Justice ANTONY DOMINIC\n\n Dated :20\/07\/2009\n\n O R D E R\n                     ANTONY DOMINIC, J.\n                    ================\n                W.P.(C) NO. 12346 OF 2009 (K)\n                =====================\n\n            Dated this the 20th day of July, 2009\n\n                        J U D G M E N T\n<\/pre>\n<p>      The challenge in this writ petition is against Ext.P2 order<\/p>\n<p>passed by the Additional District Magistrate exercising his powers<\/p>\n<p>under Section 16 of the Indian Telegraph Act.<\/p>\n<p>      2.   The petitioner only suggests that if the line is drawn<\/p>\n<p>through the boundary of her property, damages to the property<\/p>\n<p>being cut into two pieces could be avoided. Therefore, the only<\/p>\n<p>request made is that the respondents be directed to consider the<\/p>\n<p>feasibility of drawing the line through the boundary of her<\/p>\n<p>property.\n<\/p>\n<p>      3.   Having gone through Ext.P2 and also on hearing the<\/p>\n<p>counsel for the beneficiary, I do not think that if the feasibility of<\/p>\n<p>avoiding an alignment through the middle of the petitioners<\/p>\n<p>property is explored that will be of any prejudice to the<\/p>\n<p>respondents and at the same time, it will be avoiding an injury to<\/p>\n<p>the petitioner also.\n<\/p>\n<p>      4.   Therefore, the writ petition is disposed of directing the<\/p>\n<p>1st respondent to consider whether it is possible to draw the line<\/p>\n<p>WPC 12346\/09<br \/>\n<span class=\"hidden_text\">                                :2 :<\/span><\/p>\n<p>to the premises of the 5th respondent through the boundary of the<\/p>\n<p>petitioner&#8217;s property and if such an alignment is feasible, to<\/p>\n<p>consider drawing the line through the said alignment.
