Mr.Vinay Pandya<br \/>\n\tfor the respondents.\n<\/p>\n<p>By<br \/>\n\tway of the the present petition, the petitioner-detenu has<br \/>\n\tchallenged the legality and validity of the order of detention dated<br \/>\n\t8-10-2007 passed by the Police Commissioner, Ahmedabad City,in<br \/>\n\texercise of powers under the provisions of the Gujarat Prevention of<br \/>\n\tAnti-Social Activities Act, 1985( for short ?Sthe Act??).\n<\/p>\n<p>The<br \/>\n\tpetitioner-detenu is branded as a ?S bootlegger?? within the<br \/>\n\tmeaning of Sec.2 (b) of the Act as he was found involved in offences<br \/>\n\tunder the Bombay Prohibition Act by engaging in the transportation<br \/>\n\tand illegal sale and distribution of prohibited foreign liquor.<br \/>\n\tWhile passing the order of detention the detaining authority has<br \/>\n\tmainly considered the fact of registration of a single offence<br \/>\n\tpunishable under Sections 66.1B, 65AE and  81  of the Bombay<br \/>\n\tProhibition Act registered as CR no.5006\/2007 dated 12-7-2007 and<br \/>\n\tthe statement of the accused in the probibition case.\n<\/p>\n<p>The<br \/>\n\tlearned Advocate for the petitioner-detenu has assailed the order<br \/>\n\tunder challenge on various grounds. However,this petition is capable<br \/>\n\tof being disposed of on the sole ground as to whether there was<br \/>\n\tcredible material placed before the detaining authority to come to<br \/>\n\tthe conclusion that by the activities of the petitioner, public<br \/>\n\torder was disturbed or that public health was disturbed adversely.\n<\/p>\n<p>To<br \/>\n\treach to the subjective satisfaction that bootlegging activities of<br \/>\n\tthe petitioner were prejudicial to the maintenance of public order<br \/>\n\tand public health, the detaining authority must rely upon credible<br \/>\n\tand cogent material that the activities of the petitioner directly<br \/>\n\tor indirectly were causing or were likely to cause any harm danger<br \/>\n\tor alarm or feeling of insecurity among the general public or any<br \/>\n\tsection thereof or a grave or widespred danger to life, property or<br \/>\n\tthe public health. While undertaking this exercise, the detaining<br \/>\n\tauthority must draw a clear line between the cases falling within<br \/>\n\tbreach of law and order and breach of public order.\n<\/p>\n<p>The<br \/>\n\tfacts of the present case are squarely covered by a decision of the<br \/>\n\tApex Court in the matter of Darpan @ <a href=\"\/doc\/1753534\/\">Dharban Kumar Sharma vs.<br \/>\n\tState of Tamil Nadu and Ors.<\/a> (2003) 2 SCC 313 wherein while<br \/>\n\tdealing with solitary instance of robbery as ground for preventive<br \/>\n\tdetention, the Apex Court observed that there is nothing on record<br \/>\n\tto show that the reach and potentiality of the incident was so grave<br \/>\n\tas to disturb the even tempo of life of the community in the<br \/>\n\tlocality or disturb general peace and tranquility or create a sense<br \/>\n\tof alarm and insecurity in the locality. Solitary instance of<br \/>\n\trobbery was held not relevant for sustaining the order of detention<br \/>\n\tand that such incident could hardly be said to disturb public peace<br \/>\n\tor public order in jeopardy so as to bring the case within the<br \/>\n\tpurview of preventive detention.\n<\/p>\n<p>In<br \/>\n\tthe present case, the detaining authority has taken into<br \/>\n\tconsideration the investigation papers in solitary case registered<br \/>\n\tagainst the petitioner under the Bombay Prohibition Act. This case<br \/>\n\tis registered against the petitioner as he was found in possession<br \/>\n\tof 348 bottles prohibited foreeign liquor and that he was engaged in<br \/>\n\tthe business of storing and selling  foreign liquor in breach of law<br \/>\n\tfor which the petitioner can be adequately punished if found guilty.<br \/>\n\tSurely, the act constituting the offence cannot be said to have<br \/>\n\taffected the even tempo of life of the community. It is therefore<br \/>\n\tdifficult for this Court to accept that the petitioner has been<br \/>\n\trightly detained as the activities of the petitioner can at the most<br \/>\n\tbe termed as affecting law and order. In short, no further<br \/>\n\tdiscussion on the other points raised in this petition is required<br \/>\n\tas in the opinion of this Court, the order of detention is not<br \/>\n\tsustainable in the eye of law as the subjective satisfaction arrived<br \/>\n\tat by the detaining authority not legal and valid. The order under<br \/>\n\tchallenge is required to be quashed and set aside on this ground<br \/>\n\talone.\n<\/p>\n<p>In<br \/>\n\tthe result, the petition is allowed. The impugned order of detention<br \/>\n\tdated 8-10-2007 passed by the Police Commissioner, Ahmedabad City,<br \/>\n\tis hereby quashed and set aside and detenu is hereby ordered to be<br \/>\n\tset at liberty forthwith, if not required to be detained in any<br \/>\n\tother case. Rule is made absolute.
