\nevery adjournment. Her presence is required only for<br \/>\nrecording    her   statement,    but  instead    of giving<br \/>\ncooperation, she is seeking adjournments.\n<\/p>\n<p>7.So far as the decision of AIR 2000 S.C.   3406(1)<br \/>\ncited by the learned counsel for the petitioner is<br \/>\nconcerned, I am in total agreement with the law laid down<br \/>\nby the Apex Court in the said judgement.    In the said<br \/>\ncase, divorce petition was filed by the husband at Bombay<br \/>\nand wife was stationed at Jaipur with her small child and<br \/>\ntherefore, considering the difficulty of the wife to<br \/>\n contest the proceedigns at Bombay from time to time, the<br \/>\ndivorce petition was transferred from Bombay to Family<br \/>\nCourt at Jaipur.    Whereas in the present case, the<br \/>\npetitioner-original complainant and the respondent Nos.3<br \/>\nand 4, are ladies, and hence, the said decision is not<br \/>\napplicable to the facts of the present case.\n<\/p>\n<p>8.So far as the decision of 1988 Cri.L.J. 1581<br \/>\ncited by the learned counsel for the petitioner is<br \/>\nconcerned, I am in total agreement with the law laid down<br \/>\nby the Apex Court in the said judgement. Said case is<br \/>\nregarding territorial jurisdiction wherein the wife was<br \/>\nsent back to her father&#8217;s house after maltreating her for<br \/>\ndowry and wife fallen ill after her return to father&#8217;s<br \/>\nhouse due to mental shock due to cruelty of husband and<br \/>\nhis relatives.    In that case, the Apex Court has held<br \/>\nthat the court within whose jurisdiction wife resided<br \/>\nwith her father had jurisdiction to try the offence as<br \/>\nthe offence was partly committed outside the Court&#8217;s<br \/>\njurisdiction when she was maltreated and continued to be<br \/>\ncommitted within court&#8217;s jurisdiction where she had been<br \/>\nleft with her father. Whereas the facts of the present<br \/>\ncase is quite different than the cited case and hence the<br \/>\nsaid citation is also not applicable in this case.\n<\/p>\n<p>9.In the above peculiar facts and circumstances, I<br \/>\nam of the opinion that the present petition is required<br \/>\nto be rejected.    Hence, it is rejected.
