The applicant has filed this application for regular bail,<br \/>\n\tunder Section 439 of the Code of Criminal Procedure, in connection<br \/>\n\twith the offence being CR No. I &#8211; 10  of 2011 registered with<br \/>\n\tA.C.B. Police Station, Vadodara, for the offence u\/ss. 7, 12,<br \/>\n\t13,(1)(d) r\/w 13(2) of the Prevention of Corruption Act.\n<\/p>\n<p>Heard<br \/>\n\tlearned Counsel for the applicant and learned APP for the<br \/>\n\trespondent. Learned Advocate, appearing for the applicant has<br \/>\n\tcontended that the applicant is falsely implicated in the alleged<br \/>\n\toffence. He has contended that the applicant is practicing Advocate<br \/>\n\tand he had gone to visit his client who was in custody at Vadodara<br \/>\n\tfor filing anticipatory Bail Application. The applicant does not<br \/>\n\tknow the original accused No.1 as well as the complainant and even<br \/>\n\tas per the case of prosecution, the applicant has not demanded any<br \/>\n\tamount from the complainant on behalf of the original accused No.1.<br \/>\n\tHe has contended that there is no recovery of any bribe amount from<br \/>\n\tthe possession of the applicant. He has also contended that the case<br \/>\n\trelates to the documentary evidence and the documents are already<br \/>\n\tseized by the Investigating Agency and the witnesses are the pub lic<br \/>\n\tservants and, therefore, there is no question of tampering with the<br \/>\n\twitnesses. He has also contended that the petitioner is not a public<br \/>\n\tservant and, therefore, no offence under Sections 7 or 13(1)(d) r\/w<br \/>\n\t13(2) of the P.C. Act are made out against the applicant. Therefore,<br \/>\n\t  looking to the facts of the case the applicant may be released on<br \/>\n\tbail by imposing suitable conditions. Learned APP has vehemently<br \/>\n\topposed this application.\n<\/p>\n<p>Having<br \/>\n\theard the learned Advocate for the parties and looking to the facts<br \/>\n\tof the case and the fact that now the charge-sheet is filed and,<br \/>\n\ttherefore, without entering into the merits of the case, I am<br \/>\n\tinclined to grant this application. Both the parties do not press<br \/>\n\tfor reasoned order.\n<\/p>\n<p>Considering<br \/>\n\tthe above, this Application is allowed. The applicant is ordered to<br \/>\n\tbe released on bail in connection with CR No. I &#8211; 10 of 2011<br \/>\n\tregistered with A.C.B. Police Station, Vadodara, for the offences<br \/>\n\talleged against him in this application on his executing a Bond of<br \/>\n\tRs.10,000\/- (Rupees ten thousand only) with one solvent surety of<br \/>\n\tthe like amount to the satisfaction of the trial Court and subject<br \/>\n\tto the conditions that he shall-\n<\/p>\n<p>a)\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>b)\tnot<br \/>\nto try to tamper or pressurize the prosecution witnesses or<br \/>\ncomplainant in any manner;\n<\/p>\n<p>c)\tmaintain<br \/>\nlaw and order and should cooperate the Investigating Officers;\n<\/p>\n<p>d)\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>e)\tnot<br \/>\nleave the State of Gujarat without the prior permission of the<br \/>\nconcerned Sessions Judge.\n<\/p>\n<p>f)\tfurnish<br \/>\nthe address of his residence to the I.O. and also to the Court at the<br \/>\ntime of execution of the bond and shall not change the residence<br \/>\nwithout prior permission of this Court;\n<\/p>\n<p>g)\tsurrender<br \/>\nhis passport, if any, to the lower Court within a week.\n<\/p>\n<p>5.\tIf<br \/>\nbreach of any of the above conditions is committed, the concerned<br \/>\nSessions Judge will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>6.\tBail<br \/>\nbefore the lower Court having jurisdiction to try the case. It would<br \/>\nbe open to the trial Court concerned to give time to furnish the<br \/>\nsolvency certificate if prayed for.\n<\/p>\n<p>7.\tRule<br \/>\nis made absolute.
