SANKARAN, J.\n\n            ---------------------------------\n\n                   B.A. NO. 2120 OF  2007\n\n            ---------------------------------\n\n         Dated this the 17th day of April, 2007\n\n\n\n                          O R D E R\n<\/pre>\n<p>     This   is   an   application   for   bail   under   Section   439<\/p>\n<p>of the Code of Criminal Procedure.\n<\/p>\n<p>     2.   The petitioner is the accused in C.R. No.12 of<\/p>\n<p>2007   of   Excise   Range,   Payyanur.     The   offence   alleged<\/p>\n<p>against   him   is   under   Section   8(i)   and   8(ii)   of   the<\/p>\n<p>Abkari Act.\n<\/p>\n<p>     3.     The   petitioner   moved   applications   for   bail<\/p>\n<p>before   the  Court  of  Sessions,  Thalassery,  but  the  same<\/p>\n<p>were   dismissed   by   the   orders   dated   16.3.2007   and<\/p>\n<p>27.3.2007.\n<\/p>\n<p>     4.     Heard   the   learned   counsel   for   the   petitioner<\/p>\n<p>and the learned Public Prosecutor.   It is submitted by<\/p>\n<p>the   learned   counsel   for   the   petitioner   that   the<\/p>\n<p>petitioner   is   undergoing   detention   from   9.3.2007<\/p>\n<p>onwards.     The prosecution case is that the petitioner<\/p>\n<p>B.A.NO.   2120   OF 2007<\/p>\n<p>                                   ::  2  ::\n<\/p>\n<p>was   found   in   possession   of   six   litres   of   arrack.\n<\/p>\n<p>Though it is alleged that the petitioner is involved in<\/p>\n<p>other   cases,   there   is   no   case   that   he   has   been<\/p>\n<p>punished.     The   petitioner   undertakes   that   he   will   not<\/p>\n<p>indulge in similar activities as alleged and that he is<\/p>\n<p>prepared to abide by any of the conditions that may be<\/p>\n<p>imposed.\n<\/p>\n<p>        In   the   facts   and   circumstances   of   the   case,   I   am<\/p>\n<p>inclined   to   grant   bail   to   the   petitioner.
