Respondents\n\n\n     Petition filed under Article 226 of the Constitution of\nIndia,  praying  to issue a writ of mandamus  directing  the\nfirst  respondent to release the lorry bearing  Registration\nNo.KA,01\/AE.2599  seized   by  the  second   respondent   on\n8.1.2007  near Komparapatti Railway Station, Salem  District\nto the petitioner.\n\n\n   For Petitioner       : Mr. V. Dhandapani, Addl.G.P.\n\n\nO R D E R\n<\/pre>\n<p>           It  is well settled that the remedy under Article<\/p>\n<p>226  of the Constitution of India is a discretionary remedy.<\/p>\n<p>However, the Court exercises the power under Article 226  of<\/p>\n<p>the  Constitution of India in a judicial  manner.   In  this<\/p>\n<p>case,   the   petitioner&#8217;s  vehicle  has  been  seized   for<\/p>\n<p>committing  an offence under the Essential Commodities  Act.<\/p>\n<p>Pending  adjudication before the authority,  the  petitioner<\/p>\n<p>now prays for the release of the vehicle.  For that purpose,<\/p>\n<p>the  petitioner has  relied upon various judgments  of  this<\/p>\n<p>Court directing the authority to release the vehicles on the<\/p>\n<p>petitioner&#8217;s  fulfilling certain conditions imposed  by  the<\/p>\n<p>Court.  One among the conditions is to direct the petitioner<\/p>\n<p>to deposit  certain amount as directed by the Court.  Taking<\/p>\n<p>into consideration the spate of the writ petitions filed for<\/p>\n<p>release  of  vehicles, the amount to be deposited  has  been<\/p>\n<p>enhanced  and it varies depending upon the circumstances  of<\/p>\n<p>the  case,  gravity  of the offence and  the  value  of  the<\/p>\n<p>vehicles.\n<\/p>\n<\/p>\n<p>            2.   By   taking   the   above   criteria   into<\/p>\n<p>consideration,  while following the earlier orders  of  this<\/p>\n<p>Court,  the  first  respondent is directed  to  release  the<\/p>\n<p>vehicle  namely  lorry bearing Registration No.KA,01\/AE.2599<\/p>\n<p>seized   by  the  second  respondent  on  8.1.2007  on   the<\/p>\n<p>petitioner fulfilling the following conditions:<\/p>\n<blockquote><p>     &#8221;      i.  The  petitioner  shall  establish   the<br \/>\n     ownership  of  the vehicle by producing  necessary<br \/>\n     certificate before the first respondent;\n<\/p><\/blockquote>\n<blockquote><p>           ii.  The  petitioner shall not alienate  the<br \/>\n     vehicle in any manner till adjudication is over.\n<\/p><\/blockquote>\n<blockquote><p>           iii.  The petitioner shall deposit a sum  of<br \/>\n     Rs.20,000\/- (Rupees twenty thousand only) in cash,<br \/>\n     within a period of two weeks from today.\n<\/p><\/blockquote>\n<blockquote><p>            iv.  The  petitioner  shall  also  give  an<br \/>\n     undertaking  that he will not use the vehicle  for<br \/>\n     any  illegal  activities in  future  and  also  to<br \/>\n     produce  the vehicle as and when required  by  the<br \/>\n     first respondent.&#8221;\n<\/p><\/blockquote>\n<p>This writ petition  is  ordered accordingly.
