DAY, THE COURT MADE THE FOLLOWING:  — <\/p>\n
An employee   While
\ndischarging (lass  ~  1996 in the
\nbus bearing  i}l'35 piying on route
\nBangalore  committed certain acts
\nof misconduct with an articles of charge.<\/p>\n
Thejcharge  one of nonwissue of a ticket and non<\/p>\n
 'fare of Rs.51\/- from out of 72 passengers in<\/p>\n
 to the articles of charge was one of<\/p>\n
 denial 'leading to appointing an Enquiry Officer to<\/p>\n
 co'n"d_uct a domestic enquiry, followed by a report<\/p>\n
'  holding the Charge proved. The disciplinary authority<\/p>\n
issued a Show cause notice and elicited a response from<\/p>\n
the employee, culminating in an Order dt. 24.7.1998
\nM<\/p>\n
imposing the punishment of withholding of  _<\/p>\n
increments, permanently, and to treat v if<\/p>\n
suspension as such. The employee<\/p>\n
order initiated conciliatior1'\u00ab–.._Vproceedings'; 'Aumder the,'<\/p>\n
Industrial disputes Act,   which
\nled to a failure reportiliilfolliojiziedh  reference of the

\n at Bangalore, for
\nshort    was registered as

 ‘:w.*asi..i”icontendedlwthat the order of punishment was<\/p>\n
 cal.l.ed ‘qLueVsi’tion in an appeal before the Appellate<\/p>\n
Authoritj,T:;u’nder the KSRTC [conduct and Disciplinary]<\/p>\n
 Regulations, 1971 and as the Appellate authority did<\/p>\n
  2ri’ot..hear the appeal, the employee was constrained to<\/p>\n
 -\u00abinitiate conciliation proceedings which ended in a<\/p>\n
failure, and that the imposition of punishment was<\/p>\n
disproportionate to the proved act of misconduct,.’ _<\/p>\n

produce or~\u00ab.Vm’a1fk~,any’ documents as exhibits, While the<\/p>\n

 to W15. The Tribunal having<\/p>\n
regard to }:material on record answered the additional<\/p>\n
 issue”in:’1the negative by order dt. 28.8.2007 i.e. that the<\/p>\n
 enquiry held was not fair and proper. The<\/p>\n
,,._l3’ibuna1 extended an opportunity to the petitioner to<\/p>\n
adduee evidence to establish the charge before it, and<\/p>\n
though the proceeding was adjourned on \ufb01ve dates of<\/p>\n
hearing commencing from 19.9.2007 to 6.2.2008, the
\npetitioner did not avaii of the opportunity to adduce<\/p>\n
evidence. So also, the employee too did not<\/p>\n

evidence by order dt. 18.3.2008′–a.nd–‘_:u<\/p>\n
proceedings for arguments.\n<\/p>\n

nevertheless, as theie was’mn’o:’jrepresentation for the<\/p>\n
petitioner, passed thetaivard  Annexure-A<\/p>\n
setting aside  24.7.1998 and directing the<\/p>\n
petitioneir-.to-restore  monetary and service bene\ufb01ts<\/p>\n
 v  to’:gtheE ernp1oyee.\u00ab …Hence this writ petition.<\/p>\n
   petit1oner–Corporation is a mammoth<\/p>\n
organi.sation having in its fold Iarge number of<\/p>\n
  eeemployees in a hierarchy of positions commencing from<\/p>\n
t”-a’Peon to its Chairrnan, with an establishment known<\/p>\n
“as ‘Law Department’. It was the duty of each and every<\/p>\n
officer responsible and accountable in the petitioner-<\/p>\n
N<\/p>\n
 ‘K<\/p>\n
Corporation to ensure that legal proceedings before<\/p>\n
courts are handled with utmost care, caution,<\/p>\n
circumspection and responsibility. it was also”<\/p>\n
of the officers responsible to place  <\/p>\n
before the courts in support””ol””\u00abthe’..A  lioffkthe<\/p>\n
corporation, when called in question. the’. <\/p>\n
case, the petitioner neither.:pl.aced’— rele\\_}’:3nt.brnateria.ll’<\/p>\n

reference ‘of’the’:Vdirspute_:ik:as”made on 31.1.2005 and the<\/p>\n
petitioner’*-tiledfitslcounter on l2.9.2006 on the basis of<\/p>\n
  tlie3″\u00ab:reco’rds a\\}ajla_ble, Very strangely did not produce the<\/p>\n
 =recorrds* before the Tribunal. No reasons were<\/p>\n
for not producing the records in the said<\/p>\n
 proceedings. There was no responsible officer who<\/p>\n
 ~apj’peared before the Tribunal to substantiate the<\/p>\n
 ___reasons for not producing the records. In short,<\/p>\n
negligence and inaction cannot but be attributed to the<\/p>\n
Officers responsible in the said case. The inaction on<\/p>\n
M<\/p>\n
the part of the officers of the respondenbcorporation led<\/p>\n
to the award impugned.\n<\/p>\n
4. In the aforesaid factual matrix what _<\/p>\n
that the petitioner–corporation took_no pair1s::and:e’fforts”‘~<\/p>\n
to justify the order imposing the;’_’pu’nishrnent;Viwhiclgl<\/p>\n
was the subject matter ofllt_h’eV_Industrial  <\/p>\n
respondent–Corporati.on is _pub’lic enterprise serving<\/p>\n
the public and therefore,”ae.cbuntab}eV:ltoV public monies.<\/p>\n
The   monies by engaging
\nofficers}\\\u00a7vho’  and not accountable<\/p>\n
leading. to spending huge sums of monies towards<\/p>\n
,A ‘litigation .4ex.penses, smacks of the nature of business<\/p>\n
  E\u00a7y”‘.the petitioner–Corporation. There is not<\/p>\n
onlgrpwastalge of public money but also public time. The<\/p>\n
   filing of this petition without any valid and tenable<\/p>\n
A”‘groi.1nds is yet another case of wastage of public time<\/p>\n
‘and money. The Authority seem to be blind to the fact<\/p>\n
that without a valid and tenable ground in law ought<\/p>\n
lfi.\n<\/p>\n
not to have invoked the extraordinary writ jurisdiction<\/p>\n
under Article 227 of the Constitution of<\/p>\n
questioning the impugned award.\n<\/p>\n
In the facts and circumstanicesdi of”-tiliieg <\/p>\n
