Justice R.BASANT\n\n Dated :14\/12\/2006\n\n O R D E R\n                               R.BASANT, J.\n\n                      ------------------------------------\n\n                      W.P.C.NO.13103 OF 2006\n\n                      ------------------------------------\n\n             Dated this the 14th day of December, 2006.\n\n\n                                JUDGMENT\n<\/pre>\n<p>      The petitioner has come to this Court with this Writ Petition<\/p>\n<p>under   Article   226   of   the   Constitution   of   India   to   quash   the<\/p>\n<p>criminal   prosecution   initiated   against   him   before   the   38th<\/p>\n<p>Metropolitan Magistrate Court at Ballard Pier, Mumbai.   The 1st<\/p>\n<p>respondent is the complainant.  The allegations raised is that the<\/p>\n<p>petitioner is guilty of the offence punishable under Sections 120<\/p>\n<p>B and 420 I.P.C.\n<\/p>\n<\/p>\n<p>      2.     The learned counsel for the respondent has raised an<\/p>\n<p>objection   that   this   Court   lacks   jurisdiction   to   quash   the<\/p>\n<p>proceedings pending before the Magistrate Court at Mumbai in<\/p>\n<p>the   light   of   the   decision   in  <a href=\"\/doc\/1293509\/\">Musaraf   Hossain   Khan   v.<\/p>\n<p>Bhagheeratha   Engg.   Ltd.<\/a>  [2006   (2)   KLT   525   (SC)].     He<\/p>\n<p>particularly   relies   on   the   following   passage   in   para.28,   which<\/p>\n<p>clearly   lays   down   that   ordinarily   only   such   High   Court,   within<\/p>\n<p>whose jurisdiction the subordinate court which passed the order<\/p>\n<p>is   situated,   alone   would   have   jurisdiction   to   entertain   the<\/p>\n<p>application.\n<\/p>\n<p>\n<span class=\"hidden_text\">W.P.C.NO.13103 OF 2006                     2<\/span><\/p>\n<blockquote><p>               &#8220;We   have   referred   to   the   scope   of   jurisdiction<\/p>\n<p>        under   Arts.226   and   227   of   the   Constitution   only   to<\/p>\n<p>        highlight   that   the   High   Courts   should   not   ordinarily<\/p>\n<p>        interfere  with  an  order  taking  cognizance passed by a<\/p>\n<p>        competent   court   of   law   except   in   a   proper   case.<\/p>\n<p>        Furthermore   only   such   High   Court   within   whose<\/p>\n<p>        jurisdiction   the   order   of   subordinate   court   has   been<\/p>\n<p>        passed,   would   have   the   jurisdiction   to   entertain   an<\/p>\n<p>        application   under   Art.227   of   the   Constitution   of   India<\/p>\n<p>        unless it is established that the earlier cause of action<\/p>\n<p>        arose within the jurisdiction thereof.&#8221;<\/p><\/blockquote>\n<p>         3.     I   find   no   circumstances   available   in   this   case,   which<\/p>\n<p>would   justify   this   Court   invoking   the   powers   under   Article<\/p>\n<p>226\/227   of   the   Constitution   or   Section   482   Cr.P.C   to   interfere<\/p>\n<p>with   the   order   passed   by   the   Magistrate   at   Mumbai   to   take<\/p>\n<p>cognizance of the offence allegedly committed by the petitioner.<\/p>\n<p>The mere facts that the alleged goods were supplied within the<\/p>\n<p>jurisdiction   of   this   Court   or   that   the   amount   allegedly   due   was<\/p>\n<p>demanded   within   this   State   are   not   sufficient   to   justify   the<\/p>\n<p>invocation   of   the   powers   under   Article   226\/227   of   the<\/p>\n<p>Constitution by this Court in respect of the cognizance taken by<\/p>\n<p>the court at Mumbai.\n<\/p>\n<\/p>\n<p>         4.
