SHAH\n\t\t\n\t\n\n \n\nDate\n: 01\/08\/2008 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\t\tIn<br \/>\nthe present Appeal From Order, the appellants   original defendants<br \/>\nhave challenged the order passed by the learned Judge, City Civil<br \/>\nCourt No.19, Ahmedabad dated 16.6.2005  below Notice of Motion below<br \/>\nExhs.6 &amp; 7 in Civil Suit No.890\/2005.\n<\/p>\n<p>2.\t\tIt<br \/>\nappears that the original plaintiffs have filed the Civil Suit<br \/>\nNo.890\/2005 along with the Notice of Motion, inter-alia contending<br \/>\nthat the suit property bearing City Survey No.4265 and  Municipal<br \/>\nCensus No.2469\/1 at Shahpur ward City and Taluka, District Ahmedabad<br \/>\nis given to the plaintiffs as gift on 03.06.1960; and all the<br \/>\ndefendants are the co-owners of the property bearing City Survey<br \/>\nNo.4266, and they are also in possession of the said property. Both<br \/>\nthe properties are adjoining to each other, and there is a common<br \/>\nwall and common chowk between the two properties; and that the<br \/>\ndefendants have made illegal construction in the common chowk and are<br \/>\nrestraining the plaintiffs to take water connection from common<br \/>\nchowk. And, therefore, in the said Notice of Motion, it was prayed<br \/>\nfor removal of illegal construction, and also prayed that defendants<br \/>\nshould not restrain the plaintiffs from taking water from the common<br \/>\nchowk of the suit property. Learned Judge, City Civil Court has<br \/>\nallowed the Notice of Motion by his order dated 16.06.2005, granting<br \/>\nthe relief in terms of paragraph 7(b), restraining the defendants<br \/>\nfrom obstructing the plaintiff, while the plaintiffs are taking water<br \/>\nconnection in his property bearing City Survey No.4265 from the<br \/>\ncommon chowk between the property of the plaintiffs and the<br \/>\ndefendants; and they are also restrained from obstructing the<br \/>\nplaintiffs while repairing electric connection or drainage connection<br \/>\nin the common plot.\n<\/p>\n<p>3.\t\tAt<br \/>\nthe outset, it is required to be noted that the impugned order has<br \/>\nbeen passed on 16.6.2005, and till date, there is no interim order in<br \/>\nfavour of the appellants, meaning thereby that the order passed below<br \/>\nNotice of Motion is in operation since last more than three years.<br \/>\nEven otherwise, this Court has gone through the map prepared by the<br \/>\nCourt Commissioner, produced by the ld.advocate appearing on behalf<br \/>\nof the appellants, and looking to the same, it appears that there is<br \/>\na common chowk, and on one side there is a property belonging to the<br \/>\nplaintiffs, and on the other side, there is a property belonging to<br \/>\nthe defendants, and their exists one water tank and the common chowk,<br \/>\ndrainage etc. <\/p>\n<p>4.\t\tConsidering<br \/>\nthe above, prima-facie it appears that the learned Judge, City Civil<br \/>\nCourt has not committed any error in granting relief only in terms of<br \/>\nparagraph 7(b). Under the circumstances, as there is no illegality<br \/>\ncommitted by the learned Trial Court, the same does not warrant any<br \/>\ninterference of this Court.\n<\/p>\n<p>5.\t\tIt<br \/>\nwill be open for the respective parties to move an appropriate<br \/>\napplication before the learned Trial Court, for expeditious hearing<br \/>\nof the Suit, and if the pleadings are completed, the same shall be<br \/>\nconsidered by the Trial Court.\n<\/p>\n<p>6.\t\tAccordingly,<br \/>\nthe present Appeal From Order requires to be dismissed, and the same<br \/>\nis dismissed. In view of the dismissal of the Appeal From Order, no<br \/>\norder in Civil Application.
